- In cases where a sentenced person requests to use or consume such self-supplied articles as the following articles (except the articles listed in the items under paragraph (1) of the following Article; the same shall apply in the following paragraph), if deemed appropriate in terms of his/her treatment, the warden of the penal institution may, pursuant to a Ministry of Justice Ordinance, permit him/her to do so:
- 入国者収容所長又は主任審査官は、適当と認めるときは、収容令書又は退去強制令書の発付を受けて収容されている者以外の者の差し出した保証書をもつて保証金に代えることを許すことができる。保証書には、保証金額及びいつでもその保証金を納付する旨を記載しなければならない。
- The director of the immigration detention center or supervising immigration inspector, if he/she deems appropriate, may permit a letter of guarantee submitted by a person other than the foreign national detained under a written detention order or deportation order to be substituted for the deposit. Such a letter of guarantee shall contain the amount of the deposit and a statement that the deposit will be paid at any time.
- 前項に規定する場合において、被収容者が、その子の養育に必要な物品について、自弁のものを使用し、若しくは摂取し、又はその子に使用させ、若しくは摂取させたい旨の申出をした場合には、刑事施設の規律及び秩序の維持その他管理運営上支障がない限り、これを許すものとする。
- In the case prescribed in the preceding paragraph, if the inmate has requested to use or consume, or to have her child use or consume, self-supplied articles as the articles necessary for fostering the child, then the inmate shall be permitted to do so as long as it does not hinder either the maintenance of discipline and order or the management and administration of the penal institution.

- Such are the differences among human beings in their sources of pleasure, their susceptibilities of pain, and the operation on them of different physical and moral agencies, that unless there is a corresponding diversity in their modes of life, they neither obtain their fair share of happiness, nor grow up to the mental, moral, and aesthetic stature of which their nature is capable.

- If the Regional Board recognizes, with regard to a person committed in a juvenile training school for the execution of protective measures, that the person has reached the highest stage of treatment, that it is suitable for such person's improvement and rehabilitation to have the person released provisionally and that it is specially necessary for improvement and rehabilitation to have the person released provisionally, it shall permit the release on parole by its decision.
- 刑事施設の長は、未決拘禁者としての地位を有する受刑者に対し、この目、第百四十八条第三項又は次節の規定により禁止される場合を除き、他の者との間で信書を発受することを許すものとする。ただし、刑事訴訟法の定めるところにより信書の発受が許されない場合は、この限りでない。

- In cases where an inmate requests to continue to bring up the child who has been brought up inside the penal institution pursuant to the provision of the preceding paragraph and has become one year of age, if required in the particular case in light of the mental and physical conditions of the inmate or for fostering the child, the warden of the penal institution may permit the inmate to continue to do so for a maximum of six months.
- 裁判所は、取消訴訟の目的たる請求を当該処分又は裁決に係る事務の帰属する国又は公共団体に対する損害賠償その他の請求に変更することが相当であると認めるときは、請求の基礎に変更がない限り、口頭弁論の終結に至るまで、原告の申立てにより、決定をもつて、訴えの変更を許すことができる。
- When the court finds it appropriate to amend the claim that is subject matter of an action for the revocation of an administrative disposition, to a claim for damages or any other claim against the State or a public entity in which the affairs pertaining to the original administrative disposition or administrative disposition on appeal are vested, the court may, until the conclusion of the oral argument, upon the petition of the plaintiff, by an order, permit such amendment of the claim, unless there is any change to the basis for the claim.

- In cases where a person other than those listed in the items of the preceding paragraph requests to visit an inmate sentenced to death, if it is deemed that there is a circumstance where the visit is necessary for the maintenance of good relationship with the person or for any other reasons, and if it is deemed that there is no risk of causing disruption of discipline and order in the penal institution, then the warden of the penal institution may permit the inmate sentenced to death to receive the visit.
- 刑事施設の長は、禁錮受刑者(刑事施設に収容されているものに限る。以下この節において同じ。)又は拘留受刑者(刑事施設に収容されているものに限る。)が刑事施設の長の指定する作業を行いたい旨の申出をした場合には、法務省令で定めるところにより、その作業を行うことを許すことができる。
- In cases where either persons sentenced to imprisonment without work (and limited to those committed to a penal institution; hereinafter the same shall apply in this Section) or persons sentenced to misdemeanor imprisonment without work (and limited to those committed to a penal institution) request to engage in an assigned work, the warden of the penal institution may, pursuant to a Ministry of Justice Ordinance, permit them to do so.
- 留置業務管理者は、被留置者に対し、この款又は第二百二十八条第三項の規定により禁止される場合を除き、他の者との間で信書を発受することを許すものとする。ただし、その被留置者が未決拘禁者である場合において、刑事訴訟法の定めるところにより信書の発受が許されないときは、この限りでない。

