- このボーリング結果(ボーリング記録とサンプルより)と、湖底の地層構造を衝撃波により調査したこれまでの学術調査結果(植村善博:「比較変動地形論 古今書院、及び、 URBAN KUBOTA NO.37/11)から推定される湖底の岩盤深さとが一致するので比良湖岸断層は、この掘削地点より山側にあると推定されます。
- As the result of this boring (from records of boring and samples) coincides with the depth of base rock at the bottom of lake inferred from the result of scientific investigation of strata architecture at the bottom of lake with shock wave ('Hikaku Hendo Chikeiron' written by Yoshihiro UEMURA, Kokon Shoin publisher, and URBAN KUBOTA NO. 37/11), it is inferred that the Hira-ko lakeshore fault exists on the mountain side from this drilling point.
- 附則第三条、第四条又は第六条第一項の規定によりその設定の出願をし、そ の設定の登録を得た鉱業権の鉱区とウラン鉱又はトリウム鉱と同種の鉱床中に存する鉱物を目的とする鉱業権の鉱区が重複する場合においては、鉱業権者は、そ の重複する部分において鉱物を掘採しようとするときは、他の鉱業権者と協議しなければならない。
- If a mining area, where an application for creation of mining right is filed pursuant to the provision of Article 3 or 4 or paragraph (1) of Article 6 of Supplementary Provisions and the creation is registered, overlaps another mining area, of which the mining right is aimed at minerals that occur in the same type of ore deposit as uranium ore or thorium ore, the holder of mining right, when he/she intends to mine minerals in the overlapped area, shall consult with the other holder of mining right.
- 事業者は、ずい道等の建設の作業(ずい道等の掘削の作業又はこれに伴うずり、資材等の運搬、覆工のコンクリートの打設等の作業(当該ずい道等の内部又は当該ずい道等に近接する場合において行なわれるものに限る。)をいう。以下同じ。)を行なうときは、落盤又は肌落ちによる労働者の危険を防止するため、次の措置を講じなければならない。
- The employer shall, when carrying out construction work of tunnel, etc., (meaning an excavating work of tunnels, etc., or transportation of muck, materials, etc., or concrete placing, etc., work of lining associated with it (limited to the work carried out in the said tunnel, etc., or at a place near the said tunnel, etc.); the same shall apply hereinafter), take the following measures to prevent the dangers to workers due to cave-in or fall of rocks:
- 同種の鉱床中に存する鉱 物の採掘鉱区が隣接する場合において、鉱区の位置形状が鉱床の位置形状と相違し、その鉱区の位置形状を変更しなければその鉱床の完全な開発ができないとき は、採掘権者は、他の採掘権者に対し、鉱区の位置形状が鉱床の位置形状に合致するように、鉱区相互の間に鉱区の増減の出願をすることについて協議すること ができる。
- When the location and shape of a mining area are different from that of an ore deposit in the case where the digging areas of minerals that occur in the same type of ore deposit are adjacent to each other, and it is found that the ore deposit cannot be completely developed unless the location and shape of the mining area are changed, the holders of digging right concerned may consult with each other about applications for mutual increase or decrease of their mining areas to make the location and shape thereof agree with that of the ore deposit.
- 経済産業局長は、鉱 業出願地がその目的となつている鉱物と異種の鉱床中に存する鉱物の他人の鉱区と重複し、又はその目的となつている鉱物と同種の鉱床中に存する鉱物の他人の 鉱区と隣接する場合において、当該鉱業出願地における鉱物の掘採が他人の鉱業の実施を著しく妨害すると認めるときは、その部分については、その出願を許可 してはならない。
- When mining application areas overlap the mining areas of others where the minerals as the subject of application occur in different ore deposits or are adjacent to the mining areas of others where the minerals as the subject of application occur in the same type of ore deposit, and mining of such minerals in the mining application areas is found to significantly interfere with mining of others, the Director of Regional Bureau of Economy, Trade and Industry shall not permit such applications for such areas.
