- An Electricity Utility or Wholesale Supplier may, when it is necessary to install Electric Lines to be used for an Electricity Business or Wholesale Supply on a road, bridge, ditch, river, embankment or other public land, use them with permission from the administrator thereof to the extent that such use does not impair their usability.

- In the case of the preceding paragraph, as for the business that conducts transportation of passengers or freight by railway to meet the needs of others by directly borrowing railway tracks from Japan Railway Construction, Transport and Technology Agency or directly using the railway tracks that is owned by Japan Railway Construction, Transport and Technology Agency or Japan Expressway Holding and Debt Repayment Agency, the provisions of this Act shall apply to the said business by regarding the business as Type I Railway Business.

The same shall apply if they intend to change the arrangement.

- Small Capacity Generation Facilities installed at the premises (including Electric Facilities installed at the same premises and electrically connected with such generation facilities for using electricity), which are electrically connected with Electric Facilities installed outside the premises only via the electric lines used by another person at the said premises for receiving electricity at a voltage lower than that specified by an Ordinance of the Ministry of Economy, Trade and Industry under the preceding item.

- Electric Facilities for receiving electricity from another person at a voltage lower than that specified by an Ordinance of the Ministry of Economy, Trade and Industry and using the electricity thus received at the same premises where it has been received (including Small Capacity Generation Facilities installed in the same premises and electrically connected with such Electric Facilities), which are electrically connected with Electric Facilities installed outside the premises only via the electric lines used for receiving electricity.
- 電気事業者は、植物が電気事業の用に供する電線路に障害を及ぼし、若 しくは及ぼすおそれがある場合又は植物が電気事業の用に供する電気工作物に関する測量若しくは実地調査若しくは電気事業の用に供する電線路に関する工事に 支障を及ぼす場合において、やむを得ないときは、経済産業大臣の許可を受けて、その植物を伐採し、又は移植することができる。
- Where plants cause or are likely to cause interference with Electric Lines to be used for an Electricity Business or plants cause hindrance to taking measurements or field investigations with regard to Electric Facilities to be used for an Electricity Business or a construction project with regard to Electric Lines to be used for an Electricity Business, an Electricity Utility may, when it is unavoidable, clear or transplant such plants with permission from the Minister of Economy, Trade and Industry.

- A Specified-Scale Electricity Utility shall, when conducting a Specified-Scale Electricity Business via the electric lines that the Specified-Scale Electricity Utility independently maintains and operates, notify the Minister of Economy, Trade and Industry, pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry, of the matters concerning each electric line and the place where electricity is to be supplied via the electric line (hereinafter referred to as 'Place of Supply' in this Article), which are specified by an Ordinance of the Ministry of Economy, Trade and Industry.
- 第二項から第六 項までの規定は、前項の届出に準用する。この場合において、第三項中「電線路を介して特定規模電気事業を行つてはならない」とあるのは「変更をしてはなら ない。ただし、経済産業省令で定める軽微な変更については、この限りでない」と、第四項から第六項までの規定中「電線路を介して特定規模電気事業を行うこ と」とあるのは「変更」と読み替えるものとする。

- In the case the Railway Business Operator intends to construct or improve a railway track or a station, when it is economical and reasonable to take Measures for Smoothing Connection related to the construction or improvement of the said railway track or station, or if the Minister of Land, Infrastructure, Transport and Tourism finds that it is especially necessary by taking into consideration the extent of improvement of the convenience of users, the cost necessary for the construction or improvement, etc., he/she may recommend the Railway Business Operator to take the Measures for Smoothing Connection.

