In formulating policies to ensure Food safety, necessary measures such as the collection, arrangement, and utilization of internal and external information about ensuring Food safety, shall be taken to appropriately and effectively implement the necessary measures for ensuring Food safety in response to changes in the environment surrounding dietary habits of citizens.
The competent minister may, when he/she finds it necessary to enforce this Act, cause his/her officials to enter the offices, factories, workplaces, stores or warehouses of a person engaging in the manufacture, import or sale of the consumer products or a business operator transacting specified maintenance products and to conduct an inspection of the consumer products, books, documents and other items.
To subscribe shares and hold these subscribed shares, issued by a Small and Medium Sized Enterprise Operator or an individual not engaging in a business who established a business with stated capital exceeding 300,000,000 yen for the purpose to implement the business that utilizes the said Specified Research Results which is transferred to an Accredited TLO pursuant to the Specified University Technology Transfers Operations to be carried out according to an Approved Plan.
The purpose of this Act is to improve the social infrastructure efficiently and effectively and to ensure the provision of affordable and good service to the citizens by taking measures for promotion of provision etc., of Public Facility etc. through utilization of private finance, management abilities and technical capabilities, thereby contributing healthy development of the national economy.

In formulating policies to ensure Food safety, necessary measures such as the collection, arrangement, and utilization of internal and external information about ensuring Food safety, shall be taken to appropriately and effectively implement the necessary measures for ensuring Food safety in response to changes in the environment surrounding dietary habits of citizens.

The government shall, for the purpose of reflecting public opinion on formulation of policies for conservation and sustainable use of biodiversity and ensuring fairness and transparency of the process thereof, ask for the opinions of diversified bodies, including businesses, private bodies and persons who have expert knowledge about conservation and sustainable use of biodiversity, and aim at utilization, etc. of a mechanism to form policies after sufficiently considering such opinions.
In forming an advanced information and telecommunications network society, positive action shall be taken to reduce the disparity in the opportunities for using information and telecommunications technologies and in the ability to use them derived from geographical constraints, age, physical circumstances and other elements in consideration of the possibility that the disparity may severely hamper orderly and integrated formation of the advanced information and telecommunications network society.
Strategies developed to form an advanced information and telecommunications network society shall promote education and learning for enabling every citizen to use information and telecommunications technologies and shall ensure that the necessary action is taken to develop creative human resources with the technical knowledge and skills required to play leading roles in the development of the advanced information and telecommunications network society.
In light of the fact that the judicial authorities will play more important role in protecting intellectual property rights along with advancement in the exploitation of intellectual property in the economy and society, national government shall take necessary measures to ensure more effective and prompt court proceedings, improve technical resolution systems at court and reinforce alternative dispute resolution systems, with regard to legal case on intellectual property rights.
This Act shall, for the purpose of ensuring more effective and expeditious trial proceedings in intellectual property cases, and bearing in mind developments in the utilization of intellectual property in the Japanese economy and society and the ever increasing importance of the role of justice in the protection of intellectual property, provide for necessary matters for establishment of the Intellectual Property High Court that shall specialize in intellectual property cases.
If water on servient land (hereinafter referring to a land of any person other than the one entitled to the servitude, made available for the benefit of the dominant land) subject to a water servitude is insufficient for the demand of the dominant land and the servient land, the water shall be used in proportion to the demand on each parcel of land, firstly for household purposes with the remaining portion used for other purposes; provided, however, that this shall not apply if the act establishing the servitude provides otherwise.
By positively leasing or lending public property (which shall mean the public property provided in Article 238 paragraph (1) of the Local Autonomy Act) or taking other necessary measures, a municipality facing an increasing demand for the Daycare Practice shall promote establishment or operation of nursery centers by utilizing the abilities of social welfare corporations and other various business operators and shall thereby increase supply pertaining to the Daycare Practice efficiently and systematically.
The formation of an advanced information and telecommunications network society shall contribute to creating unique and vital local communities and improving the welfare of the local residents by stimulating local economies, creating attractive local employment opportunities, increasing the variety of opportunities for exchange within and between communities with the use of information and telecommunications technologies to enrich lifestyles and increase convenience.
In the case that the national government recognizes that said Patent Right, etc. have not been utilized within a reasonable time and does not find any justifiable grounds as to why said Patent Rights, etc. have not been utilized within a reasonable time, and in case the national government finds that utilization of said Patent Rights, etc. is particularly necessary for promoting the use of said Patent Rights and makes a request making clear the reasons therefor, the Trustee, etc. promise to grant to a third the right to use said Patent Rights, etc.
This Act shall, for the purpose of ensuring more effective and expeditious trial proceedings in intellectual property cases, and bearing in mind developments in the utilization of intellectual property in the Japanese economy and society and the ever increasing importance of the role of justice in the protection of intellectual property, provide for necessary matters for establishment of the Intellectual Property High Court that shall specialize in intellectual property cases.
Any person engaging in the manufacture or import of the specified maintenance products, etc. shall make use of the information on the age-related deterioration that is made public pursuant to the provisions of paragraph (1) of the preceding Article and shall consider said information when designing and selecting components or materials and shall indicate on his/her products any information on age-related deterioration or make improvements or otherwise, thereby endeavoring to prevent the occurrence of danger due to age-related deterioration.
The term 'product accidents' as used in this Act means those accidents resulting from the use of consumer products that fall under any of the following, other than those apparently not caused by a defect in the consumer products (except for those provided for by Cabinet Order as accidents where the occurrence and increase of danger may be considered to be prevented by the provisions of other acts):
With regard to any application for a test set forth in Article 24-2, paragraph (1) (including the cases applied mutatis mutandis pursuant to Article 32-2, paragraph (2) of the Old Consumer Products Safety Act; hereinafter the same shall apply in the following paragraph) of the Old Consumer Products Safety Act filed prior to the enforcement of Article 1 for which a disposition of success or rejection has not been made at the time of the enforcement of Article 1, the provisions then in force shall remain applicable to the disposition of said application.