- 公害等調整委員会は、前 項の規定による禁止をした場合において、その鉱区禁止地域内における同項の規定により指定された鉱物の掘採が著しく公共の福祉に反するようになつていると 認めるときは、経済産業局長に対し、その鉱区禁止地域内に存する当該鉱物を目的とする鉱業権について第五十三条の規定による処分をすべきことを勧告するこ とができる。
- In the case of prohibition pursuant to the provision of the preceding paragraph, if the Environmental Dispute Coordination Commission finds that mining of the minerals specified by the preceding paragraph in a mining prohibition area has become substantially adverse to public welfare, the commission may recommend that the Director of Regional Bureau of Economy, Trade and Industry should dispose of the mining right of which the subject is such minerals that occur in the mining prohibition area, pursuant to the provision of Article 53.
- 附則第三条、第四条又は第六 条第一項の規定により鉱業権の設定の出願をし、その設定の登録を得た者は、その鉱区がウラン鉱又はトリウム鉱と同種の鉱床中に存する鉱物を目的とする他人 の鉱区と重複するときは、その重複する部分については、鉱業法第五条の規定にかかわらず、ウラン鉱又はトリウム鉱以外の鉱物を掘採し、及び取得することが できない。
- As for a person who filed an application for creation of mining right pursuant to the provision of Article 3 or 4 or paragraph (1) of Article 6 of Supplementary Provisions and obtained the registration of creation, if his/her mining area overlaps other's mining area that is aimed at the minerals that occur in the same type of ore deposit as uranium ore or thorium ore, any mineral other than uranium ore or thorium ore may not be mined and acquired in the overlapped area notwithstanding the provision of Article 5 of the Mining Act.
- 経済産業局長は、鉱 物の掘採が保健衛生上害があり、公共の用に供する施設若しくはこれに準ずる施設を破壊し、文化財、公園若しくは温泉資源の保護に支障を生じ、又は農業、林 業若しくはその他の産業の利益を損じ、著しく公共の福祉に反するようになつたと認めるときは、鉱区のその部分について減少の処分をし、又は鉱業権を取り消 さなければならない。
- When the mining of minerals is found to be harmful to health, destroy facilities for public use or any facility equivalent to the above, hinder the protection of cultural properties, parks or hot spring resources, or impair the interests of agriculture, forestry and other industries, and be extremely adverse to public welfare, the Director of Regional Bureau of Economy, Trade and Industry shall make dispositions to decrease such part of the mining area or rescind the mining right thereof.
- 経済産業局長は、同種の鉱床中に存する鉱物の採掘鉱区が隣接する場合 において、鉱区の位置形状が鉱床の位置形状と相違し、その鉱区の位置形状を変更しなければその鉱床の完全な開発ができないと認めるときは、当該採掘権者に 対し、鉱区の位置形状が鉱床の位置形状に合致するように、鉱区相互の間の鉱区の増減の出願について協議すべきことを勧告することができる。
- When the location and shape of a mining area are different from those of an ore deposit in the case where the digging areas of minerals that occur in the same type of ore deposit are adjacent to each other, and it is found that the ore deposit cannot be completely developed unless the location and shape of the mining area are changed, the Director of Regional Bureau of Economy, Trade and Industry may recommend that the holders of digging right concerned consult with each other about applications for mutual increase or decrease of their mining areas to make the location and shape thereof agree with that of the ore deposit.
