- The formation of an advanced information and telecommunications network society shall encourage electronic commerce and other economic activities that depend on advanced information and telecommunications networks (hereinafter referred to as 'electronic commerce, etc.'), improvement in the management efficiency and productivity of small and medium enterprise operators and other business operators, creation of new businesses and increased employment opportunities, thereby facilitating economic structural reforms and reinforcing international industrial competitiveness.
- 第二条第一項第一号から第九号まで、第十二号又は第十五号に掲げる不正競争によって営業上の利益を侵害された者は、故意又は過失により自己の営業上の利益を侵害した者に対し、次の各号に掲げる不正競争の区分に応じて当該各号に定める行為に対し受けるべき金銭の額に相当する額の金銭を、自己が受けた損害の額としてその賠償を請求することができる。

- Any person who has been using in Japan a trademark identical with, or similar to, a regionally based collective trademark for which an application for registration is filed by another person in connection with the designated goods or designated services for which the application for trademark registration is filed, or in connection with goods or services similar thereto, without any intention to be engaged in unfair competition, prior to the filing of such other person's application for trademark registration of the said regionally based collective trademark, shall have the right to use the trademark in connection with such goods or services as far as the said person continuously uses the trademark in connection with such goods or services. - In addition to the business activities under the provisions of the preceding two paragraphs, the Regional Companies may, subject to the authorization of the Minister, operate the telecommunications business activities and other business activities by using facilities or technologies which are maintained in order to operate the business activities under the provisions of paragraph (3), or their staff. In this case, the Minister shall grant authorization if it is deemed that the business activities operated by the Regional Companies do not interfere smooth implementation of the business activities under the provisions of the same paragraph and securement of fair competition of the telecommunications business.

- In light of the fact that enhancing Technology Management Capability contributes to the enhancing of Industrial Technology Capability as prescribed in the preceding paragraph, the enhancement of Technology Management Capability shall be carried out based on the premise that when business operators engage in research and development, it is important for said business operators to accurately grasp the current status of their competitiveness and the trends of technical innovation, and it is also important for said business operators to seek broad knowledge regardless of their current business field and to assimilate the knowledge thus obtained and utilize it.

- The Government shall review the status of legal system pertaining to telecommunications including the classification pertaining to telecommunications and broadcasting, taking into account the implementation status of the provisions as amended by this Act, technologies pertaining to the Internet and other advanced information and telecommunications networks and trends in use thereof and changes in socioeconomic climates in Japan and foreign countries, and taking into consideration facilitation of international telecommunications business and improvement of international competitiveness of Japanese telecommunications technologies, and shall take necessary measures for preparing legal frameworks, etc. based on the conclusion of the review.
- 新法第三条から第五条まで、第十四条及び第十五条の規定は、平成三年六月十五日前に行われた新法第二条第一項第四号に規定する不正取得行為又は同項第八号に規定する不正開示行為に係る同項第四号から第六号まで、第八号又は第九号に掲げる不正競争であって同日以後に行われるもの(次の各号に掲げる行為に該当するものを除く。)及び同日前に開始した同項第七号に規定する営業秘密を使用する行為を継続する行為については、適用しない。
- The provisions of Articles 3 through 5, Article 14, and Article 15 of the New Act shall not apply to acts of unfair competition listed in Article 2, paragraph (1), items (iv) through (vi), (viii) and (ix) of the New Act pertaining to the act of wrongful acquisition prescribed in item (iv) of the same paragraph or the act of improper disclosure prescribed in item (viii) of the same paragraph that took place before June 15, 1991, if such acts of unfair competition are committed after such date (excluding acts listed in the following items), or to continuation of an act of using a trade secret prescribed in item (vii) of the same paragraph that was commenced before such date:
- 政府は、この法律による改正後の規定の実施状況、インターネットその他の 高度情報通信ネットワークに係る技術及びその利用の動向その他内外の社会経済情勢の変化等を勘案し、並びに国際的な電気通信事業の円滑な遂行及び我が国の 電気通信技術の国際競争力の向上に配意し、通信と放送に係る事業の区分を含む電気通信に係る制度の在り方について総合的に検討を加え、その結果に基づいて 法制の整備その他の必要な措置を講ずるものとする。

- 第二条第一項第四号から第九号までに掲げる不正競争のうち、営業秘密を使用する行為に対する第三条第一項の規定による侵害の停止又は予防を請求する権利は、その行為を行う者がその行為を継続する場合において、その行為により営業上の利益を侵害され、又は侵害されるおそれがある保有者がその事実及びその行為を行う者を知った時から三年間行わないときは、時効によって消滅する。その行為の開始の時から十年を経過したときも、同様とする。
- Among the acts of unfair competition listed in Article 2, paragraph (1), items (iv) through (ix), the right to seek the suspension of or protection from infringement under the provisions of Article 3, paragraph (1) against use of a trade secret shall be extinguished by prescription if the infringer continues to engage in the infringing act and the holder of the right whose business interests have been infringed or are likely to be infringed by the act does not exercise the right within three years from the time that he/she becomes aware of the infringement. The same shall apply when ten years have elapsed from the time of commencement of the infringing act.
- 意匠権、商標権、著作者の権利(プログラムの著作物についての著作者の権利を除く。)、出版権、著作隣接権若しくは育成者権に関する訴え又は不正競争(不正競争防止法(平成五年法律第四十七号)第二条第一項に規定する不正競争をいう。)による営業上の利益の侵害に係る訴えについて、第四条又は第五条の規定により次の各号に掲げる裁判所が管轄権を有する場合には、それぞれ当該各号に定める裁判所にも、その訴えを提起することができる。
- With regard to an action relating to a design right, trademark right, author's right (excluding an author's right over a computer program), right of publication, neighboring right or breeder's right or an action pertaining to the infringement of business interests by unfair competition (meaning unfair competition prescribed in Article 2(1) of the Unfair Competition Prevention Act (Act No. 47 of 1993)), if any of the courts listed in the following items shall have jurisdiction pursuant to the provisions of Article 4 or Article 5, such action may also be filed with the court specified in the respective items:
- この法律は、私的独占、不 当な取引制限及び不公正な取引方法を禁止し、事業支配力の過度の集中を防止して、結合、協定等の方法による生産、販売、価格、技術等の不当な制限その他一 切の事業活動の不当な拘束を排除することにより、公正且つ自由な競争を促進し、事業者の創意を発揮させ、事業活動を盛んにし、雇傭及び国民実所得の水準を 高め、以て、一般消費者の利益を確保するとともに、国民経済の民主的で健全な発達を促進することを目的とする。
- The purpose of this Act is, by prohibiting private monopolization, unreasonable restraint of trade and unfair trade practices, by preventing excessive concentration of economic power and by eliminating unreasonable restraint of production, sale, price, technology, etc., and all other unjust restriction on business activities through combinations, agreements, etc., to promote fair and free competition, to stimulate the creative initiative of entrepreneurs, to encourage business activities, to heighten the level of employment and actual national income, and thereby to promote the democratic and wholesome development of the national economy as well as to assure the interests of general consumers.
