- The employer shall, as regards movable electric cables or their connecting tools used at places where are wetted with water or other liquids having high conductivity and which workers may contact during work or passage, not use them unless the covering or armor of the said movable electric cables or their connecting tools have an insulating effect against the said liquids having high conductivity.

- The employer shall, as regards wirings which workers contact or may contact during work or passage and which have insulating coating (excluding those which only electrician contact or may contact in work set forth in item (iv) of Article 36), or movable electric cables, take measures for preventing the danger of electric shocks due to damage or aging of the insulating coating.

- The employer shall, when there exists a boiling basin, hopper, pit, etc., which is liable to cause dangers to workers due to a fall during work or passage, such as burns and suffocation, in order to prevent such dangers, provide a strong railing, etc., having a height of 75 cm or higher to necessary parts. However, this shall not apply to when having taken the measures to prevent workers from dangers such as having workers use safety belts, etc.
- 事業者は、建設中のずい道等の内部に軌道装置を設けるときは、通行中の労働者に運行する車両が接触する危険を防止するため、その片側において、当該車両と側壁又は障害物との間隔を〇・六メートル以上としなければならない。ただし、ずい道等の断面が狭小であること等により当該間隔を〇・六メートル以上とすることが困難な場合で、次のいずれかの措置を講じたときは、この限りでない。
- The employer shall, when installing railway equipment inside a tunnel, etc., under construction, provide a clearance of 0.6 m or more between a vehicle and the sidewall or obstacle on either side of the track in order to prevent the dangers of workers who are passing through being hit by vehicles in operation. However, this shall not apply to the case where providing the said clearance is difficult due to the small sectional area of the tunnel, etc., and any of the following measures has been taken:
- 都道府県知事又は市町村長は、家畜伝染病のまん延を防止するため緊急の必要があるときは、政令で定める手続に従い、七十二時間を超えない範囲内において期間を定め、牛疫、牛肺疫、口蹄疫又はアフリカ豚コレラの患畜又は疑似患畜の所在の場所(これに隣接して当該伝染性疾病の病原体により汚染し、又は汚染したおそれがある場所を含む。)とその他の場所との通行を制限し、又は遮断することができる。
- Prefectural governors or mayors of municipalities may, when urgently necessary for preventing the spread of a domestic animal infectious disease, restrict or block passage between places where animals that have contracted or are suspected of having contracted rinderpest, contagious bovine pleuropneumonia, foot-and-mouth disease or African swine fever are located (including any neighboring location that is contaminated or likely to be contaminated with pathogens of said infectious disease) and other locations, specifying a time limit within a range not exceeding 72 hours, in accordance with procedures prescribed by Cabinet Order.

- An overseas Distribution Process Manager may, as provided for by MAFF Ordinance, having obtained a certification from a Registered Certifying Body or Registered Overseas Certifying Body for each distribution process and type of agricultural and forestry product, evaluate whether or not his/her products pertaining to said certification complies with the relevant Japanese Agricultural Standard and affix a Grade Label (limited to the one pertaining to the standard listed in item (iii) of paragraph (3) of Article 2) to the relevant product, its package, container or invoice.