- 異種の鉱床中に存す る鉱物の鉱区が重複するときは、その重複する部分について鉱業権の設定又は鉱区の増加による変更の登録を得た日が後である者は、その先である者の承諾を得 なければ、その部分において鉱物を掘採してはならない。但し、鉱業権の設定又は鉱区の増加による変更の登録を得た日が先である者は、正当な事由がなけれ ば、その承諾を拒むことができない。
- If mining areas of minerals that occur in different types of ore deposits are overlapped, the holder of mining right whose day of obtaining the registration of creation of mining right in the overlapped areas or that of changes thereof due to an increase of mining areas is later than that of the other holder of mining right, the holder may not mine any mineral in the overlapped areas unless he/she obtain consent from the other holder. However, the holder of mining right, whose day of obtaining the registration of creation of mining right or that of changes thereof due to an increase of mining areas is earlier than that of the other holder of mining right, may not refuse to give such approval without any justifiable grounds.
- 経済産業局長は、鉱 業出願地における鉱物の掘採が経済的に価値がないと認めるとき、又は保健衛生上害があり、公共の用に供する施設若しくはこれに準ずる施設を破壊し、文化 財、公園若しくは温泉資源の保護に支障を生じ、若しくは農業、林業若しくはその他の産業の利益を損じ、公共の福祉に反すると認めるときは、その部分につい ては、その出願を許可してはならない。
- When the mining of minerals in mining application areas is found to have no economic value, be harmful to health, destroy facilities for public use or any facility equivalent to the above, disrupt the protection of cultural properties, parks or hot spring resources, or impair the interests of agriculture, forestry and other industries, and be extremely adverse to public welfare, the Director of Regional Bureau of Economy, Trade and Industry shall not permit such applications for such areas.

- Nagaoka-kyo had been called the 'phantom capital' until recently, but members led by Shuichi NAKAYAMA, a high school teacher, began to excavate the area in 1954, and the following year, they found the site of the gate of the Daidairi Chodoin (a large hall at the front in the palace); more excavation and research have been done to date (partly because research on the land has been required to meet the increased demand of land for industrial use and housing), and the site has been designated as a National Historical Site since 1964.

- In the adjoining ruins 'Nishidaihata Ruins' (locally often called 'Nishidaibatake') and Nagamchi East Station Ruins, the remains of residences and so on where people working in the Koriyam Ruins had presumably lived were found and excavated, but they had been damaged probably by the construction of old Japanese National Railway (JR) Nagamachi Rail Center and old JR Nagamachi Yard (now both of them are abolished) and work of burying infrastructure.
- 事業者は、ずい道等の掘削の作業を行う場合において、第三百八十条第一項の施工計画が第三百八十一条第一項の規定による観察、第三百八十二条の規定による点検、第三百八十二条の二の規定による測定等により知り得た地山の状態に適応しなくなつたときは、遅滞なく、当該施工計画を当該地山の状態に適応するよう変更し、かつ、変更した施工計画によつて作業を行わなければならない。
- The employer shall, in the case of carrying out excavating work of tunnels, etc., and when the construction plan set forth in paragraph (1) of Article 380 becomes unsuitable to the conditions of natural ground which was known by the observation pursuant to the provision of paragraph (1) of Article 381, the checkup pursuant to the provision of Article 382, the measurement pursuant to the provision of Article 382-2, etc., alter such construction plan without delay so that it may suit the conditions of the said natural ground, and carry out the excavating work by the changed construction plan.
- 採掘鉱区がその目的とする鉱物と同種の鉱床中に存する鉱物の他人の鉱 区と隣接する場合において、鉱床の位置形状により隣接鉱区に掘進しなければその鉱床の完全な開発ができないときは、その隣接鉱区の鉱業権者及び抵当権者の 承諾を得て、鉱床を定めて、鉱区の増加の出願をすることができる。この場合において、鉱業権者及び抵当権者は、正当な事由がなければ、その承諾を拒むこと ができない。
- In the case where digging areas are adjacent to mining areas of others where the minerals as the subject of digging areas occur in the same type of ore deposit, if the ore deposit cannot be completely developed unless a heading is driven to the adjacent mining area due to the location and shape of ore deposit, an application for increase of mining areas may be filed by obtaining the approval of the holder of mining right and mortgagee of the adjacent mining area and specifying the ore deposit. In this case, the holder of mining right and mortgagee may not refuse to give such approval without any justifiable grounds.