- 私的独占の禁止及び公正取引の確保に関する法律の規定は、次条第一項の認可を受けて行う次に掲げる行為には、適用しない。ただし、不公正な取引方法を用いるとき、一定の取引分野における競争を実質的に制限することにより利用者の利益を不当に害することとなるとき、又は第百十一条の三第四項の規定による公示があつた後一月を経過したとき(同条第三項の請求に応じ、国土交通大臣が第百十一条の二の規定による処分をした場合を除く。)は、この限りでない。
- The provisions of the Act concerning the Prohibition of Private Monopolization and Maintenance of Fair Trade shall not apply to any of the following action effected upon approval under paragraph (1) of the next article; provided, however, that the same shall not apply in case where unfair business practices are used or substantive limitations in competition in the specific field of trade unfairly impair the benefits of users, or where one month has passed since a public announcement under the provisions of Article 111-3 paragraph (4) was made (except where the Minister of Land, Infrastructure, Transport and Tourism has made a decision under the provisions of Article 111-2 upon request under paragraph (3) of the same article).
- 第二条第一項第一号、第二号及び第十五号に掲げる不正競争 自己の氏名を不正の目的(不正の利益を得る目的、他人に損害を加える目的その他の不正の目的をいう。以下同じ。)でなく使用し、又は自己の氏名を不正の目的でなく使用した商品を譲渡し、引き渡し、譲渡若しくは引渡しのために展示し、輸出し、輸入し、若しくは電気通信回線を通じて提供する行為(同号に掲げる不正競争の場合にあっては、自己の氏名を不正の目的でなく使用して役務を提供する行為を含む。)
- unfair competition set forth in Article 2, paragraph (1), items (i), (ii) and (xv) an act of using one's own name without a wrongful purpose (which means a purpose of acquiring an illicit gain, a purpose of causing injury to another person, or any other wrongful purpose; the same shall apply hereinafter), or an act of assigning, delivering, displaying for the purpose of assignment or delivery, exporting, importing or providing through a telecommunications line, goods using one's own name without a wrongful purpose (including an act of providing services using one's own name without a wrongful purpose, in the case of unfair competition set forth in item (xv));

- documents pertaining to a trial under Article 46(1) (including cases where it is applied mutatis mutandis pursuant to Article 68(4)), 50(1), 51(1), 52-2(1), 53(1) or 53-2 (including cases where it is applied mutatis mutandis pursuant to Article 68(4)) or a retrial of the final and binding trial decision rendered in the said trial, with respect to which the party in the case or an intervener has given notice that a trade secret owned by the said party in the case or intervener has been described (trade secret as provided in Section 2(6) of the Unfair Competition Prevention Act (Act No. 47 of 1993));

- Measures for the creation, protection and exploitation of intellectual property shall be promoted with the objective of achieving an intensification of the technical capabilities of Japanese industry and the revitalization of the industry, the activation of the local economy, and an increase in job opportunities, thereby contributing to the intensification of the international competitiveness of Japanese industry and a sustainable development of Japanese industry that precisely responds to the changes in the economic environment at home and abroad, through encouraging smooth transfer of the results of creative Research and Development into commercial use and promoting the development of new business fields, management innovation and business startups, all of which are based on intellectual property.
- 国土形成計画は、我が国及び世界における人口、産業その他の社会経済構造の変化に的確に対応し、その特性に応じて自立的に発展する地域社会、国際競争力の強化及び科学技術の振興等による活力ある経済社会、安全が確保された国民生活並びに地球環境の保全にも寄与する豊かな環境の基盤となる国土を実現するよう、我が国の自然的、経済的、社会的及び文化的諸条件を維持向上させる国土の形成に関する施策を、当該施策に係る国内外の連携の確保に配意しつつ、適切に定めるものとする。
- National Spatial Strategies shall appropriately formulate measures for the spatial development to maintain and improve the natural, economic, social and cultural conditions of Japan, while paying attention to securing domestic and international coordination pertaining to the said measures, in order to appropriately respond to the changes in social and economic structures including population and industry in Japan and the world and realize a national land that acts as the foundation of: local communities that independently develop in accordance with their own characteristics; a vital economy and society through the enhancement of international competitiveness, promotion of science and technology, etc.; citizens' lives for which safety is secured; and a rich environment which also contributes to the preservation of the global environment.
- 前二項において「事業支 配力が過度に集中すること」とは、会社及び子会社その他当該会社が株式の所有により事業活動を支配している他の国内の会社の総合的事業規模が相当数の事業 分野にわたつて著しく大きいこと、これらの会社の資金に係る取引に起因する他の事業者に対する影響力が著しく大きいこと又はこれらの会社が相互に関連性の ある相当数の事業分野においてそれぞれ有力な地位を占めていることにより、国民経済に大きな影響を及ぼし、公正かつ自由な競争の促進の妨げとなることをい う。
- The term 'excessive concentration of economic power' in the preceding two paragraphs means a situation in which the extreme largeness of comprehensive business scale over a considerable number of fields of business of a corporation and its subsidiaries and other corporations in Japan whose business activities are controlled by the said corporation through holding of their stocks, the remarkably strong power of the said corporations to influence other entrepreneurs due to transactions pertaining to the funds of, or the occupancy of influential positions over a considerable number of interrelated fields of business by the said corporations, has a large effect on the national economy and impedes the promotion of fair and free competition.

