- 当該個人が公務員等(国家公務員法(昭和二十二年法律第百二十号)第二条第一項に規定する国家公務員(独立行政法人通則法(平成十一年法律第百三号)第二条第二項に規定する特定独立行政法人及び日本郵政公社の役員及び職員を除く。)、独立行政法人等(独立行政法人等の保有する情報の公開に関する法律(平成十三年法律第百四十号。以下「独立行政法人等情報公開法」という。)第二条第一項に規定する独立行政法人等をいう。以下同じ。)の役員及び職員、地方公務員法(昭和二十五年法律第二百六十一号)第二条に規定する地方公務員並びに地方独立行政法人(地方独立行政法人法(平成十五年法律第百十八号)第二条第一項に規定する地方独立行政法人をいう。以下同じ。)の役員及び職員をいう。)である場合において、当該情報がその職務の遂行に係る情報であるときは、当該情報のうち、当該公務員等の職及び当該職務遂行の内容に係る部分
- In the case that the said individual is a Public Officer, etc. (national public officers prescribed in Article 2, paragraph 1 of the National Public Officer Act [Act No. 120 of 1947] [excluding officers and employees of the specified incorporated administrative agencies prescribed in Article 2, paragraph 2 of the Act on General Rules for Incorporated Administrative Agency (Act No. 103 of 1999) and of the Japan Post]; officers and employees of the Incorporated Administrative Agencies, etc. (meaning the incorporated administrative agencies, etc. prescribed in Article 2, paragraph 1 of the Act on Access to Information Held by Incorporated Administrative Agencies (Act No. 140 of 2001. Hereinafter referred to as 'Incorporated Administrative Agency, etc. Information Disclosure Act'); local public officers prescribed in Article 2 of the Local Public Officer Act (Act No. 261 of 1950).); and officers and employees of the Local Incorporated Administrative Agencies [which means local incorporated administrative agencies prescribed in Article 2, paragraph 1 of the Act on Local Incorporated Administrative Agencies(Act No. 118 of 2003).The same shall apply hereinafter.]), and when the said information is one pertaining to the performance of his or her duties, the portion of the said information pertaining to the job of the said Public Officer, etc. and the substance of the said performance of duties.
- この法律の施行の際現に従前の総理府、法務省、外務省、大蔵省、文部省、厚生省、農林水産省、通商産業省、運輸省、郵政省、労働省、建設省又は自治省(以下この条において「従前の府省」という。)の職員(国家行政組織法(昭和二十三年法律第百二十号)第八条の審議会等の会長又は委員長及び委員、中央防災会議の委員、日本工業標準調査会の会長及び委員並びにこれらに類する者として政令で定めるものを除く。)である者は、別に辞令を発せられない限り、同一の勤務条件をもって、この法律の施行後の内閣府、総務省、法務省、外務省、財務省、文部科学省、厚生労働省、農林水産省、経済産業省、国土交通省若しくは環境省(以下この条において「新府省」という。)又はこれに置かれる部局若しくは機関のうち、この法律の施行の際現に当該職員が属する従前の府省又はこれに置かれる部局若しくは機関の相当の新府省又はこれに置かれる部局若しくは機関として政令で定めるものの相当の職員となるものとする。
- A person who, at the time of the enforcement of this Act, has been an official (excluding a chairperson and a member of councils, etc. set forth in Article 8 of the National Government Organization Act [Act No. 120 of 1948], a member of the Central Disaster Prevention Council, a chairperson and a member of the Japanese Industrial Standards Committee, and those specified as similar persons by a Cabinet Order) of the prior and existing Prime Minister's Office, the Ministry of Justice, the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Education, the Ministry of Health and Welfare, the Ministry of Agriculture, Forestry and Fisheries, the Ministry of International Trade and Industry, the Ministry of Transport, the Ministry of Posts and Telecommunications, the Ministry of Labor, the Ministry of Construction or the Ministry of Home Affairs (hereinafter referred to as a 'Prior and Existing Ministry or Agency' in this Article) shall, unless an appointment is announced separately, become a relevant official of the Cabinet Office, the Ministry of Internal Affairs and Communications, the Ministry of Justice, the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Education, Culture, Sports, Science and Technology, the Ministry of Health, Labour and Welfare, the Ministry of Agriculture, Forestry and Fisheries, the Ministry of Economy, Trade and Industry, the Ministry of Land, Infrastructure and Transport, or the Ministry of the Environment after the enforcement of this Act (hereinafter referred to as a 'New Ministry or Agency' in this Article), or a department or organization established thereunder, which is specified by a Cabinet Order as the New Office or Ministry or the department or organization established thereunder that corresponds to the Former Office or Ministry or the department or organization established thereunder to which said official belongs at the time of the enforcement of this Act, with the same working conditions.