- 事業者は、架空電線又は電気機械器具の充電電路に近接する場所で、工作物の建設、解体、点検、修理、塗装等の作業若しくはこれらに附帯する作業又はくい打機、くい抜機、移動式クレーン等を使用する作業を行なう場合において、当該作業に従事する労働者が作業中又は通行の際に、当該充電電路に身体等が接触し、又は接近することにより感電の危険が生ずるおそれのあるときは、次の各号のいずれかに該当する措置を講じなければならない。
- The employer shall, in the case where carrying out the works such as constructing, dismantling, checkup, repairing, and painting of a structure or the work associated with them, or the work using a pile driver, pile drawer, mobile crane, etc., at a place close to overhead wires or charged circuits of electric machine and appliance, and when it is liable to cause danger of electric shocks to the worker engaging in the said works due to the workers' body, etc., contact or close to the said charged circuits during work or passage, take measure falling under any of the following each item:
- 農林物資の販売業 者その他の農林物資の流通行程を管理し、又は把握するものとして農林水産省令で定めるもの(以下「流通行程管理者」という。)は、農林水産省令で定めると ころにより、農林物資の流通行程及び種類ごとに、あらかじめ登録認定機関の認定を受けて、その流通行程を管理し、又は把握している当該認定に係る農林物資 について日本農林規格による格付を行い、当該農林物資又はその包装、容器若しくは送り状に格付の表示(第二条第三項第三号に掲げる基準に係るものに限 る。)を付することができる。
- A manager or controller for a distribution process of agricultural and forestry products such as distributors, who is specified by MAFF Ordinance (hereinafter referred to as the 'Distribution Process Manager') may, as provided for by MAFF Ordinance, having obtained a certification from a Registered Certifying Body for each distribution process and type of agricultural and forestry product, evaluate whether or not his/her products pertaining to said certification complies with the relevant Japanese Agricultural Standard and affix a Grade Label (limited to the one pertaining to the standard listed in item (iii) of paragraph (3) of Article 2) to the relevant product, its package, container or invoice.

- An overseas Manufacturer, etc. certified pursuant to paragraph (1) of Article 19-3 (hereinafter referred to as the 'Certified Overseas Manufacturer, etc.'), overseas Production Process Manager certified pursuant to paragraph (2) of the same Article (hereinafter referred to as the 'Certified Overseas Production Process Manager'), overseas Distribution Process Manager certified pursuant to paragraph (3) of the same Article (hereinafter referred to as the 'Certified Overseas Distribution Process Manager') or overseas Subdivider certified pursuant to the preceding Article (hereinafter referred to as the 'Certified Overseas Subdivider') shall not affix a Grade Label or any other confusing label therewith to any agricultural and forestry product exported to Japan, or its package, container or invoice, except in the cases listed in items (vi) to (ix) of paragraph (1) of Article 18.
- 主として、自己の居住の用に供する住宅の建築の用に供する目的で行う開発行為以外の開発行為にあつては、道路、公園、広場その他の公共の用に供する空地(消防に必要な水利が十分でない場合に設置する消防の用に供する貯水施設を含む。)が、次に掲げる事項を勘案して、環境の保全上、災害の防止上、通行の安全上又は事業活動の効率上支障がないような規模及び構造で適当に配置され、かつ、開発区域内の主要な道路が、開発区域外の相当規模の道路に接続するように設計が定められていること。この場合において、当該空地に関する都市計画が定められているときは、設計がこれに適合していること。
- In cases of development activities other than development activities carried out with the primary purpose of building residences for own private dwelling, roads, parks, open spaces and other vacant spaces for public use (including reservoir facilities intended for fire service which are built in case it is difficult to secure sufficient water for fire service otherwise) shall be of scale and structure that will cause no inconvenience from the viewpoints of environmental preservation, disaster prevention, traffic safety and the efficiency of business activities considering the following items and shall be properly located; and main roads in development areas shall be designed so as to connect with considerably large roads outside of the development areas. In this case, if city plans relating to the relevant vacant spaces have been established, the design shall be in conformance with it.
- 農林水産大臣は、この法 律の施行に必要な限度において、認定製造業者等、認定生産行程管理者、認定流通行程管理者、認定小分け業者、認定輸入業者若しくは指定農林物資の生産業 者、販売業者若しくは輸入業者に対し、その格付(格付の表示を含む。以下この項及び次条第二項において同じ。)若しくは指定農林物資に係る名称の表示に関 し必要な報告を求め、又はその職員に、これらの者の工場、ほ場、店舗、事務所、事業所若しくは倉庫その他の場所に立ち入り、格付若しくは指定農林物資に係 る名称の表示の状況若しくは農林物資、その原料、帳簿、書類その他の物件を検査させることができる。
- The Minister of Agriculture, Forestry and Fisheries may, within the limit necessary to enforce this Act, have the Certified Manufacturer, etc., Certified Production Process Manager, Certified Distribution Process Manager, Certified Subdivider, Certified Importer or a producer, distributer or importer of Specified Agricultural and Forestry Products submit necessary reports on its grading (including the Grade Label; hereinafter the same shall apply in this paragraph and paragraph (2) of the next Article) or the indication of name pertaining to the Specified Agricultural and Forestry Products, or have his/her officials enter its factory, field, shop, office, place of business, warehouse or other locations and inspect the conditions of the grading or the indication of name pertaining to the Specified Agricultural and Forestry Products, or the agricultural and forestry products, their ingredients, its books, documents and other materials.