- 公正取引委員 会は、第八条の四第一項に係る事件について第五十三条第一項の規定により審判開始決定をした後、被審人が、審判開始決定書記載の事実及び法律の適用を認め て、公正取引委員会に対し、その後の審判手続を経ないで審決を受ける旨を文書をもつて申し出て、かつ、独占的状態に係る商品又は役務について競争を回復さ せるために自らとるべき具体的措置に関する計画書を提出した場合において、適当と認めたときは、その後の審判手続を経ないで当該計画書記載の具体的措置と 同趣旨の審決をすることができる。
- After the Fair Trade Commission has decided to commence a hearing pursuant to the provisions of paragraph 1 of Article 53 regarding a case pertaining to paragraph 1 of Article 8-4, the Fair Trade Commission may, where the respondent admits the facts and the application of the law as stated in the written decision of commencement of the hearing, and offers in writing to accept the decision without requiring subsequent hearing procedures and submits to the Fair Trade Commission a written plan setting forth concrete measures which the respondent proposes voluntarily to take in order to restore competition with respect to the goods or services involved in the monopolistic situation, render a decision to the effect of the concrete measures stated in such plan without conducting the subsequent hearing procedures if the Fair Trade Commission finds it appropriate.
- 商標権が移転された結果、同一の商品若しくは役務について使用をする類似の登録商標又は類似の商品若しくは役務について使用をする同一若しくは類似の登録商標に係る商標権が異なつた商標権者に属することとなつた場合において、その一の登録商標に係る商標権者が不正競争の目的で指定商品又は指定役務についての登録商標の使用であつて他の登録商標に係る商標権者、専用使用権者又は通常使用権者の業務に係る商品又は役務と混同を生ずるものをしたときは、何人も、その商標登録を取り消すことについて審判を請求することができる。
- Where a trademark right to a similar registered trademark to be used in connection with identical goods or services, or a trademark right to an identical or similar registered trademark to be used in connection with similar goods or services becomes owned by a different holder of trademark right as a result of transfer of the trademark right, if the holder of trademark right of one of the registered trademarks uses, for the purpose of unfair competition, the registered trademark for its designated goods or designated services in a manner that causes confusion in connection with the goods or services pertaining to the business of the holder of trademark right, exclusive right to use or non-exclusive right to use of the other registered trademark, any person may file a request for a trial for rescission of the trademark registration.
- 独占的状態があるとき は、公正取引委員会は、第八章第二節に規定する手続に従い、事業者に対し、営業の一部の譲渡その他当該商品又は役務について競争を回復させるために必要な 措置を命ずることができる。ただし、当該措置により、当該事業者につき、その供給する商品若しくは役務の供給に要する費用の著しい上昇をもたらす程度に事 業の規模が縮小し、経理が不健全になり、又は国際競争力の維持が困難になると認められる場合及び当該商品又は役務について競争を回復するに足りると認めら れる他の措置が講ぜられる場合は、この限りでない。
- When a monopolistic situation exists, the Fair Trade Commission may order the relevant entrepreneur, pursuant to the procedures provided for in Section 2 of Chapter VIII, to transfer a part of its business or to take any other measures necessary to restore competition with respect to the relevant goods or services; provided, however, that this shall not apply to cases where it is found that such measures may, in relation to the said entrepreneur, reduce the scale of business to such an extent that the expenses required for the supply of goods or services which the said entrepreneur supplies will rise sharply, undermine its financial position, or make it difficult to maintain its international competitiveness, or where such alternative measures may be taken that is found sufficient to restore competition with respect to the relevant goods or services.
- 特許、実用新案、意匠、商標、回路配置若しくは特定不正競争に関する事件又は著作物(著作権法(昭和四十五年法律第四十八号)第二条第一項第一号に規定する著作物をいう。以下同じ。)に関する権利に関する事件の裁判外紛争解決手続(裁判外紛争解決手続の利用の促進に関する法律(平成十六年法律第百五十一号)第一条に規定する裁判外紛争解決手続をいう。以下この号において同じ。)であって、これらの事件の裁判外紛争解決手続の業務を公正かつ適確に行うことができると認められる団体として経済産業大臣が指定するものが行うものについての代理
- Representing such others with regard to alternative dispute resolution procedures (meaning alternative dispute resolution procedures as provided in Article 1 of the Act on Promotion of Use of Alternative Dispute Resolution (Act No. 151 of 2004). Hereinafter the same shall apply in this item.) pertaining to any cases related to patents, utility models, designs, trademarks, circuit layouts or specific unfair competition, or any cases related to a right concerning any works (meaning the works as provided in Article 2 (1) (i) of the Copyright Act (Act No. 48 of 1970). The same shall apply hereinafter.) to the extent that such procedures are performed by a body designated by the Minister of Economy, Trade and Industry as a body recognized to be capable of doing the business of performing alternative dispute resolution procedures for said cases in a fair and proper manner; and
- 商標登録が第三条、第四条第一項第八号若しくは第十一号から第十四号まで若しくは第八条第一項、第二項若しくは第五項の規定に違反してされたとき、商標登録が第四条第一項第十号若しくは第十七号の規定に違反してされたとき(不正競争の目的で商標登録を受けた場合を除く。)、商標登録が第四条第一項第十五号の規定に違反してされたとき(不正の目的で商標登録を受けた場合を除く。)又は商標登録が第四十六条第一項第三号に該当するときは、その商標登録についての同項の審判は、商標権の設定の登録の日から五年を経過した後は、請求することができない。
- Where a trademark registration has been made in violation of Article 3, 4(1)(viii), 4(1)(xi) to 4(1)(xiv), 8(1), 8(2) or 8(5), where a trademark registration has been made in violation of Article 4(1)(x) or 4(1)(xvii) (excluding the case where a trademark has been registered for the purpose of unfair competition), where a trademark has been registered in violation of Article 4(1)(xv) (excluding the case where a trademark has been registered for unfair purposes), or where a trademark registration falls under Article 46(1)(iii), a request for a trial relating to the trademark registration under Article 46(1) may not be filed after a lapse of five years from the date of registration of the establishment of the trademark right.
- 商標登録出願の日前又はこれと同日の特許出願に係る特許権がその商標登録出願に係る商標権と抵触する場合において、その特許権の存続期間が満了したときは、その満了の際現にその特許権についての専用実施権又はその特許権若しくは専用実施権についての特許法第九十九条第一項の効力を有する通常実施権を有する者は、原権利の範囲内において、その商標登録出願に係る指定商品若しくは指定役務又はこれらに類似する商品若しくは役務についてその登録商標又はこれに類似する商標の使用をする権利を有する。ただし、その使用が不正競争の目的でされない場合に限る。
- Where a patent right of an application that has been filed prior to or on the same date as the filing date of an application for trademark registration conflicts with the trademark right of the application for trademark registration, upon expiration of the duration of the said patent right, the person who, at the time of expiration of the duration of the patent right, has the exclusive registered right to work the patent right, or a non-exclusive registered right to work which is effective on the patent right or on the exclusive registered right to work under Article 99(1) of the Patent Act, shall have the right to use the registered trademark or a trademark similar thereto, within the limits of the original patent right, in connection with the designated goods or designated services specified in the application for trademark registration, or goods or services similar thereto; provided, however, that such trademark is not used for the purpose of unfair competition.