The government shall, after approximately three years from the enforcement of this Act, review the measures on advertisements by electromagnetic means that are based on the provisions of the Act on Specified Commercial Transactions as revised by this Act in accordance with the situation of commercial transactions using information technology, the status of the offering of advertisements by electromagnetic means in Specified Commercial Transactions, and other conditions after the enforcement of this Act, and take necessary measures based on the results of the review.
The national government is responsible for adequate and efficient management and operation of the national forest projects, pursuant to the basic principles, in order to contribute to the promotion of the industry or the welfare of the communities by enhancing the public interest and the roles of national lands and forests, providing forest products continually and systematically, and utilizing the national forests.
When having formulated a plan set forth in the preceding paragraph, the employer shall take the measures necessary to disseminate the contents of the plan to his/her employed workers and thereby endeavor to promote the voluntary development and improvement of the vocational abilities(*) of those workers in line with their vocational life planning, and shall effectively utilize the human resources development promoters he/she has appointed as prescribed in the following Article and thereby endeavor to implement the plan smoothly.
A Municipality, when it intends to provide standards concerning employees that engage in Designated Community-Based Service in said Municipality as set forth in the preceding paragraph and standards concerning Facilities and Management of a Designated Community-Based Service Business, shall reflect the opinions of Insured Persons of Long-Term Care Insurance provided by said Municipality and take necessary measures in order to promote the use of knowledge of persons with relevant knowledge and experience.
It was used as a station building by Japanese National Railways and JR West Japan after Kyoto Railway Company was nationalized in 1907; but its use as a station building ended in 1996, following the elevation of the Sanin Line (Sagano Line) between Nijo and Hanazono Stations (in Kyoto Prefecture), and in 1997 was rebuilt on this site to be used as an entrance, with its original indoor facilities such as ticket windows being used as a gallery.
The term 'specified maintenance products' as used in this Act means consumer products that are deemed highly likely to cause serious danger particularly to the lives or bodies of general consumers because of these products' lack of reliable safety due to deterioration caused by long-term use (hereinafter referred to as 'age-related deterioration'), which specified maintenance products are provided for by Cabinet Order as appropriate to be subject to improvement through proper maintenance in view of their usage, etc.
To put a lid on popular faith to prevent rumors from circulating, the Shogunate began to control activities of the flourishing civilian onmyoji in various regions at that time and to give that measure authority, the Shogunate schemed to use 2 onmyoji families (the Kamo clan and the Abe clan) from the Heian Period to administer civilian onmyoji in various provinces assigning the existing Tsuchimikado family and the Kamo family that was restored by Kotokui family, a branch family of the extinguished Kamo clan, to this task.
Any person engaging in the manufacture or import of consumer products shall, in cases where the product accidents have originated with the consumer products that he/she manufactured or imported, investigate the cause of these product accidents, and if he/she finds it necessary to prevent the occurrence and increase of danger, he/she shall endeavor to recall said consumer products or otherwise take measures to prevent the occurrence and increase of danger.
In cases where the competent minister has caused his/her official to conduct an on-site inspection pursuant to the provisions of paragraph (1) of the preceding Article or has caused NITE to conduct an on-site inspection in accordance with the provisions of paragraph (4) of the preceding Article, if there are any consumer products that are found to be extremely difficult for the official or NITE inspect on-site, the competent minister may order the owner or possessor to submit them within a period designated by the competent minister.
In developing strategies to form an advanced information and telecommunications network society, consideration shall be given to areas where it is essential to continuously expand advanced information and telecommunications networks, to enrich text, audio, visual and other information provided on such networks and to acquire the skills necessary to use information and telecommunications technologies so that that they are closely linked with one another. The strategies developed shall ensure that these objectives are pursued in an integrated manner.
In light of the importance of the role that intellectual property plays in the development of Japanese industry, business operators shall, in accordance with the basic principles, endeavor for positive exploitation of the intellectual property that is created by themselves or by other business operators and the intellectual property that is created by universities, etc. as well as for proper management of their own intellectual property in order to increase their productivity and reinforce their business foundation through vigorous business activities.
Any person who has obtained a certification or approval as set forth in Article 12, paragraph (1) of the Consumer Products Safety Act prior to the revision by Article 3 (hereinafter referred to as 'Old Consumer Products Safety Act') at the time of the enforcement of this Act shall be deemed to have obtained a registration pursuant to Article 12, paragraph (1) of the New Consumer Products Safety Act. In this case, the valid period of the registration shall be the remaining period of validity of the certification or approval set forth in Article 12, paragraph (1) of the Old Consumer Products Safety Act.
Any person who intends to obtain the registration set forth in Article 12, paragraph (1) of the Consumer Products Safety Act revised by Article 3 (hereinafter referred to as 'New Consumer Products Safety Act') may file an application for registration prior to the enforcement of this Act. The same shall apply to the notification of the business regulations as described in Article 22, paragraph (1) of the New Consumer Products Safety Act (including the cases applied mutatis mutandis pursuant to Article 29, paragraph (2) of the New Consumer Products Safety Act).
Considering that enhancing Technology Management Capability is important for enhancing Industrial Technology Capability, the national government shall take necessary measures for promoting the enhancing of Technology Management Capability, such as presenting forecasts concerning useful future technologies for business operators to comprehensively grasp the trends of technological innovations, training the human resources who will contribute to enhancing Technology Management Capability and improving the qualities thereof, thus maintaining an environment in which business operators can efficiently and smoothly utilize the results of research and development in carrying out business activities, etc.
