- Nuclear source material, nuclear fuel material, or material contaminated by such materials shall not be disposed of at sea; provided, however, that this shall not apply to cases that are inevitable for ensuring the safety of human life, vessel, aircraft, or artificial marine structure.

- そのため、汲み取ったし尿は周辺の海域に投棄されることが多かったが、国際条約によってし尿の海洋投棄が禁止されることになり、下水道の整備や浄化槽の設置に対する補助金制度の拡充などの施策が進められている。

- 農林水産大臣は、特定海洋生物資源ごとの動向、特定海洋生物資源に係る漁業の経営その他の事情を勘案して、毎年少なくとも一回、基本計画に検討を加え、必要があると認めるときは、これを変更しなければならない。
- The Minister of Agriculture, Forestry and Fisheries shall examine the Basic Plan, in consideration of the trends in specified living marine resources, the management of fisheries pertaining to the specified living marine resources, and other circumstances at least once a year, and shall change the Basic Plan when he/she finds it necessary.

- 大臣管理量又は大臣管理努力量に係る採捕を行う者は、当該大臣管理量又は大臣管理努力量に係る特定海洋生物資源の保存及び管理に関する協定を締結し、当該協定が適当である旨の農林水産大臣の認定を受けることができる。
- A person who carries out gathering or catching related to quantity control by the Minister or fishing effort control by the Minister may enter into an agreement on the preservation and control of the specified living marine resources those are related to said quantity control by the Minister or fishing effort control by the Minister, and may obtain certification from the Minister of Agriculture, Forestry and Fisheries to the effect that said agreement is appropriate.
- この法律は、海洋法に関する国際連合条約に定める権利を的確に行使することにより海洋生物資源の適切な保存及び管理を図るため、排他的経済水域における漁業等に関する主権的権利の行使等について必要な措置を定めるものとする。

- The State, in order to promote the Ocean Industries and to strengthen the international competitiveness, shall take necessary measures with regard to the Ocean Industries, to promote the cutting-edge research and development, to upgrade the level of technology, to nurture and secure the human resources and to reinforce the management basis with the improvement of competitive conditions and others as well as to exploit new businesses and to execute others.
- 知事管理量又は知事管理努力量に係る採捕を行う者は、当該知事管理量又は知事管理努力量に係る特定海洋生物資源又は指定海洋生物資源の保存及び管理に関する協定を締結し、当該協定が適当である旨の都道府県の知事の認定を受けることができる。

- Governance of the oceans shall be executed comprehensively and integrally with respect to the development, use and conservation of the oceans, in consideration of the fact that the matters with regard to ocean resources, marine environment, maritime traffic and the safety and security of the oceans interrelate closely with each other, and such matters shall be examined as a whole.

- 前項第三号及び第八号に掲げる 事項は、最大持続生産量を実現することができる水準に特定海洋生物資源を維持し又は回復させることを目的として、同項第二号に掲げる事項及び他の海洋生物 資源との関係等を基礎とし、特定海洋生物資源に係る漁業の経営その他の事情を勘案して定めるものとする。
- The matters set forth in items (iii) and (viii) of the preceding paragraph shall be decided based on matters under item (ii) of the same paragraph and the relationship thereof to other living marine resources, etc., for the purpose of maintaining or restoring specified living marine resources levels that allow for maximum sustainable production to be realized, in consideration of fishery management pertaining to the specified living marine resources and other circumstances.
- 前項第二号及び第五号に掲げる 事項は、最大持続生産量を実現することができる水準に指定海洋生物資源を維持し又は回復させることを目的として、同項第一号に掲げる事項及び他の海洋生物 資源との関係等を基礎とし、指定海洋生物資源に係る漁業の経営その他の事情を勘案して定めるものとする。
- The matters under items (ii) and (v) of the preceding paragraph shall be decided based on the matter stated in item (i) of the same paragraph, the relationship thereof to other living marine resources, etc., for the purpose of maintaining or restoring designated living marine resource levels that allow maximum sustainable production to be realized, in consideration of fishery management pertaining to the designated living marine resources and other circumstances.
- 海洋生物資源の保存及び管理に関する法律(平成八年法律第七十七号)第二条第二項に規定する漁獲可能量を定める同条第六項に規定する第一種特定海洋生物資源について第一項の規定による漁獲量の限度の決定を行う場合には、前項に定めるところによるほか、当該漁獲可能量を基礎としなければならない。

- In the case set forth in item (i) or (ii) of the preceding Article, the catch, products made therefrom, ship(s), fishing gear, and any other objects used for gathering or catching the relevant living marine resources that are owned by or in the possession of an offender may be confiscated; provided, however, that if objects owned by the offender cannot be confiscated in whole or in part, their equivalent value may be collected.
- この法律において「漁獲努力可 能量」とは、排他的経済水域等において、海洋生物資源の種類ごとにその対象となる採捕の種類並びに当該採捕の種類に係る海域及び期間を定めて漁獲努力量に よる管理を行う場合の海洋生物資源の種類ごとの当該採捕の種類に係る年間の漁獲努力量の合計の最高限度をいう。
- In this Act, the 'total allowable effort' shall mean the maximum limit of the total annual fishing effort in the Exclusive Economic Eone, etc. for each type of living marine resources and for the mode of gathering or catching to which each such type is subject, and in the cases where each type of living marine resources are controlled based on the fishing effort within designated areas of the sea or designated periods of time in relation to a mode of gathering or catching, this shall mean the maximum limit of the total annual fishing effort for each such mode of gathering or catching each type of living marine resources, etc.