- この法律において「入札談合等」とは、国、地方公共団体又は特定法人(以下「国等」という。)が入札、競り売りその他競争により相手方を選定する方法(以下「入札等」という。)により行う売買、貸借、請負その他の契約の締結に関し、当該入札に参加しようとする事業者が他の事業者と共同して落札すべき者若しくは落札すべき価格を決定し、又は事業者団体が当該入札に参加しようとする事業者に当該行為を行わせること等により、私的独占の禁止及び公正取引の確保に関する法律(昭和二十二年法律第五十四号)第三条又は第八条第一項第一号の規定に違反する行為をいう。
- The term 'bid rigging etc.' in this Act shall mean, in respect of conclusion of agreements by the government, local governments or specified corporations (hereinafter referred to as 'government, etc.') for the sale and purchase, lease, contract, etc., with a counter party to be chosen by auction or other competitive means (hereinafter referred to as 'bidding, etc.'), the acts in violation of the provision of Article 3 or Article 8, paragraph 1, item 1 of the Act on the Prohibition of Private Monopolization and Maintenance of Fair Trade (Act No. 54 of 1947), through such practices that a entrepreneur wishing to participate in the bidding decides in conjunction with other entrepreneurs the successful bidder or the successful bid price, or the trade association makes an entrepreneur wishing to participate in the said bidding do the said acts.
- 国土交通大臣は、特定重要港湾であって、長距離の国際海上コンテナ運送の用に供され、かつ、同一の民間事業者により一体的に運営され、又は運営されることとなる岸壁その他の係留施設及びこれに附帯する荷さばき施設その他の国土交通省令で定める係留施設以外の港湾施設であって国土交通省令で定める規模以上の国際コンテナ埠頭を有するもののうち、コンテナ取扱量その他の国土交通省令で定める事情を勘案し、当該国際コンテナ埠頭の機能の高度化により当該特定重要港湾の運営の効率化を図ることが国際競争力の強化のために特に重要なものを、指定特定重要港湾として指定するものとする。
- The Minister of Land, Infrastructure, Transport and Tourism shall designate those ports, where promotion of the efficient operation of the port through the enhancement of the functions of international container wharves has special importance for the enhancement of international competitiveness, as Designated Special Major Ports based on their cargo volumes, scale of facilities and other conditions specified by an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism. Designated Special Major Ports shall be designated from among the Special Major Ports with international container wharves for long distance international maritime container transport, which are of a scale exceeding that specified by an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism and are composed of quaywalls and other mooring facilities, auxiliary cargo handling facilities and Port Facilities other than the mooring facilities specified by an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism, and are operated or shall be operated by the same private operator as a unit.
- 私的独占の禁止及び公正取引の確保に関する法律第七条第一項及び第二項(排除措置)(第八条の二第二項(事業者団体による既往の違反行為に対する措置)及び第二十条第二項(既往の不公正な取引方法に対する措置)において準用する場合を含む。)、第八条の二第一項及び第三項(事業者団体に対する排除措置)、第二十条第一項(不公正な取引方法に係る排除措置)、第七十条の十三第一項(裁判所の緊急停止命令又はその変更・取消し)並びに第七十四条(告発・不起訴処分の報告)の規定は、第一項の認定を受けた公正競争規約及びこれに基づいてする事業者又は事業者団体の行為には、適用しない。
- The provisions of Article 7 (Elimination measures) (1) and (2) (including cases applicable mutatis mutandis under Article 8-2 (Elimination measures against trade associations) (2) and Article 20 (Elimination measures against unfair trade practices) (2)), Article 8-2 (1) and (3), Article 20 (1), Article 70-13 (Urgent temporary suspension order or change or rescission thereof by court) (1) and Article 74 (Accusation and report on non-prosecution) of the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade shall not be applied to the fair competition code that has been authorized under paragraph (1), and to such acts of entrepreneurs or a trade association as have been done in accordance therewith.
- この法律は、内外の社会経済情勢の変化に伴い、我が国産業の国際競争力の強化を図ることの必要性が増大している状況にかんがみ、新たな知的財産の創造及びその効果的な活用による付加価値の創出を基軸とする活力ある経済社会を実現するため、知的財産の創造、保護及び活用に関し、基本理念及びその実現を図るために基本となる事項を定め、国、地方公共団体、大学等及び事業者の責務を明らかにし、並びに知的財産の創造、保護及び活用に関する推進計画の作成について定めるとともに、知的財産戦略本部を設置することにより、知的財産の創造、保護及び活用に関する施策を集中的かつ計画的に推進することを目的とする。
- The purpose of this Act is, for the objective of realizing a dynamic economy and society that is based on the creation of added values through the creation of new intellectual property and effective exploitation of such intellectual property in light of a growing necessity for intensifying the international competitiveness of Japanese industry in response to the changes in the social and economic situations at home and abroad, to promote measures for the creation, protection and exploitation of intellectual property in a focused and systematic manner by stipulating the basic principles on the creation, protection and exploitation of intellectual property and the basic matters to achieve the principles, clarifying the responsibilities of national government, local governments, universities, etc. and business operators, establishing the Intellectual Property Strategy Headquarters, and providing stipulations on the development of a strategic program on the creation, protection and exploitation of intellectual property.
- 特定排出者は、前条第一項の規定による報告に係る温室効果ガス算定排出量の情報が公にされることにより、当該特定排出者の権利、競争上の地位その他正当な利益(以下「権利利益」という。)が害されるおそれがあると思料するときは、当該温室効果ガス算定排出量に代えて、当該特定排出者に係る温室効果ガス算定排出量を事業所ごとに合計した量(当該量によることが困難であると認められる特別な事情がある場合においては、当該特定排出者に係る温室効果ガス算定排出量を主務省令で定めるところにより合計した量。次条第二項第二号において同じ。)をもって次条第一項の規定による通知を行うよう事業所管大臣に請求を行うことができる。
- If there is believed to be a risk that the rights, competitive standing, or other legitimate interests (hereinafter referred to as 'rights and interests') of a specified emitter could be injured by the publication of information on carbon dioxide equivalent greenhouse gas emissions pertaining to a report prescribed in Paragraph (1) of the preceding article, then that specified emitter may submit a request to the minister having jurisdiction over the business in question, asking that the notification prescribed in Article 21-4, Paragraph (1) be conducted using the total value of carbon dioxide equivalent greenhouse gas emissions related to that specified emitter for each place of business (or the carbon dioxide equivalent greenhouse gas emissions pertaining to that specified emitter, totaled as specified by Competent Ministerial Order, if there are found to be special circumstances making it difficult to use that value; the same shall apply in Article 21-4, Paragraph (2), Item (ii)) instead of the carbon dioxide equivalent greenhouse gas emissions in question.
