- 京都旭丘中学事件(きょうとあさひがおかちゅうがくじけん)とは、1953年4月29日-1954年6月1日にかけて発生した京都市立旭丘中学校の教育方針を巡る保守派と進歩派の教員・父母による対立事件。
- The Kyoto Asahigaoka Junior High School affair is a conflict that lasted from April 29, 1953 to June 1, 1954, between conservative and progressive parents/teachers over the education policy of Kyoto Municipal Asahigaoka Junior High school.
- 没年は未詳であるが、息子・長屋王が神亀5年(728年)に奉納したと言われる長屋王願経(神亀経)の釈文(写経の目的は父母の菩提を弔う、とする)から、神亀5年以前には亡くなっていたものと考えられる。

- 1月1日の寅の刻(午前4時ごろ)に、天皇が綾綺殿で黄櫨染御袍(こうろぜんのごほう:みかどの朝服)を召され、清涼殿東庭に出御して天皇の属星(ぞくしょう:誕生年によって定まるという人間の運命を司る北斗七星のなかの星)、天地四方の神霊や父母の天皇陵などの方向を拝し、その年の国家・国民の安康、豊作などを祈った。
- On January 1, torano koku (at about four o'clock in the morning), the Emperor, wearing Korozen no go-ho at Ryoki-den, came to the east garden of Seiryo-den and prayed for his Zokusho (one of the stars of the Big Dipper, which is said to have destiny depending on the year in which the person was born) and spirits in every direction, or the direction of his parents' Imperial Mausoleum, whereupon he wished for the peace and security of the nation and good harvests for the coming year.
- 医療費等を受けることができる者が死亡した場合において、その死亡した者に支給すべき医療費等でまだその者に支給していなかったものがあるときは、その者の配偶者、子、父母、孫、祖父母又は兄弟姉妹であって、その死亡した者の死亡の当時その者と生計を同じくしていたものは、自己の名で、その支給を請求し、当該医療費等の支給を受けることができる。
- In the event that a person entitled to receive medical expenses, etc. dies, if there still remains an amount of medical expenses, etc. yet to be paid to the deceased person, his/her spouse, child, parent, grandchild, grandparent or sibling who shared living expenses with such deceased person when he/she died can request the payment in the name of the person who requests it and can receive the payment of the said medical expenses, etc.
- また、御成敗式目制定時には兄弟甥姪に対する悔返は他人和与の例に準じて認められていなかった(これは公家法と同様であった)が、仁治元年(1240年)に本主(元の所有者)に父母の礼をなすか恩顧によって分与を得たものが本主に敵対する行動をとった場合には悔返の対象とされ、正応3年(1290年)には兄弟甥姪に対する悔返が全面的に認められた。
- Also, when Goseibai-shikimoku was established, the Kuikaeshi against brothers and cousins were not allowed as well as the cases of a compromise with a third person (same as in Kugeho), but in 1240, when the person who received the property from the previous owner for treating the owner's parents well or from patronage became hostile against the owner, it was to be the subject for Kuikaeshi; and in 1290, all Kuikaeshi against brothers and cousins became legal.

- The surviving family members who are eligible to receive a compensation pension for surviving family shall be a worker's spouse, children, parents, grandchildren, grandparents, and siblings who were dependent on the worker's income at the time of his/her death; provided, however, that in the case of those other than a wife (including a person who has not made a notification of marriage but has been in a de facto marital relationship with the worker; the same shall apply hereinafter), this provision shall apply only where they have satisfied the requirements listed in any of the following items at the time of the worker's death:
- 前条の規定に該当する者がない場合においては、遺族補償を受けるべき者は、労働者の子、父母、孫及び祖父母で前条第二項の規定に該当しないもの並びに労働者の兄弟姉妹とし、その順位は、子、父母、孫、祖父母、兄弟姉妹の順序により、兄弟姉妹については、労働者の死亡当時その収入によつて生計を維持していた者又は労働者の死亡当時その者と生計を一にしていた者を先にする。
- When a worker has no one who falls under the provision of the preceding Article, the person who should be given compensation for bereaved family shall be his or her children, parents, grandchildren, and grandparents who do not fall under the provision of paragraph (2) of the preceding Article, and his or her brothers and sisters, in this priority order. As for brothers and sisters, those who made a living from the worker's income, or who lived on common living expenses at the time when the worker died shall have priority.