- 国際的な視点で見ても、森林の減少や劣化、乱獲による海洋生物資源の減少など生物の多様性は大きく損なわれている。我が国の経済社会が、国際的に密接な相互依存関係の中で営まれていることにかんがみれば、生物の多様性を確保するために、我が国が国際社会において先導的な役割を担うことが重要である。
- Seen from a global standpoint, biodiversity has been significantly damaged, including decrease and deterioration in forests and decrease in marine biological resources due to overexploitation. Taking into consideration that the Japanese economy and society are carried on in a close mutual dependence relation with other countries, it is important for Japan to play a leading role in the international community to ensure biodiversity.
- 前項の規定による漁獲量の限度の決定は、政令で定めるところにより、排他的経済水域における科学的根拠を有する海洋生物資源の動向及び我が国漁業者の漁獲の実情を基礎とし、排他的経済水域における外国人による漁業の状況、外国周辺水域における我が国漁業の状況等を総合的に考慮して行われなければならない。
- The limit for the quantity of fish catches pursuant to the provision set forth in the preceding paragraph shall be decided, as provided for in a Cabinet Order, on the basis of trends, having scientific grounds, regarding living marine resources and the actual situation of fish catches by Japan's fishery operators in the Exclusive Economic Zone, taking the situation of the Fishery by the Foreign Nationals in the Exclusive Economic Zone and Japan's Fishery in the surrounding waters of foreign states or others comprehensively into consideration.
- 水産物の供給に当たっては、水産資源が生態系の構成要素であり、限りあるものであることにかんがみ、その持続的な利用を確保するため、海洋法に関する国際連合条約の的確な実施を旨として水産資源の適切な保存及び管理が行われるとともに、環境との調和に配慮しつつ、水産動植物の増殖及び養殖が推進されなければならない。
- Propagation and aquaculture of aquatic plants and animals shall, in view of fishery resources being a component of ecosystem and limited, be promoted to secure its sustainable utilization by adequate preservation and management of fishery resources and harmony with the environment aiming at the correct implementation of United Nations Convention on the Act of the Sea.
- 国は、国民が海洋についての理解と関心を深めることができるよう、学校教育及び社会教育における海洋に関する教育の推進、海洋法に関する国際連合条約その他の国際約束並びに海洋の持続可能な開発及び利用を実現するための国際的な取組に関する普及啓発、海洋に関するレクリエーションの普及等のために必要な措置を講ずるものとする。
- The State shall take necessary measures, in order that citizens shall have a better understanding of and deeper interests in the oceans, to promote school education and social education with regard to the oceans, propagation and enlightenment of the United Nations Convention on the Law of the Sea and other international agreements as well as international efforts to realize the sustainable development and use of the oceans, and popularization of ocean recreation.
- 国は、海に囲まれ、かつ、主要な資源の大部分を輸入に依存する我が国の経済社会にとって、海洋資源の開発及び利用、海上輸送等の安全が確保され、並びに海洋における秩序が維持されることが不可欠であることにかんがみ、海洋について、我が国の平和及び安全の確保並びに海上の安全及び治安の確保のために必要な措置を講ずるものとする。
- The State, in consideration of the fact that, for the economy and society of our State, surrounded by the oceans and dependent on import for major portion of the resources, it is essential to secure the development and use of the marine resources, the safety of the maritime transport and others as well as to maintain the order in the oceans, with regard to the oceans, shall take necessary measures to secure the peace and safety of our State as well as to secure the maritime safety and public order.
- 港長は、海難の発生その他の事情により特定港内において引火性の液体が浮流している場合において、火災の発生のおそれがあると認めるときは、当該水域にある者に対し、喫煙又は火気の取扱いを制限し、又は禁止することができる。ただし、海洋汚染等及び海上災害の防止に関する法律第四十二条の五第一項の規定の適用がある場合は、この限りでない。
- When flammable liquid is floating in the Specified Port by reason of an occurrence of a marine accident or other circumstances and that the Captain of the port finds that a fire could occur, it may restrict or prohibit person in such water area to smoke or treat a fire; provided, however, that this shall not apply in the event that the provision of paragraph 1 of Article 42-5 of the Act Pertaining to the Prevention of Marine Pollution and Maritime Disaster applies.
- 第一項の海域及び海洋生物資源 を定める都道府県の条例は、都道府県が当該都道府県の地先水面(排他的経済水域等に限る。第十七条第三項において同じ。)の全部又は一部の海域において都 道府県漁獲限度量又は都道府県漁獲努力限度量を決定すること等により特定の海洋生物資源の保存及び管理を行う必要があると認める場合に定めることができ る。
- Prefectural Ordinance for designating the area of the sea and living marine resources under paragraph (1) may be established in the event that the prefecture finds it necessary to preserve and control specific living marine resources by deciding the prefectural catch limits or prefectural fishing effort limits in the whole or part of those areas of the sea (limited to the Exclusive Economic Zone, etc.; the same shall apply in paragraph (3) of Article 17) that border said prefecture.
- 都道府県の知事は、前項の場合 を除くほか、指定海洋生物資源(次条第一項の第一種指定海洋生物資源及び第二種指定海洋生物資源をいう。以下同じ。)の動向、特定海洋生物資源又は指定海 洋生物資源に係る漁業の経営その他の事情を勘案して、毎年少なくとも一回、都道府県計画に検討を加え、必要があると認めるときは、これを変更しなければな らない。
- In addition to the case referred to in the preceding paragraph, the governor of each prefecture shall examine the Prefectural Plan, in consideration of trends in designated living marine resources (referring to the Class I designated living marine resources and Class II designated living marine resources under paragraph (1) of the following Article; hereinafter the same shall apply), the management of fisheries pertaining to the specified living marine resources or designated living marine resources, and other circumstances at least once a year, and shall change it when he/she finds it necessary.