- この法律で「特定不正競争」とは、不正競争防止法(平成五年法律第四十七号)第二条第一項に規定する不正競争であって、同項第一号から第九号まで及び第十二号から第十五号までに掲げるもの(同項第四号から第九号までに掲げるものにあっては技術上の秘密(秘密として管理されている生産方法その他の事業活動に有用な技術上の情報であって公然と知られていないものをいう。以下同じ。)に関するものに限り、同項第十三号に掲げるものにあっては商標に関するものに限り、同項第十四号に掲げるものにあっては特許、実用新案、意匠、商標若しくは回路配置に関する権利又は技術上の秘密についての虚偽の事実に関するものに限る。)をいう。
- The term 'Specific Unfair Competitions' as used in this Act means acts of unfair competition as provided for in Article 2 (1) of the Unfair Competition Prevention Act (Act No. 47 of 1993) which are listed in items (i) to (ix) and items (xii) to (xv) of the same paragraph (However, said acts are limited to those relating to a technological secret (meaning information valuable to business activities such as a production method controlled as a secret, etc. and which is not publicly known. The same shall apply hereinafter) regarding those acts listed in items (iv) to (ix) of the same paragraph, limited to those relating to a trademark with regard to those listed in item (xiii) of the same paragraph, and limited to those relating to a false allegation concerning a technological secret or right regarding a patent, utility model, design, trademark or circuit layout with regard to those listed in item (xiv) of the same paragraph).
- 裁判所は、不正競争による営業上の利益の侵害に係る訴訟において、その当事者が保有する営業秘密について、次に掲げる事由のいずれにも該当することにつき疎明があった場合には、当事者の申立てにより、決定で、当事者等、訴訟代理人又は補佐人に対し、当該営業秘密を当該訴訟の追行の目的以外の目的で使用し、又は当該営業秘密に係るこの項の規定による命令を受けた者以外の者に開示してはならない旨を命ずることができる。ただし、その申立ての時までに当事者等、訴訟代理人又は補佐人が第一号に規定する準備書面の閲読又は同号に規定する証拠の取調べ若しくは開示以外の方法により当該営業秘密を取得し、又は保有していた場合は、この限りでない。
- In a suit for the infringement of business interests by unfair competition, where a prima facie showing is made that a trade secret held by a party of the suit falls under both of the following grounds, the court may, upon motion of the party, issue an order prohibiting a party, etc., a counsel, or an assistant in court from using the trade secret for any purpose other than for the carry out of the suit or from disclosing it to a person other than those who have received the order under the provisions of this paragraph with regard to said trade secret; however, this shall not apply when the party, etc., the counsel, or the assistant in court had already acquired or held the trade secret by means other than the reading of the brief prescribed in item (i) or the examination or disclosure of the evidence prescribed in the same item:
- 第二条第一項第一号、第二号、第十三号及び第十五号に掲げる不正競争 商品若しくは営業の普通名称(ぶどうを原料又は材料とする物の原産地の名称であって、普通名称となったものを除く。)若しくは同一若しくは類似の商品若しくは営業について慣用されている商品等表示(以下「普通名称等」と総称する。)を普通に用いられる方法で使用し、若しくは表示をし、又は普通名称等を普通に用いられる方法で使用し、若しくは表示をした商品を譲渡し、引き渡し、譲渡若しくは引渡しのために展示し、輸出し、輸入し、若しくは電気通信回線を通じて提供する行為(同項第十三号及び第十五号に掲げる不正競争の場合にあっては、普通名称等を普通に用いられる方法で表示をし、又は使用して役務を提供する行為を含む。)
- unfair competition set forth in Article 2, paragraph (1), items (i), (ii), (xiii) and (xv) an act of using or indicating in a normally used manner a common name for goods or business (excluding the name of a place of origin of goods made from grapes or using grapes, which has become a common name) or an indication of goods, etc. that is commonly used for identical or similar goods or business (hereinafter collectively referred to as a 'common name, etc.'), or an act of assigning, delivering, displaying for the purpose of assignment or delivery, exporting, importing or providing through a telecommunications line, goods using or indicating a common name, etc. in a normally used manner (including an act of providing services indicating or using a common name, etc. in a normally used manner, in the case of unfair competition set forth in items (xiii) and (xv) of the same paragraph);
- 不正競争による営業上の利益の侵害に係る訴訟における当事者等が、その侵害の有無についての判断の基礎となる事項であって当事者の保有する営業秘密に該当するものについて、当事者本人若しくは法定代理人又は証人として尋問を受ける場合においては、 裁判所は、裁判官の全員一致により、その当事者等が公開の法廷で当該事項について陳述をすることにより当該営業秘密に基づく当事者の事業活動に著しい支障 を生ずることが明らかであることから当該事項について十分な陳述をすることができず、かつ、当該陳述を欠くことにより他の証拠のみによっては当該事項を判 断の基礎とすべき不正競争による営業上の利益の侵害の有無についての適正な裁判をすることができないと認めるときは、決定で、当該事項の尋問を公開しないで行うことができる。
- In a suit for the infringement of business interests by unfair competition, where a party, etc. is to be examined as a party himself/herself or a legal representative thereof or as a witness with regard to a matter that serves as the basis for determining the presence or absence of the infringement and that is categorized as a trade secret held by a party, if the court, by the unanimous consent of the judges, finds that the party, etc. is unable to give sufficient statements regarding the matter because it is clear that giving statements regarding the matter in open court will significantly hinder the party's business activities that are based on the trade secret, and finds that, without said statements and with other evidence alone, the court is unable to make an appropriate judicial decision on the presence or absence of infringement on business interests by unfair competition which should be determined based on said matter, the court may carry out the examination on said matter in camera by an order.