- 事業者は、電気機械器具の充電部分(電熱器の発熱体の部分、抵抗溶接機の電極の部分等電気機械器具の使用の目的により露出することがやむを得ない充電部分を除く。)で、労働者が作業中又は通行の際に、接触(導電体を介する接触を含む。以下この章において同じ。)し、又は接近することにより感電の危険を生ずるおそれのあるものについては、感電を防止するための囲い又は絶縁覆いを設けなければならない。ただし、配電盤室、変電室等区画された場所で、事業者が第三十六条第四号の業務に就いている者(以下「電気取扱者」という。)以外の者の立入りを禁止したところに設置し、又は電柱上、塔上等隔離された場所で、電気取扱者以外の者が接近するおそれのないところに設置する電気機械器具については、この限りでない。
- The employer shall, as regards live parts of electric machine and appliance (excluding the portions of electric machine and appliance which are inevitable to be exposed for the purpose of their use such as heating unit of electric heaters, the welding rods of resistance welding machines) which is liable to cause danger of electric shocks to workers when they contact (including contact via an electric conductor; hereinafter the same shall apply in this Chapter) or come in proximity to these parts during work or passage, install enclosures or insulating covers in order to prevent electric shocks. However, this shall not apply to the electric machine and appliance which are installed in an enclosed place such as a switchboard room and substation room where the employer prohibited persons other than those who are engaged in the work set forth in item (iv) of Article 36 (hereinafter referred to as "electrician") from entering, or installed on detached place such as a pole and a tower where there is no possibility that persons other than electrician will come in proximity to them.
- 登録申請者が、その申請に係る農林物資の製造業者等、生産行程管理者、流通行程管理 者、小分け業者、外国製造業者等(本邦に輸出される農林物資を外国において製造し、加工し、又は輸出することを業とする者をいう。以下同じ。)、外国生産 行程管理者(本邦に輸出される農林物資の外国における生産業者その他の当該農林物資の生産行程を外国において管理し、又は把握するものとして農林水産省令 で定めるものをいう。以下同じ。)、外国流通行程管理者(本邦に輸出される農林物資の輸出業者その他の当該農林物資の流通行程を外国において管理し、又は 把握するものとして農林水産省令で定めるものをいう。以下同じ。)又は外国小分け業者(本邦に輸出される農林物資を外国において小分けすることを業とする 者(小分けして自ら販売することを業とする者を含む。)をいう。以下同じ。)(以下「被認定事業者」という。)に支配されているものとして次のいずれかに 該当するものでないこと。
- The Accreditation Applicant does not fall under any of the following as an entity controlled by a Manufacturer, etc., Production Process Manager, Distribution Process Manager, Subdivider, overseas Manufacturer, etc. (one who manufactures or processes agricultural and forestry products to be exported to Japan in an overseas country, or exports them to Japan; the same shall apply hereinafter), overseas Production Process Manager (specified by MAFF Ordinance as a producer or other entity who manages or controls a production process in an overseas country for the agricultural and forestry product to be exported to Japan; the same shall apply hereinafter), overseas Distribution Process Manager (specified by MAFF Ordinance as an exporter or other entity who manages or controls a distribution process in an overseas country for the agricultural and forestry product to be exported to Japan in an overseas country; the same shall apply hereinafter) or overseas Subdivider (one who subdivides consignments of agricultural and forestry products to be exported to Japan in an overseas country (including the one who subdivides the consignments and sells them by himself/herself), the same shall apply hereinafter) of the agricultural and forestry product pertaining to said application (hereinafter referred to as the 'Certified Business Operator').