- 国は、離島が我が国の領海及び排他的経済水域等の保全、海上交通の安全の確保、海洋資源の開発及び利用、海洋環境の保全等に重要な役割を担っていることにかんがみ、離島に関し、海岸等の保全、海上交通の安全の確保並びに海洋資源の開発及び利用のための施設の整備、周辺の海域の自然環境の保全、住民の生活基盤の整備その他の必要な措置を講ずるものとする。
- The State, with regard to the remote islands, shall take necessary measures including conserving the seacoasts and others, securing the safety of navigation as well as establishing the facilities for the development and use of ocean resources, conserving natural environment in adjacent sea areas, maintaining infrastructure for the life of inhabitant and executing others, in consideration of such fact that the remote islands bear an important role in conserving our territorial sea and the Exclusive Economic Zone and other areas, and in securing the safety of navigation in the development and use of ocean resources as well as in conservation of the marine environment.
- 水産政策審議会は、この法律の規定によりその権限に属させられた事項を 処理するために必要があると認めるときは、特定海洋生物資源の採捕を行う指定漁業等を営む者その他関係者に対し出頭を求め、若しくは必要な事項に関し報告 を求め、又はその委員若しくはその事務に従事する者に漁場、船舶、事業場若しくは事務所について所要の調査をさせることができる。
- The Fisheries Policy Council may ask a person who operates a designated fishery, etc. and who gathers or catches specified living marine resources or any other relevant person to appear before the council or to report to it on any necessary matters, or may have a member of the council or a person engaged in the affairs of the council carry out the necessary examination of a fishing area, ship, workplace, or office, if the council finds it necessary for dealing with any matter over which it holds authority pursuant to the provisions of this Act.
- 国は、海洋が地球温暖化の防止等の地球環境の保全に大きな影響を与えること等にかんがみ、生育環境の保全及び改善等による海洋の生物の多様性の確保、海洋に流入する水による汚濁の負荷の低減、海洋への廃棄物の排出の防止、船舶の事故等により流出した油等の迅速な防除、海洋の自然景観の保全その他の海洋環境の保全を図るために必要な措置を講ずるものとする。
- The State shall take necessary measures to conserve the marine environment including securing the biodiversity in the oceans with conservation and improvement of the habitat, reduction of the pollution load caused by water flow into the oceans, prevention of the discharge of waste materials to the oceans, prompt prevention of the oil spill caused by accidents of the vessels and others, conservation of the seascape and others, in consideration of the fact that the oceans make a great impact on the conservation of the global environment such as the prevention of global warming and others.
- 第三条から前条までの規定は、大陸棚(排他的経済水域及び大陸棚に関する法律第二条に規定する区域をいう。)であって排他的経済水域でない区域の定着性種族(海洋法に関する国際連合条約第七十七条4に規定する定着性の種族に属する生物をいう。次項において同じ。)に係る漁業、水産動植物の採捕及び探査について準用する。この場合において、必要な技術的読替えは、政令で定める。
- The provisions of Article 3 through to the preceding Article shall apply mutatis mutandis to the Fishery, the harvest of aquatic animals and plants and the Survey pertaining to fixative species (which means living creatures belonging to the fixative species set forth in 4 of Article 77 of the United Nations Convention on the Law of the Sea; the same shall apply in the following paragraph) in the area which is on the continental shelf (which means the area set forth in Article 2 of the Act on the Exclusive Economic Zone and Continental Shelf) but not in the Exclusive Economic Zone. In this case, any necessary technical replacement shall be provided for in a Cabinet Order.

- The dock allows colonists to produce fish on ocean tiles adjacent to the colony. As soon as the population is at least 4, it can be upgraded to a drydock, which allows the colony to repair damaged ships. When the colony's population reaches 8, it can be further upgraded to a shipyard, which enables the colony to build new ships.Building a dock allows fishing.
- 国は、海洋環境の保全並びに海洋資源の将来にわたる持続的な開発及び利用を可能とすることに配慮しつつ海洋資源の積極的な開発及び利用を推進するため、水産資源の保存及び管理、水産動植物の生育環境の保全及び改善、漁場の生産力の増進、海底又はその下に存在する石油、可燃性天然ガス、マンガン鉱、コバルト鉱等の鉱物資源の開発及び利用の推進並びにそのための体制の整備その他の必要な措置を講ずるものとする。
- The State shall take necessary measures on conservation and management of living aquatic resources, conservation and improvement of the growing environment for aquatic plants and animals, increase of the fishing ground productivity, promotion of the development and use of petroleum, inflammable natural gas, other mineral resource including manganese ores, cobalt ores existing on and under the sea floor, establishment of the system for the above mentioned missions and execution of others, in order to promote the positive development and use of the oceans, considering conservation of the marine environment and to allow for the sustainable development and use of the ocean resources in the future.