- In litigation concerning the infringement of a patent right or exclusive license, where there is prima-facie evidence of the fact that trade secrets (refers to trade secrets as provided in Article 2(6) of the Unfair Competition Prevention Act (Act No. 47 of 1993), the same shall apply hereinafter) possessed by a party satisfy all of the following paragraphs, the court may, upon a motion of the party, order by a ruling that the parties, etc., attorneys or assistants shall neither use the trade secrets for any purpose other than those for the proceedings of the litigation nor disclose the trade secrets to any person other than those who receive the order regarding the trade secrets under this provision; provided, however, that this shall not apply where the parties, etc., attorneys or assistants have, prior to the filing of the motion, already obtained or been in the possession of the trade secrets by a method other than by reading of the briefs under item (i) or through the examination or disclosure of evidence under the said item:

- In litigation pertaining to the infringement of a breeder's right or an exclusive exploitation right, where there is prima-facie evidence of the fact that trade secrets (refers to trade secrets as provided in Article 2 (6) of the Unfair Competition Prevention Act (Act No. 47 of 1993), the same shall apply hereinafter) possessed by a party satisfy all of the following conditions, the court may, upon the motion of the party, order by a ruling that the parties, etc., counsels or assistant in courts shall neither use the trade secrets for any purpose other than those for the proceedings of the litigation nor disclose the trade secrets to any person other than those who receive the order regarding the trade secrets under this provision. However, this shall not apply where the parties, etc., counsels or assistant in courts have, prior to the filing of the motion, already obtained or been in the possession of the trade secrets by a method other than by reading of the briefs under item (i) or through the examination or disclosure of evidence under the said item.

- In a lawsuit pertaining to an infringement on the moral rights of author, copyright, right of publication, moral rights of performer or neighboring right, the court may, upon petition of a party, issue an order, in the form of a decision, to any other party, etc., trial counsel or assistant in court to a party or legal counsel, that trade secrets (means "trade secrets" as provided for in Article 2, paragraph (6) of the Unfair Competition Prevention Act (Act No. 47 of 1993); the same shall apply hereinafter) in the possession of the [petitioning] party shall not be used for purposes other than those in furtherance of said lawsuit and shall not be disclosed to persons other than those against whom an order pertaining to such trade secrets has been issued pursuant to the provisions of this paragraph, where a prima facie showing has been made that each of the reasons listed below applies; provided, however, that the foregoing shall not apply where, at the time of such petition, the party, etc. [against which the petitioned order is sought to be issued], trial counsel [against which the petitioned order is sought to be issued] or assistant in court [against which the petitioned order is sought to be issued] had already acquired or possessed such trade secrets by means other than through inspection of the briefs as provided for in item (i) or the examination of evidence or the disclosure provided for in that item.
- 他人の商標登録出願前から日本国内において不正競争の目的でなくその商標登録出願に係る指定商品若しくは指定役務又はこれらに類似する商品若しくは役務についてその商標又はこれに類似する商標の使用をしていた結果、その商標登録出願の際(第九条の四の規定により、又は第十七条の二第一項若しくは第五十五条の二第三項(第六十条の二第二項において準用する場合を含む。)において準用する意匠法第十七条の三第一項の規定により、その商標登録出願が手続補正書を提出した時にしたものとみなされたときは、もとの商標登録出願の際又は手続補正書を提出した際)現にその商標が自己の業務に係る商品又は役務を表示するものとして需要者の間に広く認識されているときは、その者は、継続してその商品又は役務についてその商標の使用をする場合は、その商品又は役務についてその商標の使用をする権利を有する。当該業務を承継した者についても、同様とする。
- Where a trademark identical with, or similar to, the trademark for which the application is filed by another person has been used in Japan in connection with the designated goods or designated services of the trademark for which the application is filed, or in connection with goods or services similar thereto, without any intention to be engaged in unfair competition, from the time prior to the filing of such other person's application for the said trademark registration, and as a result, at the time of filing of the application for trademark registration (at the time of filing of the original application for trademark registration or the submission of a written amendment, if the application for trademark registration is deemed to have been filed at the time of submission of a written amendment under Article 9-4 of this Act or Article 17-3(1) of the Design Act as applied mutatis mutandis under Article 17-2(1) or 55-2(3) of this Act (including its mutatis mutandis application under Article 60-2(2))), such trademark has become well known among consumers as that indicating goods or services pertaining to the business of the person, the person shall have the right to use the trademark in connection with such goods or services as far as the said person continuously uses the trademark for the goods or services. The same shall apply to those by whom such business is succeeded.