- この法律の施行の際現に係属している処分又は裁決の取消しの訴えについては、当該法律関係の当事者の一方を被告とする旨のこの法律による改正後の規定にかかわらず、なお従前の例による。ただし、裁判所は、原告の申立てにより、決定をもつて、当該訴訟を当事者訴訟に変更することを許すことができる。
- With regard to an action for rescission of a disposition or determination which is already pending at the time of the enforcement of this Act, the provisions then in force shall remain applicable, notwithstanding the provisions after the revision by this Act stipulating that either of the parties in the relevant legal relationship shall be the defendant; provided, however, that it shall be permissible to change said lawsuit to an adversary lawsuit by a ruling, on a motion by the plaintiff.
- With regard to actions for rescission of a disposition or determination which are actually pending at the time of the enforcement of this Act, the provisions then in force shall remain applicable, notwithstanding the provisions revised by this Act to the effect that one party to the legal relationship shall be the defendant; provided, however, that the court may, upon the plaintiff's application, permit to change the action into a party suit by its ruling.
- With regard to an action for the rescission of a disposition or determination that is actually pending at the time of enforcement of this Act, the provisions then in force shall remain applicable, notwithstanding the provisions revised by this Act to the effect that a party to the legal relationship shall be the defendant; provided, however, that the court may, by its decision, permit to change the action to the party suit based on a motion by the plaintiff.
- With regard to actions for rescission of disposition or determination actually pending at time of enforcement of this Act, the provisions then in force shall remain applicable, notwithstanding provisions revised by this Act stipulating that one party to the legal relationship be the defendant; provided, however, that the court may, upon the plaintiff's request, may rule to permit changing the action into a party suit.

- In cases where an inmate or the other party of correspondence does not have a sufficient command of the national language, or where deemed appropriate, the warden shall permit to send or receive a letter in a foreign language. In this case, if translation is necessary in order to examine the contents of the letter, then the warden of the penal institution may, pursuant to a Ministry of Justice Ordinance, charge the expenses thereby incurred to the inmate.
- 留置業務管理者は、被留置者又はその信書の発受の相手方が国語に通じない場合その他相当と認める場合には、外国語による信書の発受を許すものとする。この場合において、信書の内容を確認するため翻訳が必要であるときは、内閣府令で定めるところにより、その被留置者にその費用を負担させることができる。

- With regard to an action for rescission of disposition or determination actually pending prior to the enforcement of this Act, the provisions then in force shall remain applicable notwithstanding the provisions after the revision by this Act that designates one party of such legal relationship as a defendant. However, the court may allow such action to be changed to a party action upon decision by the request of plaintiff.
- 留置業務管理者は、被留置受刑者以外の被留置者に対し、他の者から面会の申出があったときは、第二百二十八条第三項の規定により禁止される場合を除き、これを許すものとする。ただし、その被留置者が未決拘禁者である場合において、刑事訴訟法の定めるところにより面会が許されないときは、この限りでない。
- In cases where a person requests to visit any detainee other than the sentenced persons under detention, the detention services manager shall permit the detainee to receive the visit, except the cases where it is prohibited pursuant to the provision of paragraph (3) under Article 228; provided, however, that the foregoing shall not apply where the detainee is an unsentenced person and such visit is not permitted by the provisions of the Code of Criminal Procedure.

- In examinations for whether or not parole should be permitted, the Regional Board shall have its constituting Board members interview the person subject to examination; provided, however, that this shall not apply to cases in which it is recognized that the severe illness or injury of such person makes the interview difficult or cases in which it is recognized that an interview in the case in question is prescribed by the Ordinance of the Ministry of Justice as being unnecessary.