- 事業者は、くい打機又はボーリングマシンを使用して作業を行う場合において、ガス導管、地中電線路その他地下に存する工作物(以下この条において「ガス導管等」という。)の損壊により労働者に危険を及ぼすおそれのあるときは、あらかじめ、作業箇所について、ガス導管等の有無及び状態を当該ガス導管等を管理する者に確かめる等の方法により調査し、これらの事項について知り得たところに適応する措置を講じなければならない。
- The employer shall, in the case where work using a pile driver or boring machine is carried out, and when it is liable to cause dangers to workers due to damage of gas conduits, underground raceways and other underground structure (hereinafter referred to as "gas conduits, etc." in this Article), in advance, make investigation for work place by enquiring the existing of the gas conduits, etc., and confirming their conditions to the person administrating the said gas conduits, etc., and take measures in conformity with what are known by the investigation.
- 卸電気事業者は、振替供給(一般電気事業の用に供するための電気 に係るものであつて、経済産業省令で定めるものに限る。以下この条及び第二十四条の七において同じ。)に係る料金その他の供給条件について、経済産業省令 で定めるところにより、経済産業大臣に届け出なければならない。ただし、その維持し、及び運用する電線路の状況からみて振替供給を行うことが想定されない ものとして経済産業大臣の承認を受けた場合は、この限りでない。
- A Wholesale Electricity Utility shall, pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry, notify the Minister of Economy, Trade and Industry of the rates and other supply conditions for its Cross-Area Wheeling Service (limited, however, to such services for supplying electricity to be used for General Electricity Business, which are specified by an Ordinance of the Ministry of Economy, Trade and Industry; hereinafter the same shall apply in this Article and Article 24-7); provided, however, that this shall not apply where the Minister of Economy, Trade and Industry has granted approval based on the recognition that the Wholesale Electricity Utility is not expected to provide a Cross-Area Wheeling Service in light of the condition of the electric lines that the Wholesale Electricity Utility maintains and operates.
- 経済産業大臣 は、第一項の規定による届出に係る電線路を介して特定規模電気事業を行うことにより前項に規定する一般電気事業者の供給区域内の電気の使用者の利益が著し く阻害されるおそれがあると認めるときは、その届出をした者に対し、その届出を受理した日から二十日(次項の規定により第三項に規定する期間が延長された 場合にあつては、当該延長後の期間)以内に限り、その届出の内容を変更し、又は中止すべきことを命ずることができる。
- When the Minister of Economy, Trade and Industry finds that the Specified-Scale Electricity Business to be conducted via the electric lines to which the notification given under paragraph 1 pertained is likely to harm significantly the interests of electricity users in the service area of the General Electricity Utility prescribed in the preceding paragraph, he/she may, within 20 days from the day when the notification was received (or, if the period prescribed in paragraph 3 has been extended pursuant to the next paragraph, the extended period), order the Specified-Scale Electricity Utility to change the content of the notification or suspend its performance of the Specified-Scale Electricity Business to which such notification pertained .