With respect to the Consumer Product Safety Association, the provisions of the Old Consumer Products Safety Act shall remain in force until the Consumer Product Safety Association ceases to exist by dissolution (or until the change of organization in the case where the organization is changed in accordance with the provisions of Article 12, paragraph (1) of the Supplementary Provisions). In this case, the term 'Ordinance of the Ministry of International Trade and Industry' and the term 'Minister of International Trade and Industry' in the provisions of the Old Consumer Products Safety Act shall be deemed to be replaced with 'Ordinance of the Ministry of Economy, Trade and Industry' and 'Minister of Economy, Trade and Industry', respectively.
The State and Local governments shall take such necessary measures as promoting research studies on psychological trauma and other mental and physical influences that Crime Victims receive from Crimes and methods to restore their mental and physical health, collecting, organizing and utilizing domestic and foreign information, and cultivating human resources concerning support for Crime Victims and enhancing their qualifications, so that appropriate support based on professional expertise may be provided for Crime Victims.
The term 'Qualified Project' as used in this Act means a project (including an urban redevelopment project, a land readjustment project, and another urban development project) involving the provision etc. of Public Facility etc. (which mean construction, rehabilitation, maintenance or operation of Public Facility etc, or planning of them, and include provision of services to the citizens; the same shall apply hereinafter), which is carried out more efficiently and effectively by utilizing private finance, management abilities and technical capabilities.
As for application of the provision of paragraph (2) of Article 461 of the Company Code (Act No. 87 of 2005) in the case where the preceding paragraph applies, 'the amount obtained by subtracting the sum of ' therein shall be deemed to be replaced with 'and, in the cases prescribed in the relevant Cabinet Office Ordinance, the amount obtained by subtracting the sum of the amount prescribed in the Cabinet Office Ordinance which has been appropriated in the part of asset of the balance sheet pursuant to paragraph (1) of Article 20 of the Act on Promotion of Private Finance Initiative.'
In light of the fact that Research and Development results achieved by universities, etc. are useful for the development of new business fields and the improvement of industrial technology, national government shall take necessary measures to encourage universities, etc. to properly manage their Research and Development results and smoothly transfer the results to business operators, such as improving systems in universities, etc. to utilize human resources that have expert knowledge on intellectual property, improving such proceedings pertaining to registration for establishment on intellectual property, carrying out research and study on market, etc., and providing market information.
Any person who intends to obtain a certification or approval pursuant to the provisions of Article 12, paragraph (1) of the Consumer Products Safety Act revised by Article 1 (hereinafter referred to as 'New Consumer Products Safety Act') may file an application for certification or approval prior to the enforcement of the provisions of Article 1. The same shall apply to the notification of the business regulations as prescribed in Article 22, paragraph (1) of the New Consumer Products Safety Act (including the cases applied mutatis mutandis pursuant to Article 29, paragraph (2) of the New Consumer Products Safety Act).
A business that is mainly intended to provide services carried out by persons who have expert knowledge or specialist skills in science and technology, business management or any other fields by utilizing the said knowledge or skills (excluding a business conducted in association with the principal operations of a person who engages in sales and other businesses concerning machinery and equipment, and a business that is mainly intended to provide services for directing and supervising construction, installation, assembly or any other work as prescribed in Article 141(ii) (Tax Base of Corporation Tax in the Case of Foreign Corporations) of the Act).
Upon deciding the establishment and the jurisdictional district of the Public Employment Security Offices, sufficient consideration is required in respect of, in addition to the standards provided in the preceding 2 items, not only the local necessities but also the relationship with other local areas or with the whole nation, so that the national labor force can be optimized to the fullest extent, such as establishing the Public Employment Security Office where necessary in the area where there are few plants, factories or other workplaces but which is the source of labor supply to other areas, or the area where there are plants, factories or other workplaces but such workplaces may not secure appropriate workers residing within commuting distance.
In addition to the business activities under the provisions of the preceding two paragraphs, the Regional Companies may, subject to the authorization of the Minister, operate the telecommunications business activities and other business activities by using facilities or technologies which are maintained in order to operate the business activities under the provisions of paragraph (3), or their staff. In this case, the Minister shall grant authorization if it is deemed that the business activities operated by the Regional Companies do not interfere smooth implementation of the business activities under the provisions of the same paragraph and securement of fair competition of the telecommunications business.
In light of the fact that enhancing Technology Management Capability contributes to the enhancing of Industrial Technology Capability as prescribed in the preceding paragraph, the enhancement of Technology Management Capability shall be carried out based on the premise that when business operators engage in research and development, it is important for said business operators to accurately grasp the current status of their competitiveness and the trends of technical innovation, and it is also important for said business operators to seek broad knowledge regardless of their current business field and to assimilate the knowledge thus obtained and utilize it.
In addition to the business activities under the provisions of the preceding two paragraphs, the Regional Companies may, subject to the authorization of the Minister, operate the telecommunications business activities and other business activities by using facilities or technologies which are maintained in order to operate the business activities under the provisions of paragraph (3), or their staff. In this case, the Minister shall grant authorization if it is deemed that the business activities operated by the Regional Companies do not interfere smooth implementation of the business activities under the provisions of the same paragraph and securement of fair competition of the telecommunications business.
Exceptional floor area ratio districts -- adequately situated and located in category 1 medium-rise exclusive residential districts, category 2 medium-rise exclusive residential districts, category 1 residential districts, category 2 residential districts, quasi-residential districts, neighborhood commercial districts, commercial districts, quasi-industrial districts, industrial districts, or exclusive industrial districts that contain land on which public facilities stand -- are districts designated to promote high-level land use by utilizing building floor area deemed unused pursuant floor-area ratio limits provided for in paragraphs (1) through (9), Article 52 of the Building Standards Act.
With regard to any application for examination set forth in Article 6 of the Old Consumer Products Safety Act filed prior to the enforcement of Article 1 for which application a disposition of success or rejection has not been made at the time of the enforcement of Article 1 or any application for approval of the type set forth in Article 23, paragraph (1) or Article 32-4, paragraph (1) of the Old Consumer Products Safety Act under which an application is filed prior to the enforcement of Article 1, for which a disposition of approval or disapproval has not been made at the time of the enforcement of Article 1, the provisions then in force shall remain applicable to the disposition for said application.