- Any employee (excluding presidents, chairpersons and members of councils, etc. in Article 8 of the National Government Organization Act (Act No. 120 of 1948), committee members of the Central Disaster Prevention Council, chairperson and committee members of Japanese Industrial Standards Committee, and persons prescribed by a Cabinet Order as being similar to these persons) of the former Prime Minister's Office, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Ministry of Health and Welfare, Ministry of Agriculture, Forestry and Fishery, Ministry of International Trade and Industry, Ministry of Transport, Ministry of Posts and Telecommunications, Ministry of Labour, Ministry of Construction or Ministry of Home Affairs (hereinafter referred to as 'Former Office or Ministry' in this Article) at the time of the effective date of this Act shall become the corresponding employee of the Cabinet Office, Ministry of Internal Affairs and Communications, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Culture, Sports, Science and Technology, Ministry of Health, Labour and Welfare, Ministry of Agriculture, Forestry and Fishery, Ministry of Economy, Trade and Industry, Ministry of Land, Infrastructure, Transport and Tourism or Ministry of Environment (hereinafter referred to as 'Current Office or Ministry' in this Article), or a bureau or institution established under the Current Office or Ministry prescribed by a Cabinet Order as corresponding to the Former Office or Ministry, or a bureau or institution established after the enforcement of this Act under the Former Office or Ministry to which said employee belongs at the time of the effective date of this Act, with the same working conditions, provided that a separate letter of appointment has not been issued.
- Any person who is actually the official of the former Prime Minister's Office, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Ministry of Health and Welfare, Ministry of Agriculture, Forestry and Fisheries, Ministry of International Trade and Industry, Ministry of Transport, Ministry of Posts and Telecommunications, Ministry of Labour, Ministry of Construction or Ministry of Home Affairs (hereinafter referred to as the 'Former Office/Ministry' in this Article) at the time of enforcement of this Act (excluding the president or chairperson and members of a council, etc. set forth in Article 8 of the National Administrative Organization Act (Act No. 120 of 1948), members of the Central Disaster Prevention Council, chairperson and members of the Japanese Industrial Standards Committee, and those specified by Cabinet Order as similar thereto) shall be the corresponding official of the Cabinet Office, the Ministry of Internal Affairs and Communications, the Ministry of Justice, the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Education, Culture, Sports, Science and Technology, the Ministry of Health, Labour and Welfare, the Ministry of Agriculture, Forestry and Fisheries, the Ministry of Economy, Trade and Industry, the Ministry of Land, Infrastructure, Transport and Tourism, or the Ministry of the Environment after the enforcement of this Act (hereinafter referred to as the 'New Office/Ministry' in this article) or a department or organization thereunder, which is specified by Cabinet Order as the New Office/Ministry or a department or organization thereunder that corresponds to the Former Office/Ministry or a department or organization thereunder to which the official actually belongs at the time of enforcement of this Act, unless a letter of appointment is otherwise issued.

- Persons who were actually the officials of the former Prime Minister's Office and former Ministries of Justice, Foreign Affairs, Finance, Education, Health and Welfare, Agriculture, Forestry and Fisheries, International Trade and Industry, Transport, Posts and Telecommunications, Labor, Construction, or Home Affairs (herein after referred in this Article as 'Former Office and Ministries') before the enforcement of this Act (except for presidents, chairpersons and members of the councils, etc. specified by Article 8 of National Government Organization Act (Act No. 120 of 1948), the members of the Central Disaster Prevention Council, the chairperson and members of the Japanese Industrial Standards Committee, and other similar persons specified by the Cabinet Order) shall be reasonable officials of the organs that are prescribed by the Cabinet Order and are equivalent to Former Office and Ministries they formerly served among the Cabinet Office and Ministries of Internal Affairs and Communications, Justice, Foreign Affairs, Finance, Education, Culture, Sports, Science and Technology, Health, Labour and Welfare, Agriculture, Forestry and Fisheries, Economy, Trade and Industry, Land, Infrastructure, Transport and Tourism, and the Environment (herein after referred in this Article as 'New Office and Ministries') after the enforcement of this Act or departments and bureaus formed in New Office and Ministries on the same working conditions unless other appointments are announced.