- 港長は、海難の発生その他の事情により特定港内において船舶交通の危険が生じ、又は船舶交通の混雑が生ずるおそれがある場合において、当該水域における危険を防止し、又は混雑を緩和するため必要があると認めるときは、必要な限度において、当該水域に進行してくる船舶の航行を制限し、又は禁止することができる。ただし、海洋汚染等及び海上災害の防止に関する法律第四十二条の八の規定の適用がある場合は、この限りでない。
- When a peril of marine traffic arises, or marine traffic could be congested, in the Specified Port by reason of an occurrence of a marine accident or other circumstances and that the Captain of the port finds necessary to prevent the peril, or relieve the congestion, in such water area, it may restrict or prohibit the navigation of vessels entering into such water area to the necessary limit; provided, however, that this shall not apply in the event that the provision of Article 42-8 of the Act Relating to the Prevention of Marine Pollution and Maritime Disaster applies.
- 指定漁業等を営む者及び第三 条第二項第六号の政令で定める者以外の者であって都道府県の規則で定めるものは、当該都道府県の地先水面において第一種特定海洋生物資源を採捕したとき、 又は当該都道府県の指定海域において当該都道府県の第一種指定海洋生物資源を採捕したときは、都道府県の規則で定めるところにより、採捕の数量その他採捕 の状況に関し農林水産省令で定める事項を当該都道府県の知事に報告しなければならない。
- When any person who is provided for in a Prefectural Regulation of the relevant prefecture and who is other than a person operating a designated fishery, etc. or a person as provided by Cabinet Order under item (vi) of paragraph (2) of Article 3 has gathered or caught Class I specified living marine resources in the sea bordering said prefecture, or has gathered or caught any of said prefecture's Class I designated living marine resources in that prefecture's designated area of the sea, he/she shall report the matters provided by Ordinance of the Ministry of Agriculture, Forestry and Fisheries concerning the gathered or caught quantity and any other gathering or catching status to the governor of the relevant prefecture, as provided in the Prefectural Regulations.
- 海洋については、海洋の開発及び利用が我が国の経済社会の存立の基盤であるとともに、海洋の生物の多様性が確保されることその他の良好な海洋環境が保全されることが人類の存続の基盤であり、かつ、豊かで潤いのある国民生活に不可欠であることにかんがみ、将来にわたり海洋の恵沢を享受できるよう、海洋環境の保全を図りつつ海洋の持続的な開発及び利用を可能とすることを旨として、その積極的な開発及び利用が行われなければならない。
- With regard to the oceans, in consideration of the fact that the development and use of the oceans are the basis of existence for the economy and society of our State, and that securing the marine biological diversity and conserving other better marine environment are the basis of the existence of mankind and also indispensable for prosperous and affluent lives of the citizenry, the positive development and use of the oceans shall be executed, aiming at allowing for the sustainable development and use of the oceans with conservation of marine environment in order to enjoy the benefit of the oceans in the future.
- 第二条第一項の規定の適用については、当分の間、同項中「我が国の排 他的経済水域」とあるのは「我が国の排他的経済水域(排他的経済水域及び大陸棚に関する法律(平成八年法律第七十四号)第四条の条約の規定により我が国が 海洋生物資源の採捕に関する主権的権利を行使する水域の範囲について調整が行われるときは、その調整後の水域とする。)」と、「排他的経済水域及び大陸棚 に関する法律(平成八年法律第七十四号)」とあるのは「同法」とする。
- With regard to application of the provisions of paragraph (1) of Article 2, until otherwise stipulated, 'The Exclusive Economic Zone of Japan' shall be deemed to be replaced with 'The Exclusive Economic Zone of Japan (when an adjustment of the scope of waters in which Japan may exercise its sovereign right to gather and catch living marine resources pursuant to the treaty under Article 4 of the Act on The Exclusive Economic Zone and the Continental Shelf (Act No. 74 of 1996) takes place, such waters),' and 'the Act on the Exclusive Economic Zone and the Continental Shelf (Act No. 74 of 1996)' shall be deemed to be replaced with 'the same Act.'
- 前条の規定により読み替 えて適用される第二条第一項に規定する調整が行われる場合における同項に規定する主権的権利に関する排他的経済水域及び大陸棚に関する法律第三条の規定の 適用については、同条第一項第一号中「排他的経済水域」とあるのは、「排他的経済水域(海洋生物資源の保存及び管理に関する法律(平成八年法律第七十七 号)附則第一条の二の規定により読み替えて適用される同法第二条第一項の排他的経済水域をいう。以下この条において同じ。)」とする。
- With regard to the application of the provisions of Article 3 of the Act on the Exclusive Economic Zone and the Continental Shelf concerning the sovereign right as provided in paragraph (1) of Article 2 as applied mutatis mutandis pursuant to the provisions of the preceding Article, in the case where the adjustment provided in the same paragraph has taken place, 'The Exclusive Economic Zone' under item (i) of paragraph (1) of the same Article shall be deemed to be replaced with 'The Exclusive Economic Zone (The Exclusive Economic Zone under paragraph (1) of Article 2 of the Act on the Preservation and Control of Living Marine Resources (Act No. 77 of 1996) as applied mutatis mutandis pursuant to the provisions of Article 1-2 of the Supplementary Provisions of the same Act; hereinafter the same shall apply in this Article).'