Any person who has been designated pursuant to the provisions of Article 4, paragraph (1), item (i) of the Consumer Products Safety Act prior to the revision by Article 1 (hereinafter referred to as 'Old Consumer Products Safety Act') at the time of the enforcement of the provisions of Article 1 shall be deemed to have been designated pursuant to Article 12, paragraph (1) of the New Consumer Products Safety Act until the expiration of a period of six months starting from the day of the enforcement of Article 1. In the case where said person filed an application for certification as prescribed in the same paragraph during said period, the same shall apply during the period until a disposition pertaining to the application is made.
In order to enhance Industrial Technology Capability, the national government, shall endeavor to take necessary measures to provide support to the business operators who will implement businesses that utilize said research results, taking into account the fact that it has an important meaning in the promotion of transfers of said research results to business operators, for researchers at national Research and Development Institutes to jointly hold positions as officers, advisors or councilors in companies and other organizations whose purpose is to conduct for-profit private enterprise to implement businesses utilizing the results of that research (referred to in the next paragraph as 'Research Results Utilizing Companies, etc.').
In order to enhance Industrial Technology Capability, local governments shall endeavor to take necessary measures to provide support to the business operators who will implement businesses that utilize said research results, taking into account the fact that it has an important meaning in the promotion of transfers of said research results to business operators, for researchers at universities, etc. (meaning entities that are universities or national colleges of technology as prescribed in Article 1 of the School Education Act and are established by local governments) and Research and Development Institute of local governments to jointly hold positions as officers, advisors or councilors of Research Results Utilizing Companies, etc.
A Municipality, when it intends to promulgate standards concerning employees that engage in Designated Community-Based Preventive Service of Long-Term Care, standards concerning effective support methods for Prevention of Long-Term Care pertaining to a Designated Provider of Community-Based Service for Preventive Long-Term Care, and standards concerning facilities and management of the business of Designated Community-Based Preventive Service of Long-Term Care in said Municipality as set forth in the preceding paragraph, shall reflect opinions of Insured Persons by Long-Term Care Insurance provided by said Municipality and take necessary measures in order to promote to use knowledge of persons with relevant knowledge and experience.
The competent minister shall collect and analyze information on accidents that arise or are likely to arise from age-related deterioration of the specified maintenance products or other consumer products that are deemed highly likely to cause serious danger to the lives or bodies of general consumers arising from safety troubles due to age-related deterioration (hereinafter referred to as 'specified maintenance products, etc.' in this Section), and shall make public the information, which is obtained as a result of this analysis, regarding the type of components and materials that deteriorate easily and other information on the age-related deterioration of the specified maintenance products, etc.
The term 'Advanced Large Research Facilities' as used in this Act shall mean such large research facilities as shall be deemed inappropriate due to the large amount of costs required if more than one national testing and/or research institution or Incorporated Administrative Agency (meaning the Incorporated Administrative Agency prescribed by Article 2, paragraph (1) of the Act for the General Rules for Incorporated Administrative Agency (Act No. 103 of 1999)) engaged in the Researches, etc. establishes the same in an overlapping manner, and, with their incomparable functions in the fields of advanced science and technology, the value of which shall be maximized to the fullest extent by being utilized for various Researches, etc. in the wide range of fields of science and technology.
In cases where the competent minister has received a report in accordance with the provisions of paragraph (1) of the preceding Article or otherwise comes to know of the occurrence of serious product accidents, if he/she finds it necessary for preventing the occurrence and increase of serious danger to the lives or bodies of general consumers by the consumer products pertaining to said serious product accidents, he/she shall make public the name and type of the consumer products pertaining to said serious product accidents, the details of the accidents and any other matters that contribute to avoiding the dangers associated with the use of said consumer products, except in cases where he/she has given notice in accordance with the provisions of paragraph (3) of the preceding Article.
With regard to the application of penal provisions to any acts committed prior to the enforcement of this Act (or the respective provisions of the items of Article 1 of the Supplementary Provisions) (or with respect to the Consumer Product Safety Association, prior to the provisions of the old Consumer Product Safety Act losing effect despite Article 10 of the Supplementary Provisions deeming that these provisions remain in force; with respect to the High Pressure Gas Safety Institute of Japan, prior to the provisions of the old High Pressure Gas Safety Act losing effect despite Article 30 of the Supplementary Provisions deeming that these provisions remain in force) as well as any acts committed after the enforcement of this Act in the cases where the provisions then in force shall remain applicable pursuant to the Supplementary Provisions, the provisions then in force shall remain applicable.
In cases where a person engaging in the manufacture or import of consumer products fails to make a report or has made a false report in violation of the provisions of Article 35, paragraph (1), if the competent minister finds it necessary for securing the safety of the consumer products manufactured or imported by the person, the competent minister may order the person engaging in the manufacture or import of consumer products to develop a system necessary for collecting information on serious product accidents that occur in relation to the consumer products manufactured or imported by the person and for the proper management or provision of said information.
Measures for the creation, protection and exploitation of intellectual property shall be promoted with the objective of achieving an intensification of the technical capabilities of Japanese industry and the revitalization of the industry, the activation of the local economy, and an increase in job opportunities, thereby contributing to the intensification of the international competitiveness of Japanese industry and a sustainable development of Japanese industry that precisely responds to the changes in the economic environment at home and abroad, through encouraging smooth transfer of the results of creative Research and Development into commercial use and promoting the development of new business fields, management innovation and business startups, all of which are based on intellectual property.
