- The number of credits to be acquired by completing class subjects pertaining to said inter-university curricula at respective universities shall not include credits that shall be deemed to have been acquired, may be granted, or shall be regarded as, in accordance with Article 28, paragraph (1) (including the case where it is applied mutatis mutandis pursuant to paragraph (2) of the same Article), Article 29, paragraph (1), Article 30, paragraph (1) or paragraph (2), or the preceding Article.
- 前項の 規定は、学生が、外国の大学又は短期大学に留学する場合、外国の大学又は短期大学が行う通信教育における授業科目を我が国において履修する場合及び外国の 大学又は短期大学の教育課程を有するものとして当該外国の学校教育制度において位置付けられた教育施設であつて、文部科学大臣が別に指定するものの当該教 育課程における授業科目を我が国において履修する場合について準用する。
- The provision of the preceding paragraph shall apply mutatis mutandis to the cases where a student studies at a foreign university or junior college, where a student takes class subjects which are conducted by a foreign university or a junior college by correspondence education in Japan, and where a student takes class subjects in Japan, which are conducted by a foreign educational facility positioned as an facility that has curricula of a university or junior college under said foreign country's school education system and designated separately by the Minister of Education, Culture, Sports, Science and Technology.
- 学校その他の教育機関(営利を目的として設置されているものを除く。)において教育を担任する者及び授業を受ける者は、その授業の過程における使用に供することを目的とする場合には、必要と認められる限度において、公表された著作物を複製することができる。ただし、当該著作物の種類及び用途並びにその複製の部数及び態様に照らし著作権者の利益を不当に害することとなる場合は、この限りでない。
- A person who teaches a lesson, and those who receive the lesson, in a school or other educational institutions (excluding, however, those institutions established for profit-making purposes) may, if and to the extent deemed necessary for use in the course of the lesson, reproduce a work already made public; provided, however, that the foregoing shall not apply in the case where such reproduction is likely to unreasonably prejudice the interests of the copyright holder in light of the type and the usage of the work as well as the number of copies and the manner of reproduction.
- 公表された著作物については、前項の教育機関における授業の過程において、当該授業を直接受ける者に対して当該著作物をその原作品若しくは複製物を提供し、若しくは提示して利用する場合又は当該著作物を第三十八条第一項の規定により上演し、演奏し、上映し、若しくは口述して利用する場合には、当該授業が行われる場所以外の場所において当該授業を同時に受ける者に対して公衆送信(自動公衆送信の場合にあつては、送信可能化を含む。)を行うことができる。ただし、当該著作物の種類及び用途並びに当該公衆送信の態様に照らし著作権者の利益を不当に害することとなる場合は、この限りでない。
- When, in the course of a lesson at an educational institution set forth in the preceding paragraph, exploiting a work already made public, by offering or presenting the original or reproductions of such work to those who directly take lessons, or by performing, presenting or reciting it pursuant to the provisions of Article 38, paragraph (1), it shall be permissible to make public transmissions of such work (including, in the case of an automatic public transmission, making such work transmittable) for reception by those who are receiving the same lesson at the same time but at a location other than where such lesson is being given; provided, however, that the foregoing shall not apply in the case where such public transmission is likely to unreasonably prejudice the interests of the copyright holder in light of the type and the usage of the work as well as the manner of the public transmission.
- 二以上の大学は、その大学、学部及び学科の教育上の目的を達成するために必要があると認められる場合には、第十九条第一項の規定にかかわらず、当該二以上の大学のうち一の大学が開設する授業科目を、当該二以上の大学のうち他の大学の教育課程の一部とみなして、それぞれの大学ごとに同一内容の教育課程(通信教育に係るもの及び大学が外国に設ける学部、学科その他の組織において開設される授業科目の履修により修得する単位を当該学科に係る卒業の要件として修得すべき単位の全部又は一部として修得するものを除く。以下「共同教育課程」という。)を編成することができる。ただし、共同教育課程を編成する大学(以下「構成大学」という。)は、それぞれ当該共同教育課程に係る主要授業科目の一部を必修科目として自ら開設するものとする。
- Two or more universities may, when it is deemed necessary to achieve the educational purpose of said universities, faculties, and departments, organize curricula with the same contents (excluding curricula pertaining to correspondence education courses and curricula in which students acquire credits as the whole or part of credits to be acquired as graduation requirements by completing class subjects offered at faculties, departments or other organizations established by universities in foreign countries; hereinafter referred to as "inter-university curricula") at the respective universities, by deeming class subjects offered at one of these two or more universities to be part of curricula of other universities out of these two or more universities, notwithstanding the provision of Article 19, paragraph (1); provided, however, that universities that organize inter-university curricula (hereinafter referred to as "component universities") shall offer part of essential subjects pertaining to said inter-university curricula by themselves as their compulsory subjects, respectively.