- Vassal MIWA no Fumiya no Kimi advised the prince '乘馬詣東國 以乳部爲本 興師還戰 其勝必矣 (Escape to the East and prepare to fight back against Iruka), but the prince didn't want to fight and said '如卿所 其勝必然 但吾情冀 十年不役百姓 以一身之故 豈煩勞萬民 又於後世 不欲民言由吾之故 喪己父母 豈其戰勝之後 方言丈夫哉 夫損身固國 不亦丈夫者歟' (if we take up arms and fight against Iruka, surely we will win.
- 失業等給付の支給を受けることができる者が死亡した場合において、その者に支給されるべき失業等給付でまだ支給されていないものがあるときは、その者の配偶者(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にあつた者を含む。)、子、父母、孫、祖父母又は兄弟姉妹であつて、その者の死亡の当時その者と生計を同じくしていたものは、自己の名で、その未支給の失業等給付の支給を請求することができる。
- In the case where a person qualified to receive payment of the benefits for unemployment, etc. has died and part of the benefits remains unpaid, his/her spouse (including a person in a de facto marital relationship with said person, where the marriage has not been registered), children, parents, grandchildren, grandparents and brothers or sisters, who had shared a livelihood with said person at the time of that person's death, may demand payment of said unpaid part of the benefits for unemployment, etc. in their own names.
- 子(あるいは孫)が父母(あるいは祖父母)に対して行うことが違法となる行為を指し、訴訟を起こすこと、呪詛すること、罵詈を浴びせること、父母(祖父母)の許可なく勝手に戸籍や財産を分けて独立すること、父母(祖父母)の喪中(1年間)に婚姻すること、音楽などの娯楽にふけったり喪服を脱ぐこと、父母(祖父母)の死を聞いても悲しまずに平然としていること、父母(祖父母)が死んだと偽ってその妾と通じることが挙げられた。
- It refers to illegal acts done by children (or grandchildren) to their parents (or grandparents) such as follows; filing a suit, cursing, abusing, becoming independent by removing names from the koseki (family register) or inheriting properties without permission, getting married during the time of mourning for parent(s) or grandparent(s) (for one year), indulging in entertainment such as music, taking off mofuku (the livery of grief), staying calm without feeling sad to hear the death of their parent(s) or grandparent(s) and having affairs with concubine of parent(s)' (grandparent(s)') by telling a lie that they were dead.
- 前号ニの厚生労働省令で定める障害の状態にある夫、子、父母、孫、祖父母又は兄弟姉妹については、その事情がなくなったこと(夫、父母又は祖父母については、死亡労働者等の死亡の当時五十五歳以上であったとき、子又は孫については、十八歳に達する日以後の最初の三月三十一日までの間にあるとき、兄弟姉妹については、十八歳に達する日以後の最初の三月三十一日までの間にあるか又は死亡労働者等の死亡の当時五十五歳以上であったときを除く。)。
- If the survivor is the husband, child, parent, grandchild, grandparent or sibling in the state of disability prescribed in the Ordinance of the Ministry of Health, Labour and Welfare set forth in (d) of the preceding item, he/she is not in the state any more (excluding a case where the husband, parent or grandparent was 55 years or older when the deceased person, etc. died, a case where the child or grandchild did not experience the first March 31 after his/her 18th birthday, and a case where the sibling did not experience the first March 31 after his/her 18th birthday or was 55 years old or older when the deceased worker, etc. died).