With regard to the application of penal provisions to acts committed prior to the enforcement of this Act (or the respective provisions listed in the items of Article 1 of the Supplementary Provisions) (or with respect to the Consumer Product Safety Association, prior to the lapse of the provisions of the Old Consumer Products Safety Act that shall remain in force pursuant to the provisions of Article 10 of the Supplementary Provisions, or with respect to the High Pressure Gas Safety Institute of Japan, prior to the lapse of the provisions of the High Pressure Gas Safety Act that shall remain in force pursuant to the provisions of Article 30 of the Supplementary Provisions) and acts committed after the enforcement of this Act in the case where the provisions then in force shall remain applicable pursuant to the provisions of the Supplementary Provisions, the provisions then in force shall remain applicable.
The application of penal provisions to any act which has been committed before the enforcement of this Act (or the provisions in each item of Article 1 of the supplementary provisions in the case where such provisions are applicable) (or before the expiration of the validity of the provisions of the previous Consumer Product Safety Act to be regarded as still enforceable under the provisions of Article 10 of the supplementary provisions, in the case of acts by the Consumer Product Safety Association, or before the expiration of the validity of the provisions of the previous High Pressure Gas Safety Act to be regarded as still enforceable under the provisions of Article 30 of the supplementary provisions, in the case of acts by the High Pressure Gas Safety Institute) as well as to any act which has been committed after the enforcement of this Act and is required by the provisions of this supplementary provisions to be disposed in consideration of similar previous cases, shall be still treated in consideration of similar previous cases.
With regard to the application of penal provisions to any acts committed prior to the enforcement of this Act (or the respective provisions of the items of Article 1 of the Supplementary Provisions) (or with respect to the Consumer Product Safety Association, prior to the provisions of the old Consumer Product Safety Act losing effect despite Article 10 of the Supplementary Provisions deeming that these provisions remain in force; with respect to the High Pressure Gas Safety Institute of Japan, prior to the provisions of the old High Pressure Gas Safety Act losing effect despite Article 30 of the Supplementary Provisions deeming that these provisions remain in force) as well as any acts committed after the enforcement of this Act in the cases where the provisions then in force shall remain applicable pursuant to the Supplementary Provisions, the provisions then in force shall remain applicable.
With regard to the application of penal provisions to any acts committed prior to the enforcement of this Act (or the relevant provisions of the items of Article 1 of the Supplementary Provisions) (or with respect to the Consumer Product Safety Association, prior to the expiration of the provisions of the old Consumer Product Safety Act that had been deemed to remain in force pursuant to the provisions of Article 10 of the Supplementary Provisions; with respect to the High Pressure Gas Safety Institute of Japan, prior to the expiration of the provisions of the old High Pressure Gas Safety Act that had been deemed to remain in force pursuant to the provisions of Article 30 of the Supplementary Provisions) as well as any acts committed after the enforcement of this Act in the cases where the provisions then in force remain applicable pursuant to the Supplementary Provisions, the provisions then in force shall remain applicable.
A business that is mainly intended to provide services carried out by persons who have expert knowledge or specialist skills in science and technology, business management or other fields by utilizing the said knowledge or skills (excluding a business conducted in association with the principal operations of a person who engages in sales and other businesses concerning machinery and equipment, and a business that is mainly intended to provide services for directing and supervising construction, installation, assembly or any other work as prescribed in Article 164(1)(ii) (Method of Taxation on Nonresidents) of the Act or Article 141(ii) (Tax Base of Corporation Tax in the Case of Foreign Corporations) of the Corporation Tax Act)
Any label placed, in accordance with the provisions of Article 7, Article 27 or Article 32-10 of the Old Consumer Products Safety Act, to those Specified Products set forth in Article 2, paragraph (2) of the Old Consumer Products Safety Act that fall under the category of Specified Products as described in Article 2, paragraph (2) of the New Consumer Products Safety Act (hereinafter referred to as 'specified products under transition') at the time of the enforcement of Article 1 shall be deemed to be a label placed pursuant to the provisions of Article 13 of the New Consumer Products Safety Act until the expiration of a period specified by Cabinet Order for the respective specified products under transition not to exceed five years from the date of enforcement of Article 1.
In order to vitalize technology-related research and development activities and promote effective utilizations of the results thereof in business activities, if the patent right or other right specified by Cabinet Order (hereinafter in this Article referred to as 'Patent Right, etc.') pertaining to the result of technology-related research and development entrusted by the national government or of software development that the national government has contracted for work (hereinafter in this Article referred to as 'Result of Specified Research and Development, etc.'), falls under all of the following items, the national government may decide not to accept those Patent Rights, etc. from that entrusted party or contractor (hereinafter in this Article, 'Trustee, etc.').
Any person who has, at the time of enforcement of Article 1, obtained an approval or filed an application as prescribed in Article 23, paragraph (1) of the Old Consumer Products Safety Act with respect to the type of specified products under transition (including any person who has applied for approval as described in Article 4, paragraph (3) of the Supplementary Provisions (except for an application for approval of the type set forth in Article 32-4, paragraph (1) of the Old Consumer Products Safety Act)) or any person who has given a notification in accordance with the provisions of Article 32-6, paragraph (1) of the Old Consumer Products Safety Act with respect to the type of the specified products under transition shall be deemed to have given a notification with respect to the specified products under transition of the type pertaining to such approval or application or notification in accordance with the provisions of Article 6 of the New Consumer Products Safety Act.
The purpose of this Act is to provide for basic principles and a basic policy on the development of strategies with respect to the formation of an advanced information and telecommunications network society, to determine the responsibilities of the Government of Japan and local public entities, to establish the Strategic Headquarters for the Promotion of an Advanced Information and Telecommunications Network Society and to provide for the development of a Priority Policy Program on the formation of an advanced information and telecommunications network society in consideration of the urgent need to appropriately keep pace with the rapid and drastic changes on a global scale in the socio-economic structures arising from the use of information and telecommunications technologies, to swiftly and thoroughly introduce the measures for the formation of an advanced information and telecommunications network society.
