- 訴訟の準備及び追行に必要な費用を支払う資力がない者又はその支払により生活に著しい支障を生ずる者に対しては、裁判所は、申立てにより、訴訟上の救助の決定をすることができる。ただし、勝訴の見込みがないとはいえないときに限る。