- In cases where a person requests to visit a coast guard detainee, the coast guard detention services manager shall permit the coast guard detainee to receive the visit, except the cases where it is prohibited pursuant to the provision of paragraph (3) under Article 274; provided, however, that the foregoing shall not apply where the coast guard detainee is an unsentenced person and such visit is not permitted by the provisions of the Code of Criminal Procedure.

- The coast guard detention services manager shall permit a coast guard detainee to send and receive letters to and from another person, except where it is prohibited pursuant to the provisions of this Subsection or paragraph (3) of Article 274; provided, however, that this shall not apply in the cases of the coast guard detainee being an unsentenced person where sending or receiving letters is not permitted by the provisions of the Code of Criminal Procedure.

- 刑事施設の長は、受刑者以外の被収容者が、前項各号に掲げる物品及び寝具について自弁のものを使用し、又は摂取したい旨の申出をした場合には、刑事施設の規律及び秩序の維持その他管理運営上支障を生ずるおそれがある場合並びに第十二節の規定により禁止される場合を除き、法務省令で定めるところにより、これを許すものとする。
- In cases where an inmate other than a sentenced person claims to use or consume such self-supplied articles as the articles listed in the items of the preceding paragraph and beddings, the warden of the penal institution shall, pursuant to a Ministry of Justice Ordinance, permit him/her to do so except where there is a risk of causing a hindrance to either the maintenance of discipline and order or the management and administration of the penal institution or where it is prohibited pursuant to the provisions of Section 12.

- In cases where an inmate claims to expend the cash being retained in order to either purchase self-supplied articles, etc. or to apply it to the expenses to be incurred by him/her in the course of his/her daily life in the penal institution, the warden of the penal institution shall permit him/her to expend the necessary amount of cash; provided, however, that this shall not apply to the cases where the expenditure of cash for the purchase of self-supplied articles, etc. falls under any of the cases set out under the following items:

- 刑事施設の長は、受刑者に対し、前項各号に掲げる者以外の者から面会の申出があった場合において、その者との交友関係の維持その他面会することを必要とする事情があり、かつ、面会により、刑事施設の規律及び秩序を害する結果を生じ、又は受刑者の矯正処遇の適切な実施に支障を生ずるおそれがないと認めるときは、これを許すことができる。
- In cases where a person other than those listed in the items of the preceding paragraph requests to visit a sentenced person, if it is deemed that there is a circumstance where the visit is necessary for the maintenance of good relationship with the person or for any other reasons, and if it is deemed that there is no risk of causing either disruption of discipline and order in the penal institution or hindrance to the adequate pursuance of correctional treatment for the sentenced person, then the warden of the penal institution may permit the sentenced person to receive the visit.
- 家庭裁判所は、第一項の規定により審判の傍聴を許す場合において、傍聴する者の年齢、心身の状態その他の事情を考慮し、その者が著しく不安又は緊張を覚えるおそれがあると認めるときは、その不安又は緊張を緩和するのに適当であり、かつ、審判を妨げ、又はこれに不当な影響を与えるおそれがないと認める者を、傍聴する者に付き添わせることができる。
- When permitting observation of the hearing pursuant to the provisions of paragraph (1), the family court may allow a person who can appropriately ease the anxiety or the tension of the observer and is unlikely to disrupt the hearing, or have undue impact on it, to accompany the observer, if it is found that the observer is likely to feel strong anxiety or tension in consideration of age of Juvenile, emotional condition and other circumstances.
- 留置業務管理者は、被留置者が、保管私物又は領置されている金品(第二百二十七条において準用する第百三十三条に規定する文書図画に該当するものを除く。)について、他の者(その留置施設に留置されている者を除く。)への交付(信書の発信に該当するものを除く。)を申請した場合には、次の各号のいずれかに該当する場合を除き、これを許すものとする。
- In cases where a detainee claims to deliver either the self-retained articles or the cash and articles being retained (except such articles that fall under the documents and drawings prescribed in Article 133 (as applied mutatis mutandis pursuant to Article 227) to another person (except those being detained in the detention facility concerned) (except such delivery that falls under the delivery of a letter), the detention services manager shall permit the detainee to do so except cases falling under any of the cases set out under the following items:

- In cases where an inmate or the other party of visits, etc. (i.e. visits and the communication prescribed in paragraph (1) of Article 146; hereinafter the same shall apply in this Article) does not have a sufficient command of the national language, the warden of the penal institution shall permit a visit, etc. in a foreign language. In this case, if interpretation or translation is necessary in order to examine the oral statements or the communication, then the warden of the penal institution may, pursuant to a Ministry of Justice Ordinance, charge the expenses thereby incurred to the inmate.
- 海上保安留置業務管理者は、海上保安被留置者が、保管私物又は領置されている金品(第二百七十三条において準用する第百三十三条に規定する文書図画に該当するものを除く。)について、他の者(その海上保安留置施設に留置されている者を除く。)への交付(信書の発信に該当するものを除く。)を申請した場合には、次の各号のいずれかに該当する場合を除き、これを許すものとする。

- Initially, the Muromachi bakufu was cautious about issuing Tokuseirei, but in 1454, the bakufu issued 'Buichi-sen,' 'Buichi Tokuseirei,' 'Tokusei-buichi-sen,' which ordered 10% of debt repayments to be paid to the government as a type of handling fee, and since this 10% of debt became income for the bakufu, it was later frequently used to unlawfully renew the bakufu finances.
- 刑事施設の長は、負傷し、又は疾病にかかっている被収容者が、刑事施設の職員でない医師等を指名して、その診療を受けることを申請した場合において、傷病の種類及び程度、刑事施設に収容される前にその医師等による診療を受けていたことその他の事情に照らして、その被収容者の医療上適当であると認めるときは、刑事施設内において、自弁によりその診療を受けることを許すことができる。
- In cases where an inmate sustaining an injury or suffering from a disease claims to designate a doctor who is not the staff of the penal institution to receive a medical treatment, if such claim is deemed appropriate for the inmate's medical care in light of such circumstances as the type and degree of the injury or disease, and as the fact that the inmate had been visiting said doctor on the regular basis for medical treatments prior to the commitment to the penal institution, then the warden of the penal institution may permit the inmate to receive the medical treatment inside the penal institution at his/her own expenses.
- 留置業務管理者は、被留置受刑者に対し、前項各号に掲げる者以外の者から面会の申出があった場合において、その者との交友関係の維持その他面会することを必要とする事情があり、かつ、面会により、留置施設の規律及び秩序を害する結果を生じ、又はその被留置受刑者の改善更生に支障を生ずるおそれがないと認めるときは、これを許すことができる。この場合においては、前条ただし書の規定を準用する。
- In cases where a person other than those listed in the items of the preceding paragraph requests to visit a sentenced person under detention, if it is deemed that there is a circumstance where the visit is necessary for the maintenance of good relationship with the person or for any other reasons, and if it is deemed that there is no risk of causing either disruption of discipline and order in the detention facility or hindrance to the adequate pursuance of reformation and rehabilitation for the sentenced person under detention, then the detention services manager may permit the sentenced person under detention to receive the visit. In this case, the provision set forth in the proviso of the preceding paragraph shall apply mutatis mutandis.
- 団体の運営のための経費の支出につき使用者の経理上の援助を受けるもの。但し、労働者が労働時間中に時間又は賃金を失うことなく使用者と協議し、又は交渉することを使用者が許すことを妨げるものではなく、且つ、厚生資金又は経済上の不幸若しくは災厄を防止し、若しくは救済するための支出に実際に用いられる福利その他の基金に対する使用者の寄附及び最小限の広さの事務所の供与を除くものとする。
- which receives the employer's financial assistance in paying the organizations' operational expenditures, however, that this shall not prevent the employer from permitting workers to confer or negotiate with the employer during working hours without loss of time or wage and shall not apply to the employer's contributions for public welfare funds or welfare and other funds which are actually used for payments to prevent or relieve economic adversity or misfortunes, nor to the giving office of minimum space
- 刑事施設の長は、受刑者(未決拘禁者としての地位を有するものを除く。以下この款において同じ。)に対し、第八十八条第二項の規定により開放的施設において処遇を受けていることその他の法務省令で定める事由に該当する場合において、その者の改善更生又は円滑な社会復帰に資すると認めるときその他相当と認めるときは、電話その他政令で定める電気通信の方法による通信を行うことを許すことができる。
- In cases where a sentenced person (except those having the status as an unsentenced person; hereinafter the same shall apply in this Subsection) falls under the cases specified by a Ministry of Justice Ordinance, such as being placed in an open-type institution pursuant to the provision of paragraph (2) under Article 88, if it is deemed instrumental either for his/her reformation and rehabilitation or for his/her smooth re-entry to society, or if it is deemed appropriate, then the warden of the penal institution may permit him/her to engage in communication by telephone or by other means of telecommunication provided for by a Cabinet Order.