With regard to policies to urge business operators and citizens, by imposing appropriate and fair economic burdens, to take actions contributing to the prevention or reduction of the generation of wastes, etc. from products, containers, etc. or the appropriate and smooth cyclical use or disposal of products, containers, etc. when they have become circulative resources, the State shall conduct proper surveys and studies on any possible effects, influences on the Japanese economy, etc. if any measures under such policies are taken, and shall make efforts to gain understanding and cooperation from citizens towards establishing a Sound Material-Cycle Society by making use of such policies and measures if it is necessary to introduce them.
The State may, for the time being, provide local governments with loans without interest, within its budgetary limit, as funds to be allocated for covering the expenses to be incurred by the local governments in independently implementing projects to establish facilities for the promotion of effective utilization of resources through the use of Recyclable Resources or Reusable Parts, which fall under Article 2, paragraph 1, item 2 of the Act on Special Measures Concerning Promotion of Development of Social Infrastructure through Utilization of Income from Sales of Stock of the Nippon Telegraph and Telephone Corporation (Act No. 86 of 1987), or as funds to be allocated for covering the expenses for subsidies to be given by the local governments to the private business operators that carry out such projects.
Measures for the creation, protection and exploitation of intellectual property shall be promoted with the objective of realizing a society in which the public can enjoy the benefit of intellectual property and establishing a foundation for the creation of new intellectual property in the future, thereby contributing to the sound development of the national economy and the creation of rich culture, through developing an essential environment to develop human resources that are rich in creativity, effectively exercise such creativity, achieve prompt and appropriate protection of intellectual property in response to the progress in technical innovation at home and abroad, actively exploit intellectual property in the economy and society, and utilize its value to the maximum.
The purpose of the New Energy and Industrial Technology Development Organization, Incorporated Administrative Agency (hereinafter referred to as 'NEDO') is to enhance industrial technology and to promote the commercialization thereof by comprehensively performing functions such as promoting R&D (meaning research and development; the same shall apply hereinafter) carried out using skills from the private sector; promoting R&D done by the private sector with regard to technology for non-fossil energies, combustible natural gas, and coal; promoting the technology required for the rational use of energy and technology in mining and industry; and promoting the utilization of such technology in cooperation with the international community; to thereby contribute to ensuring a stable and efficient energy supply in accordance with the changes in the domestic and foreign economic and social environments and to the development of the economy and industry.
Any person who has, at the time of enforcement of Article 1, obtained an approval of the type set forth in Article 23, paragraph (1) of the Old Consumer Products Safety Act with respect to the special specified products under transition (including any person who has obtained an approval for the application for approval of the type, for which the provisions then in force shall remain applicable pursuant to the provisions of Article 4, paragraph (1) or paragraph (3) of the Supplementary Provisions (except for an application for approval of the type as prescribed in Article 32-4, paragraph (1) of the Old Consumer Products Safety Act)) shall be deemed to have performed the obligation in accordance with the provisions of Article 12, paragraph (1) of the New Consumer Products Safety Act until the expiration of the period specified by Cabinet Order set forth in Article 25, paragraph (1) of the Old Consumer Products Safety Act commencing from the date of said approval in the case where said person manufactured the special specified products under transition of the type pertaining to this approval.
In addition to cases where the provisions then in force remain applicable pursuant to the provisions of Article 7, paragraph (2) of the Supplementary Provisions, with regard to those first-class Specified Products set forth in Article 2, paragraph (3) of the Old Consumer Products Safety Act with labels placed in accordance with the provisions of Article 27 of the Old Consumer Products Safety Act as applied mutatis mutandis pursuant to Article 32-4, paragraph (2) of the Old Consumer Products Safety Act that fall under the special specified products as described in Article 2, paragraph (3) of the New Consumer Products Safety Act (hereinafter referred to as 'special specified products under transition'), the provisions then in force shall remain applicable, notwithstanding the provisions of Article 4, paragraph (1) and Article 5 of the New Consumer Products Safety Act, until the expiration of a period specified by Cabinet Order for the respective special specified products under transition not to exceed five years from the date of enforcement of Article 1.
In this Act, the term 'Specified University Technology Transfer Operations' shall mean, the operation of transfer of the patent rights or other rights provided by Cabinet Order relating to those technological research results (hereinafter referred to as 'Specified Research Results') obtained at universities (referring to universities and national colleges of technology provided in Article 1 of the School Education Act (Act No. 26 of 1947) and inter-university research institutes provided in Article 2, paragraph 4 of the National University Corporation Act (Act No. 112 of 2003); the same shall apply hereinafter), which are held by parties other than the State, to private business operators whose utilization of the Specified Research Results is confirmed to be both appropriate and assured, and the transfer of which shall contribute to the advancement of the research being done at the said universities.
The purpose of this Act is, for the objective of realizing a dynamic economy and society that is based on the creation of added values through the creation of new intellectual property and effective exploitation of such intellectual property in light of a growing necessity for intensifying the international competitiveness of Japanese industry in response to the changes in the social and economic situations at home and abroad, to promote measures for the creation, protection and exploitation of intellectual property in a focused and systematic manner by stipulating the basic principles on the creation, protection and exploitation of intellectual property and the basic matters to achieve the principles, clarifying the responsibilities of national government, local governments, universities, etc. and business operators, establishing the Intellectual Property Strategy Headquarters, and providing stipulations on the development of a strategic program on the creation, protection and exploitation of intellectual property.