- The scope of 'ancient structural remnant' that is recognized worth as a cultural property buried under the ground and 'relic' that is estimated to be worth as a tangible cultural property, or the legal scope of 'buried cultural property,' was defined by the 'notice concerning the protection of buried cultural properties and facilitation of their excavation researches, etc.,' issued by the Deputy Commissioner for Cultural Affairs to the Directors of the Prefectural Boards of Education as of September 29, 1998, or the so-called 'notice for facilitation' of 1998.
- 鉱業権者は、鉄道、軌道、道路、水道、運河、港湾、河川、湖、沼、 池、橋、堤防、ダム、かんがい排水施設、公園、墓地、学校、病院、図書館及びその他の公共の用に供する施設並びに建物の地表地下とも五十メートル以内の場 所において鉱物を掘採するには、他の法令の規定によつて許可又は認可を受けた場合を除き、管理庁又は管理人の承諾を得なければならない。但し、当該管理庁 又は管理人は、正当な事由がなければ、その承諾を拒むことができない。
- Holders of mining right shall obtain consent of competent agencies or administrators when they mine minerals at places located within 50 meters both on the Earth's surface and underground from railroads, tracks, roads, waterworks, waterways, ports and harbors, rivers, lakes, swamps, ponds, bridges, banks, dams, irrigation and drainage facilities, parks, cemeteries, schools, hospitals, libraries, and other facilities and buildings for public use, except for the case where they are permitted or approved under the provisions of other laws and regulations. However, such competent agencies or administrators may not refuse to give such approval without any justifiable grounds.
- 附則第三条若しくは第四条の 規定による鉱業権の設定の出願に係る掘採区域若しくは権利を行使することができる土地の区域又は附則第三条、第四条若しくは前条第一項の規定によりその設 定の出願をし、その設定の登録を得た鉱業権の鉱区と重複し、かつ、同種の鉱床中に存する鉱物を目的とする試掘鉱区の試掘権者がその重複する部分と重複して 試掘権の目的となつている鉱物を目的とする採掘権の設定の出願をしたときは、その重複する部分については、鉱業法第十六条及び第三十条の規定は、適用しな い。
- If a holder of prospecting right, who is in the digging area involved in the application for mining right pursuant to the provision of Article 3 or 4 of Supplementary Provisions or in the area of land where the right can be exercised, or in the prospecting area that overlaps the mining area where he/she filed an application for creation of mining right pursuant to the provision of Article 3 or 4 of Supplementary Provisions or that of paragraph (1) of the preceding Article and made registration of the said right and that is aimed at the minerals occurring in the same type of ore deposit as the subject of prospecting right, filed an application for creation of digging right for the minerals as the subject of prospecting right redundantly in the overlapped area, the provisions of Articles 16 and 30 of the Mining Act shall not apply to the overlapped area.
- 鉱物の掘採のための土地の掘さく、坑水若しくは廃水の放流、捨石若しく は鉱さいのたい積又は鉱煙の排出によつて他人に損害を与えたときは、損害の発生の時における当該鉱区の鉱業権者(当該鉱区に租鉱権が設定されているとき は、その租鉱区については、当該租鉱権者)が、損害の発生の時既に鉱業権が消滅しているときは、鉱業権の消滅の時における当該鉱区の鉱業権者(鉱業権の消 滅の時に当該鉱業権に租鉱権が設定されていたときは、その租鉱区については、当該租鉱権者)が、その損害を賠償する責に任ずる。
- If others are damaged by excavation of land to mine minerals, discharge of mine water or waste water, heaps of waste rock or slag, or discharge of metallurgical smoke, such damage shall be compensated by the holder of mining right in the mining area concerned at the time of occurrence of damage (or the holder of mining lease right, if a mining lease right is created in the mining area concerned). If the right of mining has already become extinct at the time of occurrence of damage, such damage shall be compensated by the holder of mining right in the mining area concerned at the time of extinction of the mining right (or the holder of mining lease right, if a mining lease right was created in the mining area concerned at the time of extinction of the mining right).