- But when they are sure (such reasoners may say), it is not conscientiousness but cowardice to shrink from acting on their opinions, and allow doctrines which they honestly think dangerous to the welfare of mankind, either in this life or in another, to be scattered abroad without restraint, because other people, in less enlightened times, have persecuted opinions now believed to be true.
- 留置業務管理者は、被留置者が、次に掲げる物品(次条第一項各号に掲げる物品を除く。)について自弁のものを使用し、又は摂取したい旨の申出をした場合には、留置施設の規律及び秩序の維持その他管理運営上支障を生ずるおそれがある場合、第百九十条の規定により禁止される場合並びに被留置受刑者について改善更生に支障を生ずるおそれがある場合を除き、内閣府令で定めるところにより、これを許すものとする。
- In cases where a detainee requests to use or consume such self-supplied articles as the following articles (except the articles listed in the items under paragraph (1) of the following Article), the detention services manager may, pursuant to a Cabinet Office Ordinance, permit him/her to do so, except cases where there is a risk of causing a hindrance to either the maintenance of discipline and order or the management and administration of the detention facility, cases where such permission is prohibited pursuant to the provision of Article 190, and the cases of the sentenced person under detention where such permission is likely to impose hindrance to the correction and rehabilitation on him/her:

- 留置業務管理者は、前項の規定による診療を受けることを許す場合において、同項の診療を行う医師等(以下この条において「指名医」という。)の診療方法を確認するため、又はその後にその被留置者に対して診療を行うため必要があるときは、留置業務に従事する職員をしてその診療に立ち会わせ、若しくはその診療に関して指名医に質問させ、又は診療録の写しその他のその診療に関する資料の提出を求めることができる。
- In cases where the detention services manager permits to receive the medical treatment prescribed in the preceding paragraph, if deemed necessary in order for him/her to examine the method of medical treatment by the doctor who provides the medical treatment set forth in said paragraph (hereinafter referred to as 'appointed doctor' in this Article), or if deemed necessary to conduct medical treatment afterwards, he/she may have a staff member who engages in the affairs of the detention attend the medical treatment, or ask the appointed doctor questions with regard to the medical treatment, or request the appointed doctor to submit materials on the medical treatment such as a copy of the detainee's case record.
- 刑事施設の長は、前項の規定による診療を受けることを許す場合において、同項の診療を行う医師等(以下この条において「指名医」という。)の診療方法を確認するため、又はその後にその被収容者に対して刑事施設において診療を行うため必要があるときは、刑事施設の職員をしてその診療に立会わせ、若しくはその診療に関して指名医に質問させ、又は診療録の写しその他のその診療に関する資料の提出を求めることができる。