- 前二号に該当する者を除くほか、関税法第百八条の四第二項(同法第六十九条の二第一項第三号及び第四号に係る部分に限る。以下この号において同じ。)、第三項(同法第百八条の四第二項に係る部分に限る。)若しくは第五項(同法第六十九条の二第一項第三号及び第四号に係る部分に限る。)、第百九条第二項(同法第六十九条の十一第一項第九号及び第十号に係る部分に限る。以下この号において同じ。)、第三項(同法第百九条第二項に係る部分に限る。)若しくは第五項(同法第六十九条の十一第一項第九号及び第十号に係る部分に限る。)若しくは第百十二条第一項(同法第百八条の四第二項及び第百九条第二項に係る部分に限る。)の罪、著作権法第百十九条から第百二十二条までの罪、半導体集積回路の回路配置に関する法律第五十一条第一項若しくは第五十二条の罪又は不正競争防止法第二十一条第一項若しくは第二項第一号から第四号まで若しくは第六号(同法第十八条第一項に係る部分を除く。)の罪を犯し、罰金の刑に処せられ、その刑の執行を終わり、又はその刑の執行を受けることがなくなった日から三年を経過しない者
- In addition to persons falling under any of the preceding two items, any person who has committed any of the offenses as prescribed in Article 108-4 (2) of the Customs Act (limited to the portions pertaining to Article 69-2 (1) (iii) and (iv) of the same Act. Hereinafter the same shall apply in this item), paragraph (3) (limited to the portions pertaining to Article 108-4 (2) of the same Act) or paragraph (5) (limited to the portions pertaining to Article 69-2 (1) (iii) and (iv) of the same Act), Article 109 (2) (limited to the portions pertaining to Article 69-11 (1) (ix) and (x) of the same Act. Hereinafter the same shall apply in this item), paragraph (3) (limited to the portions pertaining to Article 109 (2) of the same Act) or paragraph (5) (limited to the portions pertaining to Article 69-11 (1) (ix) and (x) of the same Act), or Article 112 (1) of the Customs Act (limited to the portions pertaining to Article 108-4 (2) and Article 109 (2) of the same Act), the offenses as prescribed in Articles 119 to 122 of the Copyright Act, the offenses as prescribed in Article 51 (1) or Article 52 of the Act Concerning the Circuit Layouts of a Semiconductor Integrated Circuit, or the offenses as prescribed in Article 21 (1) or Article 21 (2) (i) to (iv) or (vi) of the Unfair Competition Prevention Act (except for the portions pertaining to Article 18 (1) of the same Act), and has been sentenced to a fine and has not yet passed three years from the date of completion of the execution of such punishment or the date on which such execution has been remitted;
- 第二条第一項第一号から第九号まで又は第十五号に掲げる不正競争(同項第四号から第九号までに掲げるものにあっては、技術上の秘密(秘密として管理されている生産方法その他の事業活動に有用な技術上の情報であって公然と知られていないものをいう。)に関するものに限る。)によって営業上の利益を侵害された者(以下この項において「被侵害者」という。)が故意又は過失により自己の営業上の利益を侵害した者に対しその侵害により自己が受けた損害の賠償を請求する場合において、その者がその侵害の行為を組成した物を譲渡したときは、その譲渡した物の数量(以下この項において「譲渡数量」という。)に、被侵害者がその侵害の行為がなければ販売することができた物の単位数量当たりの利益の額を乗じて得た額を、被侵害者の当該物に係る販売その他の行為を行う能力に応じた額を超えない限度において、被侵害者が受けた損害の額とすることができる。ただし、譲渡数量の全部又は一部に相当する数量を被侵害者が販売することができないとする事情があるときは、当該事情に相当する数量に応じた額を控除するものとする。
- Where a person whose business interests have been infringed by any of the acts of unfair competition listed in Article 2, paragraph (1),items (i) through (ix) or item (xv) (with regard to those listed in items (iv) through (ix) of the same paragraph, it shall only be an act of unfair competition that relates to a technical secret (which means a production method or any other technical information useful for business activities that is controlled as a secret and that is not publicly known)) (such person shall hereinafter be referred to as the 'infringed person' in this paragraph) claims damages, which he/she has incurred from such infringement, against the person who has intentionally or negligently infringed his/her business interests, and where said person who committed the infringement has assigned articles constituting the act of infringement, the amount obtained by multiplying the quantity of the articles assigned (hereinafter referred to as the 'assigned quantity' in this paragraph) by the amount of profit per unit of the articles that the infringed person could have sold in the absence of the act of infringement may be deemed as the amount of damages incurred by the infringed person, to the extent that does not exceed the amount corresponding to the infringed person's capacity to sell or carry out any other acts pertaining to said articles; provided, however, that where there are any circumstances that would have prevented the infringed person from selling the quantity of articles equivalent to all or part of the assigned quantity, an amount corresponding to the quantity relevant to such circumstances shall be deducted.

- The government established one campus of Teikoku (Imperial) University in Kyoto. It had been decided that there would be two universities (in the east and west, respectively) as the center of the best education, and that the two universities would compete with each other as motivation for progress in education; and in Tokyo, several public and private schools as well as Teikoku (Imperial) University already began accepting various applicants; thus the students who had youthful resolution gathered, which is the center of education. However, there were many good, enthusiastic young students gathered at Teikoku (Imperial) University, which was newly established in Kyoto, but the university couldn't accept the applicants who had not graduated from high school, so there was no school to study high education without status as a university, which was the problem of greatest concern, so volunteers who were of the same mind gathered and established the Kyoto Hosei School, entrusting the lectures to the professors of Kyoto Imperial University and other well-known teachers; thus the institution could provide higher education in politics, law and economics to society. Certainly, a reason for that was to demonstrate the government's approval concerning the establishment of education in two places (east and west), and another reason was to make up for the flaw in the educational system whereby Teikoku (Imperial) University was not widely open to applicants who had not graduated from high school ('A Brief History of Ritsumeikan University,' 'Ritsumeikan Gakuho,' March 1915).
- この法律において「公益通報」とは、労働者(労働基準法(昭和二十二年法律第四十九号)第九条に規定する労働者をいう。以下同じ。)が、不正の利益を得る目的、他人に損害を加える目的その他の不正の目的でなく、その労務提供先(次のいずれかに掲げる事業者(法人その他の団体及び事業を行う個人をいう。以下同じ。)をいう。以下同じ。)又は当該労務提供先の事業に従事する場合におけるその役員、従業員、代理人その他の者について通報対象事実が生じ、又はまさに生じようとしている旨を、当該労務提供先若しくは当該労務提供先があらかじめ定めた者(以下「労務提供先等」という。)、当該通報対象事実について処分(命令、取消しその他公権力の行使に当たる行為をいう。以下同じ。)若しくは勧告等(勧告その他処分に当たらない行為をいう。以下同じ。)をする権限を有する行政機関又はその者に対し当該通報対象事実を通報することがその発生若しくはこれによる被害の拡大を防止するために必要であると認められる者(当該通報対象事実により被害を受け又は受けるおそれがある者を含み、当該労務提供先の競争上の地位その他正当な利益を害するおそれがある者を除く。次条第三号において同じ。)に通報することをいう。
- The term "Whistleblowing" as used in this Act shall mean whistleblowing made by a worker (which shall mean worker as provided for in Article 9 of the Labor Standards Act (Act No. 49 of 1947); the same shall apply hereinafter), without a purpose of obtaining an wrongful gain, a purpose of causing damages to others, or any other wrongful purpose, about Reportable Fact that has been occurred, is being occurred or is about to be occurred by "Business Operator" (which shall mean any of the following business operators (which shall mean juridical person, other organization and individual who operates a business)), or such persons as officer, employee or agent in the workplace where the worker is occupied in performing the Business Operator's business activities, to the said Business Operator or the person designated by the said Business Operator in advance (hereinafter referred to as "Business Operator, etc."), to an Administrative Organ with the authority to impose disposition (which shall mean an order, rescission, and other acts involving the exercise of public authority; the same shall apply hereinafter) or recommendation, etc. (which shall mean a recommendation and other acts which are not disposition; the same shall apply hereinafter) upon the said Reportable Fact, or to any person who are recognized to be necessary to do whistleblowing to the said Reportable Fact in order to prevent the occurrence thereof or the spread of damage caused thereby (including person who suffers or might suffer damage from the said Reportable Fact, but excluding any person who might cause damages to the competitive position or any other legitimate interests of the Business Operator; the same shall apply in Item (iii) of the following Article.).