- 農林水産大臣は特定海洋生物資源の採捕を行う指定漁業等を営む者その他 の関係者に対し、都道府県の知事は特定海洋生物資源又は当該都道府県の指定海洋生物資源の採捕を行う知事許可漁業を営む者その他の関係者に対し、この法律 の施行に必要な限度において、採捕の状況その他の必要な事項に関し報告を求め、又はその職員に、これらの者の漁場、船舶、事業場、事務所若しくは倉庫に立 ち入り、業務の状況若しくは漁獲物、帳簿、書類その他の物件を検査させることができる。
- The Minister of Agriculture, Forestry and Fisheries may ask any person who operates a designated fishery, etc. and who gathers or catches specified living marine resources or any other relevant person to report on his/her gathering or catching status and on any other necessary matters, and the governor of a prefecture may ask any person who operates a fishery permitted by the governor and who gathers or catches specified living marine resources or any designated living marine resource of said prefecture or any other relevant person to report on his/her gathering or catching status and on any other necessary matters, and the Minister or the governor may have any of his/her employees enter the fishing area, ship, workplace, office, or warehouse of any of such persons, for inspecting the status of business or the catch, books, documents, or other articles thereof to the extent necessary for the enforcement of this Act.
- 認定協定に参加している者は、その数が認定協定の対象となる海域におい て認定協定の対象となる特定海洋生物資源又は指定海洋生物資源について認定協定の対象となる種類の採捕を行う者のすべての数の三分の二以上であって農林水 産省令で定める割合を超えていることその他の農林水産省令で定める基準に該当するときは、農林水産省令で定めるところにより、農林水産大臣又は都道府県の 知事に対し、認定協定の目的を達成するために必要な措置を講ずべきことを求めることができる。
- If the number of persons participating in a certified agreement is not less than two thirds of all the persons who carry out the gathering or catching of the specified living marine resources or designated living marine resources subject to the certified agreement by the mode of gathering or catching mode and in the area of the sea subject to said certified agreement, and if such number of all such persons exceed the rate prescribed by Ordinance of the Ministry of Agriculture, Forestry and Fisheries and also conforms to other standards prescribed by Ordinances of the Ministry of Agriculture, Forestry and Fisheries, the participants may request that the Minister of Agriculture, Forestry and Fisheries or the governor of the relevant prefecture take the measures necessary for the achievement of the purpose of the certified agreement, as provided by Ordinance of the Ministry of Agriculture, Forestry and Fisheries.
- 前項において「海洋投棄」とは、船舶、航空機若しくは人工海洋構築物から海洋に物を廃棄すること又は船舶若しくは人工海洋構築物において廃棄する目的で物を燃焼させることをいう。ただし、船舶、航空機若しくは人工海洋構築物から海洋に当該船舶、航空機若しくは人工海洋構築物及びこれらの設備の運用に伴つて生ずる物を廃棄すること又は船舶若しくは人工海洋構築物において廃棄する目的で当該船舶若しくは人工海洋構築物及びこれらの設備の運用に伴つて生ずる物を燃焼させることを除く。
- The term 'disposal at sea' as used in the preceding paragraph shall mean the disposal of material from a vessel, aircraft, or artificial marine structure into the sea, or the combustion of material on a vessel or artificial marine structure for the purpose of disposing of the material; provided, however, that this shall not apply to disposal of material from a vessel, aircraft or artificial marine structure that is generated from the operation of said vessel, aircraft, artificial marine structure or any equipment installed on such facilities into the sea, or to combustion of material on a vessel or artificial marine structure that is generated from the operation of said vessel, artificial marine structure or any equipment installed on such facilities with the purpose of disposing of the material.
- この法律は、我が国の排他的経済水域等における海洋生物資源について、そ の保存及び管理のための計画を策定し、並びに漁獲量及び漁獲努力量の管理のための所要の措置を講ずることにより、漁業法(昭和二十四年法律第二百六十七 号)又は水産資源保護法(昭和二十六年法律第三百十三号)による措置等と相まって、排他的経済水域等における海洋生物資源の保存及び管理を図り、あわせて 海洋法に関する国際連合条約の的確な実施を確保し、もって漁業の発展と水産物の供給の安定に資することを目的とする。
- The purpose of this Act shall be to preserve and control the living marine resources in Japan's exclusive economic zone, etc. in coordination with the measures, etc. taken under the Fishery Act (Act No. 267 of 1949) and the Marine Resources Protection Act (Act No. 313 of 1951), as well as to ensure the appropriate implementation of the United Nations Convention on the Law of the Sea, for thereby contributing to the development of fisheries and the stable supply of aquatic products, by establishing a plan for the preservation and control of living marine resources in Japan's Exclusive Economic Zone, etc. and by taking the required measures to control the fish catch and the fishing effort.
- 農林水産大臣は、大臣管理量の対象となる採捕の数量が当該大臣管理量を超 えており、若しくは超えるおそれが著しく大きいと認めるとき、又は大臣管理努力量の対象となる漁獲努力量が当該大臣管理努力量を超えており、若しくは超え るおそれが著しく大きいと認めるときは、農林水産省令で、期間を定め、当該大臣管理量又は大臣管理努力量に係る採捕を行う者に対し、当該大臣管理量又は大 臣管理努力量に係る特定海洋生物資源をとることを目的とする採捕の停止その他当該特定海洋生物資源の採捕に関し必要な命令をすることができる。
- If the Minister of Agriculture, Forestry and Fisheries finds that the quantity of gathering or catching subject to quantity control by the Minister has exceeded or is very likely to exceed the quantity control set by the Minister or that the fishing effort subject to fishing effort control by the Minister has exceeded or is very likely to exceed the fishing effort control set by the Minister, he/she may issue any necessary order to the persons carrying out the gathering or catching related to said quantity control by the Minister or fishing effort control by the Minister, concerning the suspension of the gathering or catching being carried out for the purpose of taking the specified living marine resources related to said quantity control by the Minister or fishing effort control by the Minister and on other matters on the gathering or catching of said specified living marine resources, for a period prescribed by Ordinance of the Ministry of Agriculture, Forestry and Fisheries.