- 第六百四十三条の規定は、法第三十条の三第二項において準用する法第三十条第二項の規定による指名について準用する。この場合において、第六百四十三条第一項第一号中「第三十条第二項の場所」とあるのは「第三十条の三第二項において準用する法第三十条第二項の場所」と、「特定事業(法第十五条第一項の特定事業をいう。)の仕事」とあるのは「法第二十五条の二第一項に規定する仕事」と、「建築工事における躯体工事等」とあるのは「ずい道等の建設の仕事における掘削工事等」と、同条第二項中「特定元方事業者」とあるのは「元方事業者」と読み替えるものとする。
- The provisions of Article 643 shall apply mutatis mutandis to the designation as pursuant to the provision of paragraph (2) of Article 30 of the Act, which is applied mutatis mutandis pursuant to paragraph (2) of Article 30-3 of the Act. In this case, the phrase "the place set forth in paragraph (2) of Article 30", "the work of specified undertaking (meaning the specified undertaking set forth in paragraph (1) of Article 15 of the Act)"and "construction work such as building frame construction" in item (i) of paragraph (1) of Article 643 shall be deemed to be replaced with "the place set forth in paragraph (2) of Article 30 of the Act which is applied mutatis mutandis pursuant to paragraph (2) of Article 30-3 of the Act", "the work prescribed by paragraph (1) of Article 25-2 of the Act" and "excavation, etc., in tunneling work" respectively; and the term "the specified principal employer" in paragraph (2) of the same Article shall be deemed to be replaced with "the principal employer."
- 第一項の規定により障害物を伐除しようとする場合(土地の試掘又はボーリングに伴う障害物の伐除をしようとする場合を除く。)において、当該障害物の所有者及び占有者がその場所にいないためその同意を得ることが困難であり、かつ、その現状を著しく損傷しないときは、国土交通大臣、都道府県若しくは市町村又はその命じた者若しくは委任した者は、前二項の規定にかかわらず、当該障害物の所在地を管轄する市町村長の許可を受けて、ただちに、当該障害物を伐除することができる。この場合においては、当該障害物を伐除した後、遅滞なく、その旨をその所有者及び占有者に通知しなければならない。
- When obstacles are about to be felled or removed pursuant to the provisions of paragraph (1) (excluding cases in which obstacles are about to be removed or felled in line with a test drilling or boring of land), if it is difficult to obtain the consent of the owners and possessors of the obstacles due to their absence from the place, and when felling or removal does not incredibly damage the existing state, the Minister of Land, Infrastructure, Transport and Tourism, the Prefectures, the municipalities or and individuals ordered or commissioned thereby may, upon obtaining the permission of the mayors of the municipalities that have jurisdiction over the area in which said obstacles located, immediately fell or remove said obstacles, notwithstanding the provisions of the preceding two paragraphs. In such cases, they must notify the owners and possessors without delay that they have felled or removed said obstacles.