- ものづくり基盤技術は、我が国の基幹的な産業である製造業の発展を支えることにより、生産の拡 大、貿易の振興、新産業の創出、雇用の増大等国民経済のあらゆる領域にわたりその発展に寄与するとともに、国民生活の向上に貢献してきた。また、ものづく り基盤技術に係る業務に従事する労働者は、このようなものづくり基盤技術の担い手として、その水準の維持及び向上のために重要な役割を果たしてきた。我ら は、このようなものづくり基盤技術及びこれに係る業務に従事する労働者の果たす経済的社会的役割が、国の存立基盤を形成する重要な要素として、今後におい ても変わることのないことを確信する。しかるに、近時、就業構造の変化、海外の地域における工業化の進展等による競争条件の変化その他の経済の多様かつ構 造的な変化による影響を受け、国内総生産に占める製造業の割合が低下し、その衰退が懸念されるとともに、ものづくり基盤技術の継承が困難になりつつある。 このような事態に対処して、我が国の国民経済が国の基幹的な産業である製造業の発展を通じて今後とも健全に発展していくためには、ものづくり基盤技術に関 する能力を尊重する社会的気運を醸成しつつ、ものづくり基盤技術の積極的な振興を図ることが不可欠である。ここに、ものづくり基盤技術の振興に関する施策 を総合的かつ計画的に推進するため、この法律を制定する。
- By way of supporting the development of the manufacturing industry, which is Japan's fundamental industry, core manufacturing technology has contributed to the development of all areas of the national economy such as expansion of production, promotion of trade, creation of new industries, and increase in employment, and has contributed to improving the lives of the citizenry. In addition, workers engaged in operations pertaining to core manufacturing technology have played an important role in maintaining and improving the level of the technology in their capacity as supporters of such core manufacturing technology. We believe that the economic and social role of such core manufacturing technology and workers who engage in operations pertaining thereto will continue to be an important element in the foundation of the existence of the State in the future. Recently, however, due to changes in the employment structure, changes in competitive conditions resulting from factors like the progress of industrialization overseas, and other diverse and structural changes in the economy, the share of the manufacturing industry in Japan's gross domestic product has fallen, and concerns about a decline in the industry have grown, and the smooth succession of core manufacturing technology is becoming difficult. In order to deal with such a situation and to maintain the sound development of Japan's national economy through the development of the manufacturing industry, which is a fundamental to the State, that the active promotion of core manufacturing technology is indispensable, while a social tendency to respect abilities related to core manufacturing technology is enhanced. We hereby establish this Act so as to drive forward measures for the promotion of core manufacturing technology in a comprehensive and organized manner.
- 組織的な犯罪の処罰及び犯罪収益の規制等に関する法律(平成十一年法律第百三十六号。以下「組織的犯罪処罰法」という。)第九条第一項から第三項まで、第十条及び第十一条の規定は、この法律の施行前に財産上の不正な利益を得る目的で犯した第一条の規定による改正前の不正競争防止法第十四条第一項第一号から第六号の二まで若しくは第七号(同法第十一条第一項に係る部分を除く。)、第二条の規定による改正前の特許法第二百条の二第一項、第三条の規定による改正前の実用新案法第六十条の二第一項、第四条の規定による改正前の意匠法第七十三条の二第一項、第五条の規定による改正前の商標法第八十一条の二第一項、第六条の規定による改正前の著作権法第百二十二条の二又は附則第六条の規定による改正前の特許法等の一部を改正する法律(平成五年法律第二十六号)附則第四条第一項の規定によりなおその効力を有するものとされた同法第三条の規定による改正前の実用新案法(附則第六条において「平成五年旧実用新案法」という。)第六十条の二第一項に掲げる罪の犯罪行為(日本国外でした行為であって、当該行為が日本国内において行われたとしたならばこれらの罪に当たり、かつ、当該行為地の法令により罪に当たるものを含む。)により生じ、若しくは当該犯罪行為により得た財産又は当該犯罪行為の報酬として得た財産に関してこの法律の施行後にした行為に対しても、適用する。この場合において、これらの財産は、組織的犯罪処罰法第二条第二項第一号の犯罪収益とみなす。
- The provisions of Article 9, paragraphs (1) through (3), Article 10, and Article 11 of the Act on Punishment of Organized Crimes and Control of Crime Proceeds (Act No. 136 of 1999; hereinafter referred to as the 'Organized Crime Punishment Act' ) shall also apply to an act committed after the enforcement of this Act with regard to assets arising from or acquired through a criminal act constituting any of the offenses listed in the following provisions (including an act committed outside Japan, which would constitute any of these offenses if it were committed in Japan and which constitutes an offense under the laws and regulations of the place of the act) that was committed before the enforcement of this Act in order to acquire an illicit gain in terms of property, or property acquired as a reward for said criminal act: Article 14, paragraph (1), items (i) through (vi)-2, or (vii) of the Unfair Competition Prevention Act (excluding the part pertaining to Article 11, paragraph (1) of the same Act) before the revision by the provision of Article 1 of this Act; Article 200-2, paragraph (1) of the Patent Act before the revision by the provisions of Article 2 of this Act; Article 60-2, paragraph (1) of the Utility Model Act before the revision by the provisions of Article 3 of this Act; Article 73-2, paragraph (1) of the Design Act before the revision by the provisions of Article 4 of this Act; Article 81-2, paragraph (1) of the Trademark Act before the revision by the provisions of Article 5 of this Act; Article 122-2 of the Copyright Act before the revision by the provisions of Article 6 of this Act; or Article 60-2, paragraph (1) of the Utility Model Act before the revision by the provisions of Article 3 of the Act for Partial Revision of the Patent Act, etc. (Act No. 26 of 2003) before the revision by the provisions of Article 6 of the Supplementary Provisions of this Act where said provisions of Article 3 are to remain applicable pursuant to the provisions of Article 4, paragraph (1) of the Supplementary Provisions of the Act for Partial Revision of the Patent Act, etc. (such Utility Model Act shall be referred to as the 'Former Utility Model Act of 1992' in Article 6 of the Supplementary Provisions of this Act). In this case, said property shall be deemed as criminal gains under Article 2, paragraph (2), item (i) of the Organized Crime Punishment Act.