- 特別審理官又は主任審査官は、それぞれ第十条第七項若しくは第十一項又は第十一条第六項の規定により退去を命ずる場合において、当該外国人が船舶等の運航の都合その他その者の責めに帰することができない事由により直ちに本邦から退去することができないと認めるときは、法務省令で定めるところにより、当該外国人に対して、その指定する期間内に限り、出入国港の近傍にあるその指定する施設にとどまることを許すことができる。
- In the event that the exclusion which has been ordered pursuant to the provisions of Article 10, paragraph (7) or (11) or Article 11, paragraph (6) cannot be carried out due to the operating schedule of the vessel or aircraft or for other reasons not imputable to the foreign national, a special inquiry officer or a supervising immigration inspector may permit the foreign national to stay in a designated facility in the vicinity of the port of entry or departure for a designated period, pursuant to the provisions of an Ordinance of the Ministry of Justice.
- 刑事施設の長は、被収容者が、保管私物又は領置されている金品(第百三十三条(第百三十六条、第百三十八条、第百四十一条、第百四十二条及び第百四十四条において準用する場合を含む。)に規定する文書図画に該当するものを除く。)について、他の者(当該刑事施設に収容されている者を除く。)への交付(信書の発信に該当するものを除く。)を申請した場合には、次の各号のいずれかに該当する場合を除き、これを許すものとする。
- In cases where an inmate claims to deliver either the self-retained articles or the cash and articles being retained (except such articles that fall under the documents and drawings prescribed in Article 133 (including the cases where it is applied mutatis mutandis pursuant to Articles 136, 138, 141, 142, and 144)) to another person (except those being committed to the penal institution concerned) (except such delivery that falls under the delivery of a letter), the warden of the penal institution shall permit the inmate to do so except cases falling under any of the cases set out under the following items:
- 地方委員会は、 第一項の決定をした場合において、当該決定を受けた者について、その釈放までの間に、刑事施設の規律及び秩序を害する行為をしたこと、予定されていた釈放 後の住居、就業先その他の生活環境に著しい変化が生じたことその他その釈放が相当でないと認められる特別の事情が生じたと認めるときは、仮釈放又は仮出場を許すか否かに関する審理を再開しなければならない。この場合においては、当該決定は、その効力を失う。
- If, after the Regional Board renders a decision under paragraph (1), it considers that a person for whom a decision has been rendered has engaged in an act prejudicial to the discipline and order of a penal institution, or substantial changes in the planned residence after release, employment or other social circumstances factors or any specific circumstances have occurred which make the Board consider that release is not suitable, prior to the release, it shall resume examinations for whether or not the parole or provisional release is to be permitted. In this case, said decision shall cease to be effective.
- 刑事施設の長は、被収容者に対し、刑事施設の規律及び秩序の維持その他管理運営上支障を生ずるおそれがない限り、余暇時間帯等(受刑者にあっては余暇に充てられるべき時間帯をいい、その他の被収容者にあっては食事、就寝その他の起居動作をすべき時間帯以外の時間帯をいう。次項において同じ。)において自己契約作業(その者が刑事施設の外部の者との請負契約により行う物品の製作その他の作業をいう。以下同じ。)を行うことを許すものとする。
- The warden of the penal institution shall, so long as there is no risk of causing a hindrance to either the maintenance of discipline and order or the management and administration of the penal institution, permit inmates to engage in a self-contracted work (i.e. manufacturing of goods engaged in by an inmate under contract to a person outside the penal institution; the same shall apply hereinafter) during leisure time, etc. (i.e. for sentenced persons the daily schedule set aside for leisure; and for other inmates the daily schedule except those of meals, sleeping, and other routine activities; the same shall apply in the following paragraph)
- 労働者が労働組合を結成し、若しくは運営することを支配し、若しくはこれに介入すること、又は労働組合の運営のための経費の支払につき経理上の援助を与えること。ただし、労働者が労働時間中に時間又は賃金を失うことなく使用者と協議し、又は交渉することを使用者が許すことを妨げるものではなく、かつ、厚生資金又は経済上の不幸若しくは災厄を防止し、若しくは救済するための支出に実際に用いられる福利その他の基金に対する使用者の寄附及び最小限の広さの事務所の供与を除くものとする。
- to control or interfere with the formation or management of a labor union by workers or to give financial assistance in paying the labor union's operational expenditures, provided, however, that this shall not preclude the employer from permitting workers to confer or negotiate with the employer during working hours without loss of time or wage, and this shall not apply to the employer's contributions for public welfare funds or welfare and other funds which are actually used for payments to prevent or relieve economic adversity or misfortunes, nor to the giving of office of minimum space;