- Specified-Scale Electricity Business: Business supplying electricity (excluding, however, businesses supplying electricity prescribed in Article 17, paragraph 1, item 1, and businesses conducted under a license set forth in the said paragraph) to meet a certain scale of demand from electricity users that satisfies the requirements specified by an Ordinance of the Ministry of Economy, Trade and Industry (hereinafter referred to as a 'Specified-Scale Demand'), which are conducted by a General Electricity Utility to meet a Specified-Scale Demand in an area other than its service area via electric lines maintained and operated by another General Electricity Utility, or conducted by a person other than a General Electricity Utility.
- 電気事業者は、次に掲げる目的のため他人の土地又はこれに定着する建 物その他の工作物(以下「土地等」という。)を利用することが必要であり、かつ、やむを得ないときは、その土地等の利用を著しく妨げない限度において、こ れを一時使用することができる。ただし、建物その他の工作物にあつては、電線路(その電線路の維持及び運用に必要な通信の用に供する線路を含む。)又はそ の附属設備(以下「電線路」と総称する。)を支持するために利用する場合に限る。
- An Electricity Utility may, when it is necessary and unavoidable, temporarily use another person's land or buildings and other structures affixed thereto (hereinafter referred to as 'Land, etc.') for any of the following purposes to the extent that such use does not significantly hinder another person's use of the Land, etc.; provided, however, that the use of buildings and other structures shall be allowed only for the purpose of supporting electric lines (including lines used for communication necessary for the maintenance and operation of electric lines) or auxiliary equipment thereof (hereinafter collectively referred to as 'Electric Lines').
- 事業者は、高圧又は特別高圧の電路の断路器、線路開閉器等の開閉器で、負荷電流をしや断するためのものでないものを開路するときは、当該開閉器の誤操作を防止するため、当該電路が無負荷であることを示すためのパイロツトランプ、当該電路の系統を判別するためのタブレツト等により、当該操作を行なう労働者に当該電路が無負荷であることを確認させなければならない。ただし、当該開閉器に、当該電路が無負荷でなければ開路することができない緊錠装置を設けるときは、この限りでない。
- The employer shall, when opening a switch such as a disconnector and line switch for high voltage or extra-high voltage electrical circuit that is not for breaking load current, in order to prevent an operational error of the said switch, have workers engaged in the said operation confirm that the said electric circuit is on no load using a pilot lamp indicating that such electric circuit is on no load, a tablet for identifying the said electrical circuit, etc. However, this shall not apply to when a locking device is provided for the said switch not to allow circuit opening unless the said electrical circuit is not load.
- 電気事業者は、植物が電 気事業の用に供する電線路に障害を及ぼしている場合において、その障害を放置するときは、電線路を著しく損壊して電気の供給に重大な支障を生じ、又は火災 その他の災害を発生して公共の安全を阻害するおそれがあると認められるときは、第一項の規定にかかわらず、経済産業大臣の許可を受けないで、その植物を伐 採し、又は移植することができる。この場合においては、伐採又は移植の後、遅滞なく、その旨を経済産業大臣に届け出るとともに、植物の所有者に通知しなけ ればならない。
- Where plants cause interference with Electric Lines to be used for an Electricity Business and it appears that if such interference were left unaddressed it would significantly damage the Electric Lines, thereby causing serious hindrance to the supply of electricity or cause a fire or other disaster, thereby harming public safety, an Electricity Utility may, notwithstanding the provision of paragraph 1, clear or transplant such plants without permission from the Minister of Economy, Trade and Industry. In this case, the Electricity Utility shall, without delay after the clearing or transplantation, notify the Minister of Economy, Trade and Industry as well as the owner of the plants to that effect.
- 経済産業大臣 は、第一項の規定による届出に係る電線路を介して特定規模電気事業を行うことにより第四項に規定する一般電気事業者の供給区域内の電気の使用者の利益が著 しく阻害されるおそれがあるかどうかについて審査するため相当の期間を要し、当該審査が第三項に規定する期間内に終了しないと認める相当の理由があるとき は、二十日の範囲内において、同項の期間を延長することができる。この場合において、経済産業大臣は、その届出をした者に対し、遅滞なく、当該延長後の期 間及び当該延長の理由を通知しなければならない。
- The Minister of Economy, Trade and Industry may, when he/she has reasonable grounds for believing that it will take a considerable period of time to examine whether or not the Specified-Scale Electricity Business to be conducted via the electric lines to which the notification given under paragraph 1 pertained is likely to harm significantly the interests of electricity users in the service area of the General Electricity Utility prescribed in paragraph 4 and that such examination will not be completed within the period prescribed in paragraph 3, extend the period set forth in the said paragraph by up to 20 days. In this case, the Minister of Economy, Trade and Industry shall notify the Specified-Scale Electricity Utility who has given the notification of the extended period and the reason for extension without delay.
- なお、1921年(大正10年)8月1日に東海道本線のルートが逢坂山トンネル・東山トンネルの開通によって馬場~京都間で変更・短縮される事になった際に、至便性を上げるため五条通の市街地近くに駅を移設する案と、新しい市街地の開発を図るため京都北部を周回するルートに変えて、二条駅が現在設けられている付近に新しい京都総合駅を設けようという案もあったが、市街地付近に線路を引き込むのは予算や用地・工事の面で困難であった事と、京都付近で線路を周回させるのはトンネル開通に伴う距離短縮効果を失わせるという事から、どちらも立ち消えになった。
- Moreover, on August 1, 1921, when the route of the Tokaido Main Line in the section between Baba and Kyoto was to be changed and shortened thanks to the opening of Osakayama Tunnel and Higashiyama Tunnel, two plans--one being to transfer the station toward the urban area around the Gojo-dori Street in order to enhance the convenience, and the other being to change the existing route to a circuitous route in the northern part of Kyoto and construct a new Kyoto general station near the present Nijo Station so as to promote the development of a new urban area--were proposed to improve the utility, although eventually both plans faded, owing to the difficulty of budgeting and construction extending the line close to the urban area as well as the inconvenience that if the line were to go around Kyoto the distance shortened by the opening of the tunnels would be offset.
- 電気事業者又は卸供給事業者が電気事業又は卸供給を行う事業の用に供する電線路を設 置するため前項の道路又は道路となるべき区域内の土地若しくは当該土地に設置された道路の附属物となるべきものを占用しようとする場合において、道路法第 三十九条第一項(同法第九十一条第二項において準用する場合を含む。)の規定により道路管理者が徴収する占用料の額の決定又は同法第八十七条第一項(同法 第九十一条第二項において準用する場合を含む。)の規定により許可若しくは承認に条件を付したことについての審査請求又は異議申立てに対して裁決又は決定 をしようとするとき。
- Where an Electricity Utility or Wholesale Supplier intends to occupy roads or land areas on which roads are to be constructed or accessories to roads constructed on such land as set forth in the preceding paragraph for the purpose of installing Electric Lines to be used for an Electricity Business or Wholesale Supply, and the Competent Minister intends to make an award or decision in response to a request for review of or objection to the determination of the amount of an occupation fee to be collected by the road administrator pursuant to Article 39, paragraph 1 of the Road Act (including the cases where it is applied mutatis mutandis pursuant to Article 91, paragraph 2 of the said Act) or the imposition of a condition to the permission or approval under Article 87, paragraph 1 of the said Act (including the cases where it is applied mutatis mutandis pursuant to Article 91, paragraph 2 of the said Act).

