- 保護室が設置されていない留置施設においては、留置担当官は、被留置者が留置担当官の制止に従わず大声を発し続けて、留置施設内の平穏な生活を乱す場合において、他にこれを抑止する手段がないときは、留置業務管理者の命令により、防声具を使用することができる。この場合において、その被留置者が防声具を取り外し、又は損壊することを防ぐため必要があるときは、その使用と同時に捕縄又は手錠を使用することができる。
- In cases of the detention facility without any protection room, if a detainee persistently generates a loud voice against a detention officer's order to cease doing so, thereby disturbing peaceful community life thereof, detention officers may use a gag by order of the detention services manager, if no other means are available. In this case, if there exists necessity to prevent the detainee from detaching or destructing the gag, arresting ropes and handcuffs may be used in combination therewith.

- In this Act, 'a piscary' refers to the right of operating the whole or a part of the fishery covered by another person's common fishery right or by the demarcated fishery right for a bamboo-installed aquaculture business, algae aquaculture business, suspension-type aquaculture business (which refers to a business of suspending aquatic animals, operated with ropes, steel wires, or the like kept hanging; excluding the pearl aquaculture business), fish pen aquaculture business (which refers to a business of culturing aquatic animals using net creels or other creels), or shellfish aquaculture business as a class 3 demarcated fishery (hereinafter referred to as 'the specific demarcated fishery right'), in the fishing ground pertaining to the fishery right, based on the act of establishment.

- With respect to the land which is acquired and continuously held by the Company as a result of the contribution-in-kind by the Public Corporation under the provisions of Article 3 paragraph (8) of the Supplementary Provisions (limited to the land which the Public Corporation acquired during the period from January 1, 1969 (with respect to the land located in Okinawa Prefecture, from April 1, 1972) to March 31, 1982), no special land holding taxes shall be imposed on the land other than those which are located in 'urbanized areas' as stipulated in Article 7 paragraph (1) of the City Planning Act (Act No. 100 of 1968) as of January 1 of the year during which the Company is required to pay the tax by self-assessment under the provisions of Article 599 paragraph (1) of the Local Taxes Act if more than ten years have elapsed since the Public Corporation acquired said land.

- 都市計画区域について定められる都市計画(区域外都市施設に関するものを含む。次項において同じ。)は、国土形成計画、首都圏整備計画、近畿圏整備計画、中部圏開発整備計画、北海道総合開発計画、沖縄振興計画その他の国土計画又は地方計画に関する法律に基づく計画(当該都市について公害防止計画が定められているときは、当該公害防止計画を含む。第三項において同じ。)及び道路、河川、鉄道、港湾、空港等の施設に関する国の計画に適合するとともに、当該都市の特質を考慮して、次に掲げるところに従つて、土地利用、都市施設の整備及び市街地開発事業に関する事項で当該都市の健全な発展と秩序ある整備を図るため必要なものを、一体的かつ総合的に定めなければならない。この場合においては、当該都市における自然的環境の整備又は保全に配慮しなければならない。
- City plans stipulated for city planning areas (including those concerning out-of-area facilities; the same shall apply in the following paragraph) shall conform to the National Spatial Plan, the National Capital Region Development Plan, the Kinki Region Development Plan, the Chubu Region Development Plan, the Hokkaido Comprehensive Development Plan, the Okinawa Promotion Plan and any other plans based on Acts concerning national plans or regional plans (including pollution prevention plans if they have been stipulated for said cities; the same shall apply in paragraph (3)) and national plans for roads, rivers, railways, ports, airports and other facilities; and they must, in consideration of the said city's characteristics, uniformly and comprehensively stipulate matters concerning land use, urban facility construction and urban development projects required for the sound and orderly development of said cities in accordance with the following provisions. In such cases, consideration must be given to the improvement in preservation of the natural environment in said cities.
- 第七十五条の規定は海上保安留置担当官による海上保安被留置者の身体、着衣、所持品及び居室の検査並びに所持品の保管並びに海上保安被留置者以外の者の着衣及び携帯品の検査並びに携帯品の保管について、第七十八条の規定は海上保安留置担当官による捕縄、手錠及び拘束衣の使用について、それぞれ準用する。この場合において、第七十五条第一項及び第三項並びに第七十八条第一項第三号中「刑事施設」とあるのは「海上保安留置施設」と、第七十五条第二項中「第三十四条第二項」とあるのは「第二百四十二条第二項」と、第七十八条第一項、第二項及び第六項中「被収容者」とあるのは「海上保安被留置者」と、同条第一項及び第七項中「法務省令」とあるのは「国土交通省令」と、同条第二項から第六項までの規定中「刑事施設の長」とあるのは「海上保安留置業務管理者」と、同項中「刑事施設の職員である医師」とあるのは「当該海上保安留置業務管理者が委嘱する医師」と読み替えるものとする。

In this case, the term 'penal institution' in paragraphs (1) and (3) of Article 75 and item (iii) of paragraph (1) under Article 78 shall be read as 'coast guard detention facility' ; the phrase 'paragraph (2) of Article 34' in paragraph (2) of Article 75 shall be read as 'paragraph (2) of Article 242' ; the terms 'inmate' and 'inmates' in paragraphs (1), (2), and 6 under Article 78 shall be read as 'coast guard detainee' and 'coast guard detainees' ; the term 'a Ministry of Justice Ordinance' in paragraphs (1) and (7) under said Article shall be read as 'an Ordinance of the Ministry of Land, Infrastructure, Transport, and Tourism' ; the term 'warden of the penal institution' in paragraphs (2) to (6) inclusive under said Article shall be read as 'coast guard detention services manager' ; and the term 'a medical doctor on the staff of the penal institution' in said paragraph shall be read as 'a medical doctor commissioned by the coast guard detention services manager'.