- in the case of the worker's husband, children, parents, grandchildren, grandparents or siblings who are disabled as specified by an Ordinance of the Ministry of Health, Labour and Welfare set forth in Article 16-2, paragraph (1), item (iv), when such circumstances have ceased to exist (excluding cases where the worker's husband, parents or grandparents were 60 years of age or more at the time of the worker's death, where the worker's children or grandchildren have not experienced the first March 31 after reaching the age of 18, and where the worker's siblings have not experienced the first March 31 after reaching the age of 18 or they were 60 years of age or more at the time of the worker's death).
- 著作者又は実演家の死後においては、その遺族(死亡した著作者又は実演家の配偶者、子、父母、孫、祖父母又は兄弟姉妹をいう。以下この条において同じ。)は、当該著作者又は実演家について第六十条又は第百一条の三の規定に違反する行為をする者又はするおそれがある者に対し第百十二条の請求を、故意又は過失により著作者人格権又は実演家人格権を侵害する行為又は第六十条若しくは第百一条の三の規定に違反する行為をした者に対し前条の請求をすることができる。
- After the death of the author or the performer, [a member of] his bereaved family ("bereaved family" means the surviving spouse, children, parents, grandchildren, grandparents, and brothers and sisters of the deceased author or performer; the same shall apply below in this Article) may make: [(a)] the demand provided for in Article 112 against any person who commits an act, or is likely to commit an act, in violation of the provisions of Article 60 or Article 101-3 with respect to the author or the performer concerned, or [(b)] the demand provided for in the preceding Article against any person who, intentionally or negligently, commits an act of infringement on the moral rights of author or performers or who has committed an act in violation of the provisions of Article 60 or Article 101-3.
- 機構は、認定の申請をした者が認定を受けないで死亡した場合において、その死亡した者が認定を受けることができる者であるときは、その死亡した者の配偶者(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にあった者を含む。以下同じ。)、子、父母、孫、祖父母若しくは兄弟姉妹であって、その死亡した者の死亡の当時その者と生計を同じくしていたもの又はその死亡した者について葬祭を行う者の申請に基づき、その死亡した者が認定を受けることができる者であった旨の決定を行うものとする。
- In the event that a person who filed an application for certification dies without having received certification despite the fact that he/she could have received certification, the Agency, based on an application from the spouse (which includes a person who did not register the marriage but who maintained a state of quasi-marriage or similar relationship with the deceased person; hereinafter the same shall apply), a child, a parent, a grandchild, a grandparent or a sibling of the deceased person and who shared living expenses with such deceased person when he/she died or who held a funeral for the deceased person, may determine to the effect that the deceased person could have received certification.
- この法律に基づく保険給付を受ける権利を有する者が死亡した場合において、その死亡した者に支給すべき保険給付でまだその者に支給しなかつたものがあるときは、その者の配偶者(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にあつた者を含む。以下同じ。)、子、父母、孫、祖父母又は兄弟姉妹であつて、その者の死亡の当時その者と生計を同じくしていたもの(遺族補償年金については当該遺族補償年金を受けることができる他の遺族、遺族年金については当該遺族年金を受けることができる他の遺族)は、自己の名で、その未支給の保険給付の支給を請求することができる。
- Where a person entitled to the right to receive insurance benefits under this Act has died and any part of the insurance benefits payable to the deceased person remains unpaid to said person, his/her spouse (including a person who has not made a notification of marriage but has been in a de facto marital relationship with the deceased person; the same shall apply hereinafter), children, parents, grandchildren, grandparents or siblings who shared living expenses with the deceased person at the time of his/her death (in the case of the compensation pension for surviving family, other surviving family members eligible to receive said compensation pension for surviving family, and in the case of the pension for surviving family, other surviving family members eligible to receive said pension for surviving family) may claim payment of the unpaid insurance benefits in their own names.