- A person who is an official (excluding, however, the chairperson and members of the Council, etc. under Article 8 of the National Government Organization Act (Act No. 120 of 1948)), the members of the Central Disaster Prevention Council, the chairperson and members of the Japanese Industrial Standards Committee, and those specified by a Cabinet Order as similar persons) of the former Prime Minister's Office, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Ministry of Health and Welfare, Ministry of Agriculture, Forestry and Fisheries, Ministry of International Trade and Industry, Ministry of Transport, Ministry of Posts and Telecommunications, Ministry of Labor, Ministry of Construction or Ministry of Home Affairs (hereinafter referred to as the 'Former Office or Ministry' in this Article) at the time of enforcement of this Act shall, unless an appointment is announced separately, become a corresponding official of the Cabinet Office, Ministry of Internal Affairs and Communications, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Culture, Sports, Science and Technology, Ministry of Health, Labour and Welfare, Ministry of Agriculture, Forestry and Fisheries, Ministry of Economy, Trade and Industry, Ministry of Land, Infrastructure, Transport and Tourism, or Ministry of the Environment after the enforcement of this Act (hereinafter referred to as the 'New Office or Ministry' in this Article) or a department or organization established thereunder, which is specified by a Cabinet Order as the New Office or Ministry or the department or organization established thereunder that corresponds to the Former Office or Ministry or the department or organization established thereunder to which the said official belongs at the time of enforcement of this Act, with the same working conditions.
- 外国法人が第五条の二第一項に規定する特定振替機関等(以下この条において「特定振替機関等」という。)又は第五条の二第五項第四号に規定する適格外国仲介業者(以下この条において「適格外国仲介業者」という。)から開設を受けている口座において当該特定振替機関等の国内にある営業所若しくは事務所(郵便局を含む。以下この条において「営業所等」という。)又は当該適格外国仲介業者の同項第五号に規定する特定国外営業所等(以下この条において「特定国外営業所等」という。)を通じて同項第六号に規定する振替記載等(以下この条において「振替記載等」という。)を受けている分離振替国債(社債等の振替に関する法律第九十条第二項に規定する分離元本振替国債及び財務省令で定めるところにより同条第一項に規定する元利分離が行われた同条第三項に規定する分離利息振替国債をいう。以下この条において同じ。)の保有又は譲渡により生ずる所得を有する場合の当該分離振替国債の保有又は譲渡により生ずる所得については、法人税を課さない。
- Where a foreign corporation has any income from the holding or transfer of book-entry transfer national government bonds in separate trading (meaning principal-only book-entry transfer national government bonds prescribed in Article 90(2) of the Act on Book-Entry Transfer of Company Bonds, etc. and coupon-only book-entry transfer national government bonds prescribed in paragraph (3) of the said Article for which separate trading of principal and interest prescribed in paragraph (1) of the said Article has been conducted pursuant to the provision of an Ordinance of the Ministry of Finance; hereinafter the same shall apply in this Article), for which the foreign corporation has made entries or records under the book-entry transfer system prescribed in Article 5-2(5)(vi) (hereinafter referred to in this Article as 'entries or records under the book-entry transfer system') in its account established with a specified book-entry transfer institution, etc. prescribed in Article 5-2(1) (hereinafter referred to in this Article as a 'specified book-entry transfer institution, etc.') or a qualified foreign intermediary prescribed in Article 5-2(5)(iv) (hereinafter referred to in this Article as a 'qualified foreign intermediary'), via a business office or any other office of the said specified book-entry transfer institution, etc. located in Japan (including a post office; hereinafter referred to in this Article as a 'business office, etc.') or a specified overseas business office, etc. prescribed in Article 5-2(5)(v) of the said qualified foreign intermediary, corporation tax shall not be imposed with respect to such interest from the holding or transfer of the said book-entry transfer national government bonds in separate trading.