- 国は、海洋に関する科学技術(以下「海洋科学技術」という。)に関する研究開発の推進及びその成果の普及を図るため、海洋科学技術に関し、研究体制の整備、研究開発の推進、研究者及び技術者の育成、国、独立行政法人(独立行政法人通則法(平成十一年法律第百三号)第二条第一項に規定する独立行政法人をいう。以下同じ。)、都道府県及び地方独立行政法人(地方独立行政法人法(平成十五年法律第百十八号)第二条第一項に規定する地方独立行政法人をいう。以下同じ。)の試験研究機関、大学、民間等の連携の強化その他の必要な措置を講ずるものとする。
- The State, in order to promote the research and development and to disseminate the result with regard to the science and technology of the oceans (hereinafter referred to as 'Ocean Science and Technology'), shall take necessary measures including establishing the research systems, promoting research and development, nurturing researchers and technicians, strengthening coordination among such research institutions as the State, Incorporated Administrative Agency (referring to the Incorporated Administrative Agency set forth in the Act on General Rules for Incorporated Administrative Agency (Act No.103 of 1999), Article 2, paragraph (1); the same shall apply hereinafter), the prefecture, and Local Incorporated Administrative Agency (referring to the Local Incorporated Administrative Agency set forth in the Act on Local Incorporated Administrative Agency (Act No.118 of 2003), Article 2, paragraph (1); the same shall apply hereinafter), universities and private bodies, and executing others.
- 廃棄物埋立護岸、海洋性廃棄物処理施設(船舶若しくは海洋汚染等及び海上災害の防止に関する法律(昭和四十五年法律第百三十六号)第三条第十号に規定する海洋施設において生じた廃棄物(同法第四十四条に規定する廃有害液体物質等を含む。)又は第二号に掲げる業務の実施その他海洋における汚染の防除により収集された廃棄物の処理のための施設で廃棄物埋立護岸以外のものをいう。以下同じ。)、廃油処理施設(同法第三条第十四号に規定する廃油処理施設をいう。)及び排出ガス処理施設(同法第四十四条に規定する排出ガス処理施設をいう。)を管理運営すること。
- of the Act on Prevention of Marine Pollution and Maritime Disaster (Act No. 136 of 1970) (including toxic liquid waste provided by Article 44 of the same Act) or waste materials generated as a result of the works as listed in item (ii) or the measures taken for the prevention of marine pollution other than dikes for waste disposal areas; the same shall apply hereinafter), waste oil disposal facilities (meaning those set forth in Article 3, item (xiv) of the same Act) and emission treatment facilities (meaning those provided for Article 44 of the same Act)
- 第十三条第一項又は第二項の認定を受けた協定(以下「認定協定」とい う。)に参加している者は、認定協定の対象となる海域において認定協定の対象となる種類の特定海洋生物資源又は指定海洋生物資源について認定協定の対象と なる種類の採捕を行う者であって認定協定に参加していないものに対し認定協定を示して参加を求めた場合においてその参加を承諾しない者があるときは、農林 水産省令で定めるところにより、同条第一項又は第二項の認定をした農林水産大臣又は都道府県の知事に対し、その者の承諾を得るために必要なあっせんをすべ きことを求めることができる。
- In the case where a person participating in an agreement that has been certified pursuant to paragraph (1) or (2) of Article 13 (hereinafter referred to as a 'certified agreement') shows the certified agreement to a person who is not a participant thereto but who carries out the gathering or catching of the types of specified living marine resources or designated living marine resources subject to the certified agreement by the modes of gathering or catching and in the areas of the sea subject to the certified agreement and asks the non-participant to participate in the certified agreement, if the non-participant does not agree to participate, the participant to the certified agreement may request that the Minister of Agriculture, Forestry and Fisheries or the governor of the relevant prefecture who has given certification pursuant to paragraph (1) or (2) of the Article 13 make the necessary arrangements for obtaining the consent of the non-participant, as provided by Ordinance of the Ministry of Agriculture, Forestry and Fisheries.
- 都道府県の知事は、第一種特定 海洋生物資源知事管理量若しくは第一種指定海洋生物資源知事管理量(以下「知事管理量」と総称する。)の対象となる採捕の数量が当該知事管理量を超えるお それがあると認めるとき、又は第二種特定海洋生物資源知事管理努力量若しくは第二種指定海洋生物資源知事管理努力量(以下「知事管理努力量」と総称す る。)の対象となる漁獲努力量若しくは都道府県漁獲努力量が当該知事管理努力量を超えるおそれがあると認めるときは、当該採捕の数量又は漁獲努力量若しく は都道府県漁獲努力量その他農林水産省令で定める事項を公表するものとする。
- If the governor of any prefecture finds that quantity control of Class I designated living marine resources set by the governor, or an amount of gathering or catching subject to quantity control of Class I specified living marine resources by the governor (hereinafter generally referred to as 'quantity control by the governor') is likely to exceed the quantity control set by the governor, or that fishing effort control set by the governor for Class II designated living marine resources or fishing effort or prefectural fishing effort subject to fishing effort control by the governor for Class II specified living marine resources (hereinafter generally referred to as 'fishing effort control by the governor') is likely to exceed the fishing effort control set by the governor, he/she shall make public the amount of said gathering, catching, fishing effort, or prefectural fishing effort and other matters provided by Ordinance of Ministry of Agriculture, Forestry and Fisheries.