- 留置業務管理者は、負傷し、又は疾病にかかっている被留置者が、当該留置業務管理者が委嘱する医師等以外の医師等を指名して、その診療を受けることを申請した場合において、傷病の種類及び程度、留置施設に留置される前にその医師等による診療を受けていたことその他の事情に照らして、その被留置者の医療上適当であると認めるときは、内閣府令で定めるところにより、留置施設内又は留置業務管理者が適当と認める病院若しくは診療所において、自弁によりその診療を受けることを許すことができる。
- In cases where a detainee sustaining an injury or suffering from a disease claims to designate a doctor who is not commissioned by the detention services manager to receive a medical treatment, if such claim is deemed appropriate for the detainee's medical care in light of such circumstances as the type and degree of the injury or disease, and as the fact that the detainee had been visiting said doctor on the regular basis for medical treatments prior to the detention in the detention facility, then the detention services manager may, pursuant to a Cabinet Office Ordinance, permit the detainee to receive the medical treatment inside the detention facility or in a hospital or a clinic which the detention services manager recognizes as to be appropriate at his/her own expenses.
- 裁判所は、証拠調べをするに当たり、訴訟関係又は証拠調べの結果の趣旨を明瞭にするため必要があると認めるときは、当事者の意見を聴いて、決定で、証拠調べの期日において専門的な知見に基づく説明を聴くために専門委員を手続に関与させることができる。この場合において、証人若しくは当事者本人の尋問又は鑑定人質問の期日において専門委員に説明をさせるときは、裁判長は、当事者の同意を得て、訴訟関係又は証拠調べの結果の趣旨を明瞭にするために必要な事項について専門委員が証人、当事者本人又は鑑定人に対し直接に問いを発することを許すことができる。
- When the court finds it necessary, in the process of conducting the examination of evidence, in order to clarify the matters related to the suit or the gist of the result of the examination of evidence, it may, after hearing opinions of the parties, by an order, have a technical adviser participate in the proceedings so as to hear his/her explanation based on expert knowledge on the date for the examination of evidence. In this case, in order to have a technical adviser give an explanation on the date for the examination of a witness or a party him/herself or date for the questioning of an expert witness, the presiding judge, with the consent of the party, may permit the technical adviser to ask questions directly of the witness, the party him/herself or the expert witness with regard to the matters necessary for clarifying the matters related to the suit or the gist of the result of the examination of evidence.
- 刑事施設の長は、刑法第二十八条(国際受刑者移送法第二十一条において読み替えて適用する場合を含む。)、少年法第五十八条又は国際受刑者移送法第二十二条の規定により仮釈放を許すことができる期間を経過した懲役受刑者又は禁錮受刑者が、第八十八条第二項の規定により開放的施設において処遇を受けていることその他の法務省令で定める事由に該当する場合において、その円滑な社会復帰を図るため必要があるときは、刑事施設の職員の同行なしに、その受刑者を刑事施設の外の事業所(以下この条において「外部事業所」という。)に通勤させて作業を行わせることができる。
- In cases where either a person sentenced to imprisonment with work or a person sentenced to imprisonment without work has served the period of time for parole qualification pursuant to the provisions of Article 28 of the Penal Code (including the cases where it is applied by replacing the terms pursuant to Article 21 of the Act on the Transnational Transfer of Sentenced Persons), Article 58 of the Juvenile Code, or Article 22 of the Act on the Transnational Transfer of Sentenced Persons and falls under cases specified by a Ministry of Justice Ordinance, such as being placed in an open-type institution pursuant to the provision under paragraph (2) of Article 88, the warden of the penal institution may, if necessary for smooth re-entry to society, permit him/her to commute to a business establishment outside the penal institution (hereinafter referred to as 'outside business establishment' in this Article) without an escort of staff members of the penal institution.
- 家庭裁判所は、最高裁判所規則の定めるところにより第三条第一項第一号に掲げる少年に係る事件であつて次に掲げる罪のもの又は同項第二号に掲げる少年(十二歳に満たないで刑罰法令に触れる行為をした少年を除く。次項において同じ。)に係る事件であつて次に掲げる罪に係る刑罰法令に触れるもの(いずれも被害者を傷害した場合にあつては、これにより生命に重大な危険を生じさせたときに限る。)の被害者等から、審判期日における審判の傍聴の申出がある場合において、少年の年齢及び心身の状態、事件の性質、審判の状況その他の事情を考慮して、少年の健全な育成を妨げるおそれがなく相当と認めるときは、その申出をした者に対し、これを傍聴することを許すことができる。