- 事業者は、手掘り(パワー・シヨベル、トラクター・シヨベル等の掘削機械を用いないで行なう掘削の方法をいう。以下次条において同じ。)により地山(崩壊又は岩石の落下の原因となるき裂がない岩盤からなる地山、砂からなる地山及び発破等により崩壊しやすい状態になつている地山を除く。以下この条において同じ。)の掘削の作業を行なうときは、掘削面(掘削面に奥行きが二メートル以上の水平な段があるときは、当該段により区切られるそれぞれの掘削面をいう。以下同じ。)のこう配を、次の表の上欄に掲げる地山の種類及び同表の中欄に掲げる掘削面の高さに応じ、それぞれ同表の下欄に掲げる値以下としなければならない。
- The employer shall, when carrying out excavating work of natural ground (excluding natural ground composed of rock beds without cracks that cause collapse or fall of rocks, natural ground composed of sand, and natural ground in a condition which is liable to collapse due to blasting etc., hereinafter the same shall apply in this Article) by the method of manual excavation (meaning the method of excavation without excavating machines such as power shovel and tractor shovel; hereinafter the same shall apply in next Article), make the gradient of the excavation surface (in the case that there is a horizontal step with a depth of 2 m or more on the excavation surface, each excavation surface divided by the said horizontal step; the same shall apply hereinafter) the value listed in the right column of the following table or less corresponding to the type of the ground listed in the left column and the height of the excavation surface listed in the middle column of the same table, respectively:
- 前条第一項の規定により他人の占有する土地に立ち入つて測量又は調査を行なう者は、その測量又は調査を行なうにあたり、やむを得ない必要があつて、障害となる植物若しくはかき、さく等(以下「障害物」という。)を伐除しようとする場合又は当該土地に試掘若しくはボーリング若しくはこれらに伴う障害物の伐除(以下「試掘等」という。)を行なおうとする場合において、当該障害物又は当該土地の所有者及び占有者の同意を得ることができないときは、当該障害物の所在地を管轄する市町村長の許可を受けて当該障害物を伐除し、又は当該土地の所在地を管轄する都道府県知事の許可を受けて当該土地に試掘等を行なうことができる。この場合において、市町村長が許可を与えようとするときは障害物の所有者及び占有者に、都道府県知事が許可を与えようとするときは土地又は障害物の所有者及び占有者に、あらかじめ、意見を述べる機会を与えなければならない。
- When individuals, who under the provisions of paragraph (1) of the preceding Article conduct surveys or investigations by entering land in the possession of other individuals, intend under absolute necessity to fell or remove plants, fences, etc. impeding them (hereinafter referred to as 'obstacles'), to conduct test drilling or boring of the land or to fell or remove obstacles for that purpose (hereinafter referred to as 'test drilling etc.'), if they cannot obtain the consent of the owners and possessors of the obstacles or land, they may fell or remove the obstacles by obtaining the permission of the Mayors of the municipalities that have jurisdiction over the land on which the obstacles are located, or they may conduct test drilling etc. by obtaining the permission of the Prefectural governors that have jurisdiction over said land. In such cases, when the Mayors of municipalities are in the process of giving permission, they must provide the owners and possessors of the obstacles an opportunity in advance to express their opinions; and when prefectural governors are in the process of getting permission, they must provide the owners and possessors of the obstacles an opportunity in advance to express their opinions.
- この法律の施行の日の一年以 前から引き続きウラン鉱若しくはトリウム鉱の取得を目的とする土地の使用に関する権利を有している者(土地の所有者を除く。)又はその承継人がこの法律の 施行の日から三月以内にウラン鉱又はトリウム鉱を目的とする鉱業権の設定の出願をしたときは、当該権利を行使することができる土地の区域については、その 者は、鉱業法第二十七条の規定にかかわらず、他の出願(前条の規定による出願、この法律の施行前にした出願及び試掘権者がその試掘鉱区と重複してした採掘 権の設定の出願を除く。)に対し優先権を有するものとし、かつ、鉱業法第十四条第二項、第十六条、第二十九条、第三十条及び第三十二条の規定は、その出願 には、適用しない。ただし、当該土地の区域について前条の規定によるウラン鉱又はトリウム鉱を目的とする鉱業権の設定の出願が許可されたときは、同法第十 六条、第二十九条又は第三十条の規定については、この限りでない。
- If any person or his/her successor who continues to possess the right of use of land for acquisition of uranium ore or thorium ore (except for the owner of land) files an application for creation of mining right for uranium ore or thorium ore within three months from the day of enforcement of this Act, such person shall have the right of priority to other applications (except for the applications filed pursuant to the provision of the preceding Article, the applications filed before the enforcement of this Act and the applications for creation of digging right filed by holders of prospecting right redundantly in their prospecting areas) in the area of land where such right can be exercised, notwithstanding the provision of Article (27) of the Mining Act, and the provisions of paragraph (2) of Article 14 and Articles 16, 29, 30 and 32 of the Mining Act shall not apply to such application. However, if the application for creation of mining right for uranium ore or thorium ore in the area of such land as prescribed in the preceding Article is permitted, this shall not apply to the provisions of Articles 16, 29 and 30 of the said Act.