- 販売業者又は役務提供事業者は、指定商品若しくは指定権利又は指定役務 につき売買契約又は役務提供契約の申込みをした者から当該商品の引渡し若しくは当該権利の移転又は当該役務の提供に先立つて当該商品若しくは当該権利の代 金又は当該役務の対価の全部又は一部を受領することとする通信販売をする場合において、郵便等により当該商品若しくは当該権利又は当該役務につき売買契約 又は役務提供契約の申込みを受け、かつ、当該商品若しくは当該権利の代金又は当該役務の対価の全部又は一部を受領したときは、遅滞なく、経済産業省令で定 めるところにより、その申込みを承諾する旨又は承諾しない旨(その受領前にその申込みを承諾する旨又は承諾しない旨をその申込みをした者に通知している場 合には、その旨)その他の経済産業省令で定める事項をその者に書面により通知しなければならない。ただし、当該商品若しくは当該権利の代金又は当該役務の 対価の全部又は一部を受領した後遅滞なく当該商品を送付し、若しくは当該権利を移転し、又は当該役務を提供したときは、この限りでない。
- Where a seller or a Service Provider intends to receive a charge for goods or rights or a consideration for services in whole or in part from a person who has made an application for entering into a sales contract for the Designated Goods or Designated Rights or a Service Contract for the Designated Services, prior to the delivery of the goods, the transfer of the rights, or the offering of the services in conducting Mail Order Sales, when it receives the application for entering into a sales contract for the goods or rights or a Service Contract for the services by Postal Mail, etc. and receives the charge for the goods or rights or the consideration for the services in whole or in part, it shall notify said person in writing of its acceptance or non-acceptance of the application (when it has notified the person who made the application about the acceptance or non-acceptance of the application prior to the receipt of the application, it shall be a statement to the effect) or other matters specified by an Ordinance of the Ministry of Economy, Trade and Industry without delay, pursuant to the provisions of an Ordinance of the Ministry of Economy, Trade and Industry. However, this does not apply when the seller or the Service Provider sent the goods, transferred the rights, or offered the services without delay after receiving the charge for the goods or rights or the consideration for the services in whole or in part.

However, this does not apply when the seller or the Service Provider sent the goods, transferred the rights, or offered the services without delay after receiving the charge for the goods or rights or the consideration for the services in whole or in part.
- 非居住者又は外国法人でその有する次の各号に掲げるものの区分に応じ当該各号に定める要件を満たすものが、特定振替機関、特定口座管理機関若しくは特定間接口座管理機関(以下この条において「特定振替機関等」という。)又は適格外国仲介業者から開設を受けている口座において当該特定振替機関等の国内にある営業所若しくは事務所(郵便局を含む。以下この条において「営業所等」という。)又は当該適格外国仲介業者の特定国外営業所等を通じて振替記載等を受けている社債等の振替に関する法律第八十八条に規定する振替国債(同法第九十条第三項に規定する分離利息振替国債を除く。以下この条において「振替国債」という。)又は同法第百十三条において準用する同法第六十六条の規定により同法の規定の適用を受けるものとされる地方債(以下この条において「振替地方債」という。)につきその利子(第八条第一項又は第二項の規定の適用があるものを除く。)の支払を受ける場合には、その支払を受ける利子(その者が当該振替国債又は当該振替地方債を引き続き所有していた期間(当該振替国債又は当該振替地方債につき引き続き振替記載等を受けていた期間に限る。以下この条において「所有期間」という。)に対応する部分の額として政令で定めるところにより計算した金額に相当する部分に限る。)については、所得税を課さない。
- Where a nonresident or foreign corporation who satisfies the requirements specified in each of the following items for the category of bonds listed in the relevant item that are held thereby, receives payment of interest (excluding interest subject to the provision of Article 8(1) or (2)) on book-entry transfer national government bonds prescribed by Article 88 of the Act on Book-Entry Transfer of Company Bonds, etc. (excluding coupon-only book-entry transfer national government bonds prescribed in Article 90(3) of the said Act; hereinafter referred to in this Article as 'book-entry transfer national government bonds') or local government bonds which shall be subject to the provisions of the said Act pursuant to Article 66 of the said Act as applied mutatis mutandis pursuant to Article 113 of the said Act (hereinafter referred to in this Article as 'book-entry transfer local government bonds'), for which the nonresident or foreign corporation has made entries or records under the book-entry transfer system in his/her or its account established with a specified book-entry transfer institution, specified account management institution or specified indirect account management institution (hereinafter referred to in this Article as a 'specified book-entry transfer institution, etc.') or a qualified foreign intermediary, via a business office or any other office of the said specified book-entry transfer institution, etc. located in Japan (including a post office; hereinafter referred to in this Article as a 'business office, etc.') or a specified overseas business office, etc. of the said qualified foreign intermediary, income tax shall not be imposed with respect to such interest to be received (limited to the part of interest equivalent to the amount calculated pursuant to the method specified by a Cabinet Order as the amount corresponding to the period during which the nonresident or foreign corporation has continued to hold the said book-entry transfer national government bonds or the said book-entry transfer local government bonds (limited to the period during which he/she or it has continued to hold entries or records under the book-entry transfer system regarding the said book-entry transfer national government bonds or the said book-entry transfer local government bonds; hereinafter referred to in this Article as the 'holding period'):