- The family court may, pursuant to the Rules of the Supreme Court, permit, upon request, the victim, etc. to observe the proceedings on the date of the hearing of a case of a Juvenile as prescribed in Article 3, paragraph (1), item (i) who committed a crime listed in any of the following items or for a case of a Juvenile as prescribed in item (ii) of the same paragraph (excluding any Juvenile under 12 years of age who committed an act violating laws and regulations of criminal nature; the same shall apply in the next paragraph) who committed an act violating criminal laws and regulations concerning crimes listed in any of the following items (limited to any act that caused serious danger to victim's life in either of said cases where the victim was injured) if the court found it appropriate and unlikely to hinder sound development of the Juvenile in light of the age of the Juvenile, emotional state, the nature of the case, status of the hearing and other circumstances.
- 地方委員会は、仮釈放を許すか否かに関する審理を行うに当たり、法務省令で定めるところにより、被害者等(審理対象者が刑を言い渡される理由となった犯罪により害を被った者(以下この項において「被害者」という。)又はその法定代理人若しくは被害者が死亡した場合若しくはその心身に重大な故障がある場合におけるその配偶者、直系の親族若しくは兄弟姉妹をいう。次項において同じ。)から、審理対象者の仮釈放に関する意見及び被害に関する心情(以下この条において「意見等」という。)を述べたい旨の申出があったときは、当該意見等を聴取するものとする。ただし、当該被害に係る事件の性質、審理の状況その他の事情を考慮して相当でないと認めるときは、この限りでない。
- The Regional Board shall, as provided for by the Ordinance of the Ministry of Justice, hear the opinions or feelings of the victims (those persons who have suffered damage as a result of the crimes which are the grounds for the punishment rendered to the person subject to examination, hereinafter referred to as 'victims', including their statutory agents or in the case of the victim's death or their suffering from severe mental or physical disorders, their spouse, lineal relatives or siblings) regarding the parole of the person subject to examination and regarding sentiment on damage by the crimes whenever, in its deliberation period, victims ask this of the Board. The Regional Board however has the discretion not to hear from victims when it finds that there is good reason to consider that hearing from them is not appropriate, in light of the nature of the case, the circumstances of the parole examinations and other related circumstances.
- 刑事施設の長は、刑法第二十八条(国際受刑者移送法第二十一条において読み替えて適用する場合を含む。)、少年法第五十八条又は国際受刑者移送法第二十二条の規定により仮釈放を許すことができる期間を経過した懲役受刑者又は禁錮受刑者が、第八十八条第二項の規定により開放的施設において処遇を受けていることその他の法務省令で定める事由に該当する場合において、その円滑な社会復帰を図るため、刑事施設の外において、その者が、釈放後の住居又は就業先の確保その他の一身上の重要な用務を行い、更生保護に関係のある者を訪問し、その他その釈放後の社会生活に有用な体験をする必要があると認めるときは、刑事施設の職員の同行なしに、外出し、又は七日以内の期間を定めて外泊することを許すことができる。ただし、外泊については、その受刑者に係る刑が六月以上執行されている場合に限る。
- In cases where either a person sentenced to imprisonment with work or a person sentenced to imprisonment without work has served the period of time for parole qualification pursuant to the provisions of Article 28 of the Penal Code (including the cases where it is applied by replacing the terms pursuant to Article 21 of the Act on the Transnational Transfer of Sentenced Persons), Article 58 of the Juvenile Code, or Article 22 of the Act on the Transnational Transfer of Sentenced Persons, and falls under cases specified by a Ministry of Justice Ordinance, such as being placed in an open-type institution pursuant to the provision of paragraph (2) of Article 88, if it is deemed necessary that the sentenced person, for smooth re-entry to society, go outside the penal institution to settle important personal matters such as securement of his/her residence and employer following release, visit people relevant to his/her rehabilitation and to the guardianship thereof, or acquire other useful experience for life in society following his/her release, then the warden of the penal institution may permit him/her a day leave or a furlough for a definite period within seven days without an escort of staff members of the penal institution. However, the furlough shall be limited to the cases where a sentenced person has been serving for not less than six months.