- 従前の届出(この法律の施行の日(以下「施行日」という。)前にこの法律による改正前の国籍法第三条第一項の規定によるものとしてされた同項に規定する父母の婚姻及びその認知により嫡出子たる身分を取得した子に該当しない父又は母が認知した子による日本の国籍の取得に係る届出の行為をいう。以下同じ。)をした者で、当該従前の届出の時においてこの法律による改正後の国籍法(附則第四条第一項において「新法」という。)第三条第一項の規定の適用があるとするならば同項に規定する要件(法務大臣に届け出ることを除く。附則第四条第一項において同じ。)に該当するものであったもの(日本国民であった者を除く。)は、施行日から三年以内に限り、法務大臣に届け出ることによって、日本の国籍を取得することができる。
- A person making a former notification (referring to the act of notification pertaining to acquisition of Japanese nationality by a child acknowledged by a father or mother not falling under children having acquired the status of a child born in wedlock through the marriage of the father and mother and their acknowledgment provided in Article 3, paragraph (1) of the Nationality Act prior to revision by this Act pursuant to the provisions of said paragraph before the day of enforcement of this Act (hereinafter referred to as 'enforcement date'); the same shall apply hereinafter) falling under the requirements (except for notification to the Minister of Justice; the same shall apply in the supplementary provisions, Article 4, paragraph (1)) provided in Article 3, paragraph (1) of the Nationality Act after revision by this Act (referred to as the 'New Act' in the supplemental provisions, Article 4, paragraph (1)), if said paragraph applies (except for a person who was once a Japanese citizen) at the time of said former notification, may acquire Japanese nationality through notification to the Minister of Justice within three years of the enforcement date.
- 国有林野事業を行う国の経営する企業に勤務する職員の給与等に関する特例法(昭和二十九年法律第百四十一号。以下この条において「給特法」という。)の適用を受ける国家公務員(国家公務員法(昭和二十二年法律第百二十号)第八十一条の五第一項に規定する短時間勤務の官職を占める者以外の常時勤務することを要しない国家公務員を除く。以下この条において同じ。)は、給特法第四条に規定する農林水産大臣又は政令の定めるところによりその委任を受けた者(以下「農林水産大臣等」という。)の承認を受けて、当該国家公務員の配偶者、父母、子又は配偶者の父母であって負傷、疾病又は身体上若しくは精神上の障害により第二条第三号の厚生労働省令で定める期間にわたり日常生活を営むのに支障があるもの(以下この条において「要介護家族」という。)の介護をするため、休業をすることができる。
- A national public officer who is subject to the Special Act on Wages, etc. of Personnel Working in National Enterprises Managing National Forest (Act No. 141 of 1954; referred to as "Special Wage Act" hereinafter in this Article) (excluding a national public officer who is not required to work full-time or does not hold an official post with part-time working hours prescribed in Article 81-5 paragraph 1 of the National Public Service Act (Act No. 120 of 1947), the same shall apply in this Article) may, upon obtaining an approval of the Minister of Agriculture, Forestry and Fisheries or a person to whom the Minister, pursuant to the provisions of a Cabinet Order, delegates the authority prescribed in Article 4 of the Special Wage Act (hereinafter referred to as "the Minister of Agriculture, Forestry and Fisheries, etc."), take leave in order to take care of a person who is a spouse, a parent, a child, or a parent of a spouse of said national public officer and who, due to injury, sickness, or physical or mental disability, has difficulty in leading his/her daily life for a period specified by Ordinance of the Ministry of Health, Labour and Welfare provided for in Article 2 item (iii) (referred to as a "Family Member in Care-requiring Condition" hereinafter in this Article).