With regard to an application for approval of the type pursuant to the provisions of Article 23, paragraph (1) or Article 32-4, paragraph (1) of the Old Consumer Products Safety Act filed within ten days from the enforcement of Article 1 by a person who had passed the test set forth in Article 24-2, paragraph (1) of the Old Consumer Products Safety Act prior to the enforcement of Article 1, with a document attached proving that the person had passed the test, or an application for approval of the type pursuant to the provisions of Article 23, paragraph (1) or Article 32-4, paragraph (1) of the Old Consumer Products Safety Act filed by a person who had applied for and passed the test for which the provisions then in force shall remain applicable pursuant to the provisions of the preceding paragraph, within ten days from the day of passing, with a document attached proving that the person had passed the test, the provisions then in force shall remain applicable to the disposition of said application.
Concerning research results related to the technologies of those national research and development institutes stipulated by Cabinet Orders (hereinafter referred to as 'Specified Research and Development Institutes'), a person who has received assignment of nationally-owned patent right or right to receive a patent, or nationally-owned utility model right or right to receive registration of a utility model related to said research results, and who is engaged in the operation of transferring said research results to private business operators who intend to utilize these research results, through assignment or the establishment of exclusive licenses of patent, obtained based on said patent right itself or right to receive said patent, or utility model rights obtained based on the utility model right itself or right to receive registration of said utility model, or otherwise, may apply to the Minister having jurisdiction over the said Specified Research and Development Institute and receive an accreditation to the effect that the operation of that person conforms to all of the following items.
To subscribe shares, to apply for share options (except for those attached to bond with share option) or to purchase bond with share option, etc. (referring to bonds with share option, etc. as provided in Article 5, paragraph 1, item 2 of the Small and Medium Business Investment & Consultation Companies Act; hereinafter the same shall apply in this paragraph), or to hold the subscribed shares, the share options (including the shares issued or transferred through the exercise of the share options), or the bonds with share option, etc. (including the shares issued or transferred through the exercise of the share options attached to the bonds with share option, etc.), which have been issued by a corporation that falls within the definition of Small and Medium Sized Enterprise Operators and that has a stated capital exceeding 300,000,000 yen in order to raise the funds required to implement the business utilizing the said Specified Research Results which was transferred to an Accredited TLO pursuant to the Specified University Technology Transfers Operations to be carried out in accordance with an Approved Plan.
In cases where serious product accidents have occurred due to defects in the consumer products or where serious danger has occurred to the lives or bodies of general consumers or the occurrence of such danger is considered to be imminent, when the competent minister finds it particularly necessary to prevent the occurrence and increase of this danger, to the extent necessary, he/she may order the person engaging in the manufacture or import of said consumer products to recall the consumer products manufactured or imported by the person and to otherwise take measures necessary to prevent the occurrence and increase of serious danger to the lives or bodies of general consumers due to said consumer products, except where the competent minister may give an order to take necessary measures in accordance with the provisions of Article 32 or other acts provided for by Cabinet Order.
Concerning research results related to technologies of an incorporated administrative agency (referring to an Incorporated Administrative Agency as stipulated in Article 2, paragraph 1 of the Act on General Rules for Incorporated Administrative Agencies) (Act No.103 of 1999) that is an entity conducting work related to testing and research (hereinafter referred to as a 'Research and Development Incorporated Administrative Agency'), a person who has received assignment of patent right or the right to receive a patent related to said research result owned by a Research and Development Incorporated Administrative Agency, and who is engaged in the operation of transferring said research results (hereinafter 'Research and Development Incorporated Administrative Agency Technology Transfer Operations') to private business operators who intend to utilize those research results, through assignment, establishment of exclusive licenses of patent rights obtained based on said patent right itself or right to receive said patent or otherwise, may apply to the Minister having jurisdiction over said Research and Development Incorporated Administrative Agencies and receive an accreditation to the effect that the operation of that person conforms to all of the following items.
With regard to the sale or labeling of the special specified products under transition subject to approval of the type as prescribed in Article 32-4, paragraph (1) of the Old Consumer Products Safety Act which is in effect at the time of enforcement of Article 1 (including approval of the type obtained by deeming that the provisions then in force shall remain applicable pursuant to the provisions of Article 4, paragraph (1) or paragraph (3) of the Supplementary Provisions (limited to the approval for a foreign registered manufacturer set forth in Article 32-2 of the Old Consumer Products Safety Act)), the provisions then in force shall remain applicable, notwithstanding the provisions of Article 4, paragraph (1) and Article 5 of the New Consumer Products Safety Act, until the expiration of the period specified by Cabinet Order provided for in Article 5, paragraph (2) of the Supplementary Provisions pertaining to the special specified products under transition starting from the date of enforcement of Article 1 or the expiration of a period specified by Cabinet Order as set forth in Article 25, paragraph (1) of the Old Consumer Products Safety Act as applied mutatis mutandis pursuant to Article 32-4, paragraph (2) of the Old Consumer Products Safety Act starting from the date of said approval, whichever comes earlier.
A notification given in accordance with the provisions of Article 32-5-6 of the Old Consumer Products Safety Act with respect to the person who is deemed, pursuant to the provisions of the preceding paragraph, to have obtained certification in accordance with Article 12, paragraph (1) of the New Consumer Products Safety Act shall be deemed to be a notification given in accordance with the provisions of Article 21 of the New Consumer Products Safety Act; the business regulations for which a certification is granted or for which an application is filed in accordance with the provisions of Article 32-5-7, paragraph (1) of the Old Consumer Products Safety Act shall be deemed to be the business regulations for which a notification is given pursuant to the provisions of Article 22, paragraph (1) of the New Consumer Products Safety Act; a suspension and discontinuation of business for which a permission is granted or for which an application is filed pursuant to the provisions of Article 32-5-8 of the Old Consumer Products Safety Act shall be deemed to be a suspension and discontinuation of business for which a notification is given pursuant to the provisions of Article 23 of the New Consumer Products Safety Act; an order given pursuant to the provisions of Article 32-5-13 of the Old Consumer Products Safety Act shall be deemed to be an order given pursuant to the provisions of Article 24 of the New Consumer Products Safety Act; and an order given pursuant to the provisions of Article 32-5-14 of the Old Consumer Products Safety Act shall be deemed to be an order given pursuant to the provisions of Article 26 of the New Consumer Products Safety Act, respectively.