- Railway fare and ship fare (including a lighterage and pierage) shall be calculated respectively as comprising [1] passenger fare (in the case of travel by a route or a ship for which there are fare classes, if the fare is categorized into three classes, the second- or third-class fare as considered reasonable by the court, and if the fare is categorized into two classes, the fare of the class as considered reasonable by the court) corresponding to the distance of the span traveled, [2] express charge (a limited express charge for travel of 100 kilometers or more one way between points where there is a railway on which a limited express train runs; an ordinary express charge or semi-express charge for travel of fewer than 100 kilometers and 50 kilometers or more one way between points where there is a railway on which an ordinary express train or semi-express train runs), [3] special compartment charge or special cabin charge, if the payment of which is considered reasonable by the court, and [4] seat reservation charge (limited to a seat reservation charge in the case of travel of 100 kilometers or more one way between points where there is a railway on which an ordinary express train requiring a seat reservation charge runs, or travel by ship between points where there is a route on which a ship requiring a seat reservation charge runs); a distance fare shall be calculated as the amount determined by the court within the range specified by the Supreme Court; and an airfare shall be calculated by the passenger fare actually paid.

- Train fares and boat fares shall be calculated based on the passenger fare (including any lighterage or pierage dues, and in the case of travel by rail transport or water transport where the fare varies by grade, if the fare has three grades, it shall be the fare for the middle or the lowest grade, whichever the Japan Fair Trade Commission deems reasonable, and if the fare has two grades, it shall be the fare for whichever grade the Japan Fair Trade Commission deems reasonable), any express fare (for travel of 100 kilometers or more each way in a section where a special express train is operated, it shall be the special express fare, and for travel of 50 kilometers or more each way in a section where an ordinary express train or a local express train is operated, it shall be the ordinary express fare or the local express fare), and any special vehicle charge or special cabin charge or reserved-seat charge (limited to a reserved-seat charge for travel of 100 kilometers or more each way in a section where an ordinary express train that charges a reserved-seat charge is operated or for travel in a section where a ship that charges a reserved-seat charge is operated) which the Japan Fair Trade Commission finds reasonable, according to the distance of the traveled section; distance fees shall be calculated based on the amount which the Japan Fair Trade Commission finds reasonable not exceeding 37 yen per kilometer; and air fares shall be calculated based on the passenger fare that is actually paid.