- 介護休業給付金は、被保険者が、厚生労働省令で定めるところにより、対象家族(当該被保険者の配偶者(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にある者を含む。以下この項において同じ。)、父母及び子(これらの者に準ずる者として厚生労働省令で定めるものを含む。)並びに配偶者の父母をいう。以下この条において同じ。)を介護するための休業をした場合において、当該休業を開始した日前二年間(当該休業を開始した日前二年間に疾病、負傷その他厚生労働省令で定める理由により引き続き三十日以上賃金の支払を受けることができなかつた被保険者については、当該理由により賃金の支払を受けることができなかつた日数を二年に加算した期間(その期間が四年を超えるときは、四年間))に、みなし被保険者期間が通算して十二箇月以上であつたときに、支給単位期間について支給する。
- The family care leave benefits shall be paid for the payment unit period where an insured person has, pursuant to the provisions of an Ordinance of the Ministry of Health, Labour and Welfare, taken leave in order to take care of his/her specified family members (meaning said insured person's spouse (including a person in a relationship with said insured person where a marital relationship is de facto, though a marriage has not been registered; hereinafter the same applies in this paragraph), parents, children (including those specified as such by an Ordinance of the Ministry of Health, Labour and Welfare) and the parents of the insured person's spouse; hereinafter the same applies in this Article), when the period deemed to be the insured period is a total of 12 months or more within the two-year period preceding the day on which said leave was commenced (for an insured person who was continuously unable to receive payment of wages for 30 days or more due to sickness, injury of other reasons specified by an Ordinance of the Ministry of Health, Labour and Welfare during the two-year period preceding the day on which said leave was commenced, the total of the number of days for which payment of wages could not be received due to said reason plus two years (when that period exceeds four years, four years)).
- 附則第四十五条の規定に基づき遺族補償年金を受けることができる遺族の範囲が改定されるまでの間、労働者の夫(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にあつた者を含む。以下次項において同じ。)、父母、祖父母及び兄弟姉妹であつて、労働者の死亡の当時、その収入によつて生計を維持し、かつ、五十五歳以上六十歳未満であつたもの(労働者災害補償保険法第十六条の二第一項第四号に規定する者であつて、同法第十六条の四第一項第六号に該当しないものを除く。)は、同法第十六条の二第一項の規定にかかわらず、同法の規定による遺族補償年金を受けることができる遺族とする。この場合において、同法第十六条の四第二項中「各号の一」とあるのは「各号の一(第六号を除く。)」と、同法別表第一の遺族補償年金の項中「遺族補償年金を受けることができる遺族」とあるのは「遺族補償年金を受けることができる遺族(労働者災害補償保険法の一部を改正する法律(昭和四十年法律第百三十号)附則第四十三条第一項に規定する遺族であつて六十歳未満であるものを除く。)」とする。
- Until the scope of surviving family members eligible to receive a compensation pension for surviving family has been revised under the provision of Article 45 of the Supplementary Provisions, a worker's husband (including a person who has not made a notification of marriage but has been in a de facto marital relationship with the worker; hereinafter the same shall apply in the following paragraph), parents, grandparents and siblings who were dependent on the worker's income at the time of his/her death and were 55 or over or under 60 years of age (excluding those prescribed in Article 16-2, paragraph (1), item (iv) of the Industrial Accident Compensation Insurance Act who do not fall under Article 16-4, paragraph (1), item (vi) of said Act) shall, notwithstanding the provision of Article 16-2, paragraph (1) of said Act, be regarded as surviving family members eligible to receive a compensation pension for surviving family under the provisions of said Act. In this case, the term "any of the items of the preceding paragraph" in Article 16-4, paragraph (2) of said Act shall be deemed to be replaced with "any of the items of the preceding paragraph (excluding item (vi))," and the term "surviving family members eligible to receive a compensation pension for surviving family" in the row concerning a compensation pension for surviving family in Appended Table 1 of said Act shall be deemed to be replaced with "surviving family members eligible to receive a compensation pension for surviving family (excluding surviving family members prescribed in Article 43, paragraph (1) of the Supplementary Provisions of the Act for Partial Revision to the Industrial Accident Compensation Insurance Act (Act No. 130 of 1965) who are under 60 years of age)."