- 農林水産大臣は、第十四条第一項の認定を受けた農林物資の製造業者 等(以下「認定製造業者等」という。)、同条第二項の認定を受けた農林物資の生産行程管理者(以下「認定生産行程管理者」という。)若しくは同条第三項の 認定を受けた農林物資の流通行程管理者(以下「認定流通行程管理者」という。)の行う同条第一項から第三項までの規定による格付(認定製造業者等、認定生 産行程管理者又は認定流通行程管理者の行う同条第一項から第三項まで又は第五項の規定による格付の表示を含む。)、第十五条第一項の認定を受けた農林物資 の小分け業者(以下「認定小分け業者」という。)の行う同項の規定による格付の表示又は第十五条の二第一項の認定を受けた指定農林物資の輸入業者(以下 「認定輸入業者」という。)の行う同項の規定による格付の表示が適当でないと認めるときは、当該認定製造業者等、認定生産行程管理者、認定流通行程管理 者、認定小分け業者又は認定輸入業者に対し、期間を定めてその改善を命じ、又は格付の表示の除去若しくは抹消を命ずることができる。
- When the Minister of Agriculture, Forestry and Fisheries finds that the grading carried out by a Manufacturer, etc. of agricultural and forestry products certified pursuant to the provisions of paragraph (1) of Article 14 (hereinafter referred to as the 'Certified Manufacturer, etc.'), a Production Process Manager of agricultural and forestry products certified pursuant to the provisions of paragraph (2) of the same Article (hereinafter referred to as the 'Certified Production Process Manager') or a Distribution Process Manager of agricultural and forestry products certified pursuant to the provisions of paragraph (3) of the same Article (hereinafter referred to as the 'Certified Distribution Process Manager') pursuant to the provisions of paragraphs (1) to (3) of the same Article (including the Grade Label affixed by a Certified Manufacturer, etc., Certified Production Process Manager or Certified Distribution Process Manager pursuant to the provisions of paragraphs (1) to (3) or paragraph (5) of the same Article), the Grade Label affixed by a Subdivider of agricultural and forestry products certified pursuant to the provisions of paragraph (1) of Article 15 (hereinafter referred to as the 'Certified Subdivider') pursuant to the provisions of the same paragraph, or the Grade Label affixed by an importer of Specified Agricultural and Forestry Products certified pursuant to the provisions of paragraph (1) of Article 15-2 (hereinafter referred to as the 'Certified Importer') pursuant to the provisions of the same paragraph is inappropriate, he/she may order such Certified Manufacturer, etc., Certified Production Process Manager, Certified Distribution Process Manager, Certified Subdivider or Certified Importer to improve the same within a fixed period, or to remove or delete the Grade Label.
- 第十九条及び第十 九条の二の規定は、認定外国製造業者等、認定外国生産行程管理者、認定外国流通行程管理者又は認定外国小分け業者について準用する。この場合において、第 十九条中「再び農林物資」とあるのは「再び、本邦に輸出される農林物資」と、第十九条の二中「第十四条第一項の認定を受けた農林物資の製造業者等(以下 「認定製造業者等」という。)、同条第二項の認定を受けた農林物資の生産行程管理者(以下「認定生産行程管理者」という。)若しくは同条第三項の認定を受 けた農林物資の流通行程管理者(以下「認定流通行程管理者」という。)の行う同条第一項から第三項まで」とあるのは「認定外国製造業者等、認定外国生産行 程管理者若しくは認定外国流通行程管理者の行う第十九条の三」と、「認定製造業者等、認定生産行程管理者又は認定流通行程管理者の行う同条第一項から第三 項まで又は第五項」とあるのは「認定外国製造業者等、認定外国生産行程管理者又は認定外国流通行程管理者の行う同条又は第十九条の六第一項において準用す る第十四条第五項」と、「第十五条第一項の認定を受けた農林物資の小分け業者(以下「認定小分け業者」という。)の行う同項」とあるのは「認定外国小分け 業者の行う第十九条の四」と、「命じ」とあるのは「請求し」と、「命ずる」とあるのは「請求する」と読み替えるものとする。