For the time being, the State may, within the scope of the budget, provide a loan without interest of an amount equivalent to the amount that the State may subsidize pursuant to the provisions of Article 75, paragraph (2) (in the case where any law or ordinance stipulates otherwise with regard to the proportion of subsidy by the State under these provisions, they shall include the provisions of said law or ordinance that stipulates otherwise; the same shall apply hereinafter) to a prefecture (in the case where the affairs under Article 74, paragraph (1), which are to be processed by a prefecture, are to be processed by a designated city, etc., pursuant to the provisions of Article 84-2, paragraph (1), this shall include said designated city, etc.; hereinafter the same shall apply in this paragraph and paragraphs (12) to (14) of the Supplementary Provisions) for the funds to be allocated to the expenses subsidized by said prefecture for the establisher of a public assistance facility other than said prefecture, with regard to a repair, renovation or expansion of a public assistance facility of which expenses may be subsidized by the State pursuant to the provisions of Article 75, paragraph (2) and which falls under Article 2, paragraph (1), item (ii) of the Act on Special Measures Concerning Promotion of Social Infrastructure Development Through Use of Proceeds from Sale of the Stock of Nippon Telegraph and Telephone Corporation (Act No. 86 of 1987).
Concerning the patent fee, registration fee or other charge to be paid with respect to Patent Rights, etc. or the Rights to Receive Patent, etc. or the Patent Rights, etc. obtained based on the Right to Receive Patent, etc., these rights being owned by a Research and Development Incorporated Administrative Agency (hereinafter referred to simply as 'Research and Development Incorporated Administrative Agency') and pertaining to research results related to technologies of said Research and Development Incorporated Administrative Agency and having been assigned, prior to the date of partial enforcement, to a person who has received an accreditation pursuant to paragraph 1 of Article 13 of the Old Universities, etc. Technology Transfer Promotion Act (limited to persons who conduct the operation of transferring research results related to technologies of Research and Development Incorporated Administrative Agencies prescribed in the same paragraph to private business operators who intend to utilize these research results; in the next paragraph referred to as 'Research and Development Incorporated Administrative Agency-Related Certified Business Operators '), the provisions of paragraph 2 and paragraph 3 in the same Article, the provisions of paragraph 4, paragraph 6 and paragraph 8 of Article 12 in the Old Universities, etc. Technology Transfer Promotion Act that apply mutatis mutandis to paragraph 2 of same Article, the provisions of paragraph 10 of Article 12 of the Old Universities, etc. Technology Transfer Promotion Act that apply mutatis mutandis to paragraph 3 of Article 13 of the Old Universities, etc. Technology Transfer Promotion Act, and paragraph 4, paragraph 6 and paragraph 8 of the same Article that apply mutatis mutandis to same paragraph shall remain in effect, even after the partial effective date.
For the time being, the national government may, within the scope of the budget, provide loans without interest to a prefectural government (including Designated Cities, etc., in the case where they handle the affairs set forth in Article 56-2 paragraph (1) that are supposed to be handled by a prefectural government pursuant to the provision of Article 59-4 paragraph (1); the same shall apply hereinafter in this paragraph and paragraph (7)), and any such loan shall be in the amount equivalent to the amount that can be subsidized by the national government pursuant to the provision of Article 56-2 paragraph (3) (including the provisions of the laws and regulations, if any, which provide for other different percentages that can be subsidized by the national government; the same shall apply hereinafter). Such loans shall be funded to be appropriated to the expenses subsidized by said prefectural government to social welfare corporations established pursuant to the provision of Article 31 paragraph (1) of the Social Welfare Act, the Japanese Red Cross Society or non-profit incorporated associations or non-profit incorporated foundations, if such subsidies from said prefectural government are granted for the expenses spent for such Construction, etc. of institutions for mentally retarded children, etc. that can be subsidized by the national government pursuant to the provision of pursuant to the provision of Article 56-2 paragraph (3) and that falls under Article 2 item (ii) paragraph (1) of the Act on Special Measures concerning Promotion of Development of Infrastructures by Utilization of Revenues from the Sale of Shares of Nippon Telegraph and Telephone Corporation (Act No. 86 of 1987) (hereinafter referred to as "Act on Special Measures concerning Infrastructure Development").
The cases specified by an Ordinance of the Ministry of Health, Labour and Welfare as provided by Article 32-3, paragraph 2 of the Act shall be the cases under which a fee equivalent to or less than ten-point-five hundredths (10.5/100) (or ten-point-two hundredths (10.2/100) in case of a tax-exempt business provider) of the wages paid during the six-month period after the employment is collected from the job seeker who had been introduced to an occupation of entertainer (who provides entertainment such as music, theatrical entertainment or other performance art in broadcasting programs (including commercial broadcasting), movies, vaudeville, theaters, etc.) or modeling (who appears at fashion shows or other events or serves as a material for a creation of photographs, etc. used for newspapers, magazines, etc. for demonstrating commercial goods, or who serves as a material for a creation of painting, carving or other works of art), or the job seeker who had been introduced to an occupation of scientist (who engages in researches and studies by applying highly scientific and specialized knowledge and means, or the planning, management, instruction, etc. of technical matters for production or other business activities), management executive (who has highly specialized knowledge and experience for the management of a company or other association and provides management businesses for the management of a company or other association) or skilled worker (who has the skill of a person having passed the technical skill test provided by Article 44, paragraph 1 of the Human Resources Development Promotion Act (Act No. 64 of 1969) for the special grade or the first grade or any corresponding skill, and provides businesses utilizing such skill for production or other business activities) (limited to the persons whose wages for the jobs, obtained by them through such introduction, exceed the amount determined by the Minister of Health, Labour and Welfare).