- 経済産業局長は、第二十一条第一項(第三十六条第二項、第四十五条 第三項又は第五十条第三項において準用する場合を含む。)、第五十二条、第五十五条、第八十三条第一項若しくは第百八十四条の規定による処分の通知、第二 十五条第一項、第四十条第二項、第四十七条第三項(第六十四条の二第二項又は第六十六条第五項において準用する場合を含む。)、第五十七条第一項、第九十 一条第二項、第百一条第二項若しくは第百六条第三項の規定による通知、第三十七条第一項、第三十八条第一項、第三十九条第一項、第四十八条第一項、第四十 九条第一項、第百八十二条若しくは第百八十三条の規定による命令又は第四十七条第五項(第六十四条の二第二項又は第六十六条第五項において準用する場合を 含む。)若しくは第九十四条第二項の規定による決定書の謄本の交付をする場合において、相手方が知れないとき、又はその所在が不分明なときは、鉱業出願 人、鉱業権者若しくは抵当権者にあつては願書若しくは鉱業原簿に記載された住所の所在地の、土地の所有者にあつては採掘出願地の所在地の市役所、町村役場 又はこれに準ずるものの掲示場に、その通知若しくは命令又は決定書の謄本の内容を掲示するとともに、その掲示をした旨及びその要旨を官報に掲載しなければ ならない。この場合においては、掲示を始めた日又は官報に掲載した日のいずれか遅い日から十四日を経過した日に、その通知若しくは命令又は決定書の謄本 は、相手方に到達したものとみなす。
- When the Director of Regional Bureau of Economy, Trade and Industry notifies a disposition pursuant to the provision of paragraph (1) of Article 21 (including the case where it applies mutatis mutandis to paragraph (2) or Article 36, paragraph (3) of Article 45 or paragraph (3) of Article 50), Article 52, Article 55, paragraph (1) of Article 83 or Article 184, gives a notice pursuant to the provision of paragraph (1) of Article 25, paragraph (2) of Article 40, paragraph (3) of Article 47 (including the case where it applies mutatis mutandis to paragraph (2) of Article 64-ii or paragraph (5) of Article 66), paragraph (1) of Article 57, paragraph (2) of Article 91, paragraph (2) of Article 101 or paragraph (3) of Article 106, gives an order pursuant to the provision of paragraph (1) of Article 37, paragraph (1) of Article 38, paragraph (1) of Article 39, paragraph (1) of Article 48, paragraph (1) of Article 49, Article 182 or Article 183, or delivers transcripts of the written decision pursuant to the provision of paragraph (5) of Article 47 (including the case where it applies mutatis mutandis to paragraph (2) of Article 64-ii or paragraph (5) of Article 66) or paragraph (2) of Article 94, he/she shall post the description of such notice, such order and the transcripts of such written decision at the posting area of the offices of municipality or any facility equivalent to the above in the location of the address mentioned in the written application or mining registry in the case of mining applicant, holder of mining right or mortgagee or at the posting area of the offices of municipality or any facility equivalent to the above in the location of the digging application area in the case of land owner, if the other party or the location thereof is unknown, and publish such posting and the gist thereof in an official gazette. In this case, such notice, such order and the transcripts of such written decision shall be deemed to have reached the other party on the day 14 days after the day of commencement of posting or the day of publication in an official gazette, whichever is later.