- 審議会は、前二項に規定するもののほか、漁業法(昭和二十四年法律第二百六十七号)、漁港漁場整備法(昭和二十五年法律第百三十七号)、漁船法(昭和二十五年法律第百七十八号)、水産資源保護法(昭和二十六年法律第三百十三号)、海洋水産資源開発促進法(昭和四十六年法律第六十号)、沿岸漁場整備開発法(昭和四十九年法律第四十九号)、漁業経営の改善及び再建整備に関する特別措置法(昭和五十一年法律第四十三号)、海洋生物資源の保存及び管理に関する法律(平成八年法律第七十七号)及び持続的養殖生産確保法(平成十一年法律第五十一号)の規定によりその権限に属させられた事項を処理する。
- The Council shall, in addition to the matters provided in the preceding two paragraphs, deal with the matters authorized under The Fishery Act (Act No. 267 of 1949), Fishing Port and Ground Improvement Act (Act No. 137 of 1950), Fishing Vessel Act (Act No. 178 of 1950), Act on the Protection of Fishery Resources (Act No. 313 of 1951), Marine Resources Development Promotion Act (Act No. 60 of 1971), Coastal Fisheries Grounds Enhancement and Development Program Act (Act No.49 of 1974), Special Measures Act for Improvement and Reconstruction of Fisheries Management (Act No. 43 of 1976), Act Concerning Conservation and Management of Marine Life Resources (Act No. 77 of 1996), and Act on Maintenance of Sustainable Aquaculture Production (Act No. 51 of 1999).
- 都道府県の知事は、知事管理 量の対象となる採捕の数量が当該知事管理量を超えており、若しくは超えるおそれが著しく大きいと認めるとき、又は知事管理努力量の対象となる漁獲努力量若 しくは都道府県漁獲努力量が当該知事管理努力量を超えており、若しくは超えるおそれが著しく大きいと認めるときは、都道府県の規則で、期間を定め、当該知 事管理量又は知事管理努力量に係る採捕を行う者に対し、当該知事管理量又は知事管理努力量に係る特定海洋生物資源又は指定海洋生物資源をとることを目的と する採捕の停止その他当該特定海洋生物資源又は指定海洋生物資源の採捕に関し必要な命令をすることができる。
- If the governor of any prefecture finds that the amount of gathering or catching subject to quantity control by the governor has exceeded or is very likely to exceed said quantity control set by the governor or that the fishing effort subject to fishing effort control by the governor has exceeded or is very likely to exceed said fishing effort control set by the governor, he/she may issue any necessary order to the persons carrying out the gathering or catching pertaining to said quantity control by the governor or fishing effort control by the governor, concerning the suspension of the gathering or catching being carried out for the purpose of taking the designated living marine resources pertaining to said quantity control by the governor or fishing effort control by the governor, and on other matters on the gathering or catching of said designated living marine resources, for a period prescribed by the relevant prefecture's Prefectural Regulation.
- 港内又は港の境界付近において発生した海難により他の船舶交通を阻害する状態が生じたときは、当該海難に係る船舶の船長は、遅滞なく標識の設定その他危険予防のため必要な措置をし、かつ、その旨を、特定港にあつては港長に、特定港以外の港にあつては最寄りの管区海上保安本部の事務所の長又は港長に報告しなければならない。ただし、海洋汚染等及び海上災害の防止に関する法律(昭和四十五年法律第百三十六号)第三十八条第一項、第二項若しくは第五項、第四十二条の二第一項、第四十二条の三第一項又は第四十二条の四の二第一項の規定による通報をしたときは、当該通報をした事項については報告をすることを要しない。
- When a situation arises in which the traffic of other vessels is impeded by a marine accident occurring in a port or in the vicinity of the boundary of the port, masters of vessels involved in such marine accident shall take necessary measures to prevent perils without delay such as the establishment of signs or others and shall report to the Captain of the port in case of the Specified Port, or to the head of the office of the nearest regional coast guard headquarters or the Captain of the port in case of ports other than the Specified Port; provided, however, that in the event that they notify pursuant to the provision of paragraph 1, 2 or 5 of Article 38, paragraph 1 of Article 42-2, paragraph 1 of Article 42-3 or paragraph 1 of Article 42-4-2 of the Act Pertaining to the Prevention of Marine Pollution and Maritime Disaster (Act No. 136 of 1970), they need not report matters so notified.
- この法律は、武力攻撃事態(武力攻撃事態等における我が国の平和と独立並びに国及び国民の安全の確保に関する法律(平成十五年法律第七十九号)第二条第二号に規定する武力攻撃事態をいう。以下同じ。)に際して、我が国領海又は我が国周辺の公海(海洋法に関する国際連合条約に規定する排他的経済水域を含む。以下同じ。)における外国軍用品等の海上輸送を規制するため、自衛隊法(昭和二十九年法律第百六十五号)第七十六条第一項の規定により出動を命ぜられた海上自衛隊の部隊が実施する停船検査及び回航措置の手続並びに防衛省に設置する外国軍用品審判所における審判の手続等を定め、もって我が国の平和と独立並びに国及び国民の安全の確保に資することを目的とする。
- The purpose of this Act is to set forth the procedures of a stopped ship inspection and taking ship measure implemented by units of the Maritime Self-Defense Force called out pursuant to the provisions of Article 76, paragraph (1) of the Self-Defense Forces Act (Act No. 165 of 1954), and the procedures, etc. of the hearing at the Foreign Military Supply Tribunal to be established in the Ministry of Defense in order to restrict the maritime transportation of foreign military supplies, etc. in our territorial seas and the high seas surrounding Japan (including the Exclusive Economic Zone prescribed in the United Nations Convention on the Law of the Sea; the same shall apply hereinafter) in armed attack situations (which means the armed attack situation prescribed in Article 2, paragraph 2 of the Act on Ensuring Peace and Independence of Japan and Security of the State and People in Armed Attack Situations, etc. (Act No. 79 of 2003); the same shall apply hereinafter), and thereby ensuring the peace and independence of Japan and security of the state and the people.
- こ の法律は、地球の広範な部分を占める海洋が人類をはじめとする生物の生命を維持する上で不可欠な要素であるとともに、海に囲まれた我が国において、海洋法 に関する国際連合条約その他の国際約束に基づき、並びに海洋の持続可能な開発及び利用を実現するための国際的な取組の中で、我が国が国際的協調の下に、海 洋の平和的かつ積極的な開発及び利用と海洋環境の保全との調和を図る新たな海洋立国を実現することが重要であることにかんがみ、海洋に関し、基本理念を定 め、国、地方公共団体、事業者及び国民の責務を明らかにし、並びに海洋に関する基本的な計画の策定その他海洋に関する施策の基本となる事項を定めるととも に、総合海洋政策本部を設置することにより、海洋に関する施策を総合的かつ計画的に推進し、もって我が国の経済社会の健全な発展及び国民生活の安定向上を 図るとともに、海洋と人類の共生に貢献することを目的とする。
- The purpose of this Act is, with regard to the oceans, to stipulate the basic principles, to clarify the responsibilities of the State, the local governments, business operators and the citizens as well as to formulate the basic plan with regard to the oceans and other basic matters with regard to the measures on the oceans, by establishing the Headquarters for Ocean Policy in order to promote measures with regard to the oceans comprehensively and systematically, through contributing to the sound development of the economy and society of our State and to improve the stability of the lives of citizenry as well as to contribute to the coexistence of the oceans and mankind, in consideration of the fact that the oceans, occupying broad portion of the globe, is an indispensable factor for maintaining the lives of the living beings including mankind, and the fact that it is important to realize a new oceanic State in harmonization of the peaceful and positive development and use of the oceans with the conservation of the marine environment, under the international cooperation, as our State surrounded by the oceans, based on the United Nations Convention on the Law of the Sea and other international agreements as well as on the international efforts on the realization of the sustainable development and use of the oceans.
- 都道府県の知事は、特定海洋生物資源でない海洋生物資源のうち、都道府県 の条例で定める海域(以下「指定海域」という。)において、都道府県漁獲限度量(指定海域において、指定漁業等を営む者及び第三条第二項第六号の政令で定 める者以外の者が採捕することができる海洋生物資源の種類ごとの年間の数量の最高限度をいう。以下同じ。)を決定すること等により保存及び管理を行う海洋 生物資源として都道府県の条例で定める海洋生物資源(以下「第一種指定海洋生物資源」という。)又は都道府県漁獲努力限度量(指定海域において、海洋生物 資源の種類ごとにその対象となる採捕の種類並びに当該採捕の種類に係る海域及び期間を定めて都道府県漁獲努力量(海洋生物資源を採捕するために行われる漁 ろう作業(指定漁業等を営む者に係るものを除く。)の量であって、採捕の種類別に操業日数その他の都道府県の規則で定める指標によって示されるものをい う。以下同じ。)による管理を行う場合の海洋生物資源の種類ごとの当該採捕の種類に係る年間の都道府県漁獲努力量の合計の最高限度をいう。以下同じ。)を 決定すること等により保存及び管理を行う海洋生物資源として都道府県の条例で定める海洋生物資源(以下「第二種指定海洋生物資源」という。)について、都 道府県計画において、次に掲げる事項を定めるものとする。
- Among living marine resources other than specified living marine resources, the governor of each prefecture may designate, etc. living marine resources by Prefectural Ordinance as living marine resources to be preserved and controlled in the area of the sea designated by Prefectural Ordinance (hereinafter referred to as 'the designated area of the sea') by deciding the prefectural catch limit (meaning the maximum annual limit for gathering or catching each type of living marine resources in the designated area of the sea by persons other than those operating a designated fishery, etc. and those provided by Cabinet Order set forth in item (vi) of paragraph (2) of Article 3; hereinafter the same shall apply) (hereinafter referred to as 'Class I designated living marine resources') or may designate, etc. living marine resources by Prefectural Ordinance as living marine resources to be preserved and controlled, by deciding the prefectural limit for fishing effort (meaning the maximum limit of the total annual fishing effort for the prefecture (the amount of fishing work (excluding work by persons who operate a designated fishery, etc.) carried out for gathering or catching each type of living marine resources, with this amount being expressed as a number of fishing days and by any other index provided in Prefectural Regulations for each mode of gathering or catching related to that type of living marine resources; hereinafter the same shall apply) for each type of living marine resources and for the mode of gathering or catching to which each such type is subject, and in cases where each type of living marine resources are controlled based on the prefectural fishing effort within designated areas of the sea or designated periods of time in relation to a mode of gathering or catching, this shall mean the maximum limit of the total annual fishing effort for the prefecture for each such mode of gathering or catching each type of living marine resources, etc.) (hereinafter referred to as 'Class II designated living marine resources'), and when the governor designates Class I and Class II designated living marine resources, he/she shall prescribe the following matters in the Prefectural Plan:
