- When digging rights are rescinded pursuant to the provision of Article 55 and the applications for creation of mining rights for the minerals that occur in the same ore deposit where the minerals as the subject of the digging rights occur are filed within 60 days from the day of rescission, the Director of Regional Bureau of Economy, Trade and Industry shall not permit such applications for the areas that fall under the areas where the digging rights have been rescinded.

- In addition, the overflow of the Yura-gawa River caused on September 25, 1953 by typhoon No.13 in 1953 (twentieth year of the Showa period), resulting in a large volume of water with a floodmark as high as 7.8 m covering the entire urban area of Fukuchiyama, resulting in approximately 940 casualties including approximately 40 deaths, and at least 1,100 demolished and partially-destroyed houses, with at least 5,300 houses flooded above floor level.
- 収容定員がこの表の定める数を超える場合は、その超える収容定員に応じて四〇〇人につき教員三人(獣医学関係又は薬学関係(臨床に係る実践的な能力を培うことを主たる目的とするもの)にあつては、収容定員六〇〇人につき教員六人)の割合により算出される数の教員を増加するものとする(ロの表において同じ。)。

- Medical Services|(i) The applicant who intends to engage in duties as a physician, dentist, pharmacist, public health nurse, birthing assistant, registered nurse, assistant nurse, dental hygienist (shikaeiseishi), X-ray technician for medical examinations, physical therapist (rigakuryouhoushi), occupational therapist (sagyouryouhoushi), eye specialist (shinoukunrenshi), clinical technician (rinshoukougakugishi), or artificial limb technician (gishisougushi) must receive no less remuneration than would a Japanese national for comparable work.

- 附則第三条、第四条又は第六条第一項の規定によりその設定の出願をし、そ の設定の登録を得た鉱業権の鉱区とウラン鉱又はトリウム鉱と同種の鉱床中に存する鉱物を目的とする鉱業権の鉱区が重複する場合においては、鉱業権者は、そ の重複する部分において鉱物を掘採しようとするときは、他の鉱業権者と協議しなければならない。
- If a mining area, where an application for creation of mining right is filed pursuant to the provision of Article 3 or 4 or paragraph (1) of Article 6 of Supplementary Provisions and the creation is registered, overlaps another mining area, of which the mining right is aimed at minerals that occur in the same type of ore deposit as uranium ore or thorium ore, the holder of mining right, when he/she intends to mine minerals in the overlapped area, shall consult with the other holder of mining right.
- 試掘権者が試掘権の存 続期間中に、同種の鉱床中に存する鉱物について試掘鉱区に重複して採掘権の設定の出願をし、その許可を受けたときは、前二項の規定の適用については、その 重複する部分に限り、試掘権の設定又は試掘鉱区の増加による変更の登録があつた日に採掘権の設定又は採掘鉱区の増加による変更の登録があつたものとみな す。
- If a holder of prospecting right files an application for creation of digging right for minerals that occur in the same type of ore deposit in an overlapped part of his/her prospecting area during the period of duration of his/her prospecting right and is given approval for it, it shall be deemed, concerning the application of the provisions of paragraphs (1) and (2) above, that the registration of creation of digging right or that of changes thereof due to an increase of digging areas was made on the day when the registration of creation of prospecting right or that of changes thereof due to an increase of prospecting areas was made only for the overlapped part.
- 同種の鉱床中に存する鉱 物の採掘鉱区が隣接する場合において、鉱区の位置形状が鉱床の位置形状と相違し、その鉱区の位置形状を変更しなければその鉱床の完全な開発ができないとき は、採掘権者は、他の採掘権者に対し、鉱区の位置形状が鉱床の位置形状に合致するように、鉱区相互の間に鉱区の増減の出願をすることについて協議すること ができる。
- When the location and shape of a mining area are different from that of an ore deposit in the case where the digging areas of minerals that occur in the same type of ore deposit are adjacent to each other, and it is found that the ore deposit cannot be completely developed unless the location and shape of the mining area are changed, the holders of digging right concerned may consult with each other about applications for mutual increase or decrease of their mining areas to make the location and shape thereof agree with that of the ore deposit.
- 附則第三条、第四条又は第六 条第一項の規定により鉱業権の設定の出願をし、その設定の登録を得た者は、その鉱区がウラン鉱又はトリウム鉱と同種の鉱床中に存する鉱物を目的とする他人 の鉱区と重複するときは、その重複する部分については、鉱業法第五条の規定にかかわらず、ウラン鉱又はトリウム鉱以外の鉱物を掘採し、及び取得することが できない。
- As for a person who filed an application for creation of mining right pursuant to the provision of Article 3 or 4 or paragraph (1) of Article 6 of Supplementary Provisions and obtained the registration of creation, if his/her mining area overlaps other's mining area that is aimed at the minerals that occur in the same type of ore deposit as uranium ore or thorium ore, any mineral other than uranium ore or thorium ore may not be mined and acquired in the overlapped area notwithstanding the provision of Article 5 of the Mining Act.

- 経済産業局長は、同種の鉱床中に存する鉱物の採掘鉱区が隣接する場合 において、鉱区の位置形状が鉱床の位置形状と相違し、その鉱区の位置形状を変更しなければその鉱床の完全な開発ができないと認めるときは、当該採掘権者に 対し、鉱区の位置形状が鉱床の位置形状に合致するように、鉱区相互の間の鉱区の増減の出願について協議すべきことを勧告することができる。
- When the location and shape of a mining area are different from those of an ore deposit in the case where the digging areas of minerals that occur in the same type of ore deposit are adjacent to each other, and it is found that the ore deposit cannot be completely developed unless the location and shape of the mining area are changed, the Director of Regional Bureau of Economy, Trade and Industry may recommend that the holders of digging right concerned consult with each other about applications for mutual increase or decrease of their mining areas to make the location and shape thereof agree with that of the ore deposit.
- 異種の鉱床中に存す る鉱物の鉱区が重複するときは、その重複する部分について鉱業権の設定又は鉱区の増加による変更の登録を得た日が後である者は、その先である者の承諾を得 なければ、その部分において鉱物を掘採してはならない。但し、鉱業権の設定又は鉱区の増加による変更の登録を得た日が先である者は、正当な事由がなけれ ば、その承諾を拒むことができない。
- If mining areas of minerals that occur in different types of ore deposits are overlapped, the holder of mining right whose day of obtaining the registration of creation of mining right in the overlapped areas or that of changes thereof due to an increase of mining areas is later than that of the other holder of mining right, the holder may not mine any mineral in the overlapped areas unless he/she obtain consent from the other holder. However, the holder of mining right, whose day of obtaining the registration of creation of mining right or that of changes thereof due to an increase of mining areas is earlier than that of the other holder of mining right, may not refuse to give such approval without any justifiable grounds.
- 採掘鉱区がその目的とする鉱物と同種の鉱床中に存する鉱物の他人の鉱 区と隣接する場合において、鉱床の位置形状により隣接鉱区に掘進しなければその鉱床の完全な開発ができないときは、その隣接鉱区の鉱業権者及び抵当権者の 承諾を得て、鉱床を定めて、鉱区の増加の出願をすることができる。この場合において、鉱業権者及び抵当権者は、正当な事由がなければ、その承諾を拒むこと ができない。
- In the case where digging areas are adjacent to mining areas of others where the minerals as the subject of digging areas occur in the same type of ore deposit, if the ore deposit cannot be completely developed unless a heading is driven to the adjacent mining area due to the location and shape of ore deposit, an application for increase of mining areas may be filed by obtaining the approval of the holder of mining right and mortgagee of the adjacent mining area and specifying the ore deposit. In this case, the holder of mining right and mortgagee may not refuse to give such approval without any justifiable grounds.
- 試掘権の設定の出願をした者(以下「試掘出願人」という。)がその試 掘出願地と重複してその目的となつている鉱物と同種の鉱床中に存する鉱物を目的として採掘権の設定の出願をしたときは、その重複する部分については、試掘 権の設定の出願をしなかつたものとみなし、試掘権の設定の願書の発送の日時に採掘権の設定の出願をしたものとみなす。但し、前条第二項の場合においては、 この限りでない。
- When those who have filed applications for creation of prospecting rights (hereinafter referred to as 'prospecting applicant') have filed applications for creation of digging rights for the minerals that redundantly occur in the same type of ore deposit where the minerals of prospecting application areas occur, it shall be deemed that the applications for creation of prospecting rights have not been filed and that the applications for creation of digging rights have been filed on the date and time of sending applications for creation of prospecting rights. However, this shall not apply to the case specified in paragraph (2) of the preceding Article.
- 経済産業局長は、試 掘権がその存続期間の満了前に消滅し、又は試掘鉱区の減少があつた場合において、その消滅又は試掘鉱区の減少の日から六十日以内(試掘権の残存すべき期間 又は残存する期間が六十日に満たないときは、その期間内)に、その試掘権の目的となつていた鉱物と同種の鉱床中に存する鉱物を目的とする試掘権の設定の出 願があつたときは、その消滅した試掘権の鉱区に該当する部分又は試掘鉱区の減少した部分に該当する部分については、その出願を許可してはならない。
- When prospecting rights have become extinct before the expiration of their duration or prospecting areas have decreased, and applications for creation of prospecting rights for the minerals that occur in the same type of ore deposit where the minerals as the subject of the prospecting rights occur are filed within 60 days from the day of extinction of prospecting rights or decrease of prospecting areas (if the period of prospecting rights to remain is less than 60 days, such remaining period shall be applied), the Director of Regional Bureau of Economy, Trade and Industry shall not permit such applications for the areas that fall under the mining areas where the prospecting rights have become extinct or the prospecting areas that have decreased.
- 附則第三条若しくは第四条の 規定による鉱業権の設定の出願に係る掘採区域若しくは権利を行使することができる土地の区域又は附則第三条、第四条若しくは前条第一項の規定によりその設 定の出願をし、その設定の登録を得た鉱業権の鉱区と重複し、かつ、同種の鉱床中に存する鉱物を目的とする試掘鉱区の試掘権者がその重複する部分と重複して 試掘権の目的となつている鉱物を目的とする採掘権の設定の出願をしたときは、その重複する部分については、鉱業法第十六条及び第三十条の規定は、適用しな い。
- If a holder of prospecting right, who is in the digging area involved in the application for mining right pursuant to the provision of Article 3 or 4 of Supplementary Provisions or in the area of land where the right can be exercised, or in the prospecting area that overlaps the mining area where he/she filed an application for creation of mining right pursuant to the provision of Article 3 or 4 of Supplementary Provisions or that of paragraph (1) of the preceding Article and made registration of the said right and that is aimed at the minerals occurring in the same type of ore deposit as the subject of prospecting right, filed an application for creation of digging right for the minerals as the subject of prospecting right redundantly in the overlapped area, the provisions of Articles 16 and 30 of the Mining Act shall not apply to the overlapped area.
- 第一項の規定により歯科医業をする場合における歯科医師相当衛生要員等は、歯科医師とみなして、保健師助産師看護師法第六条及び第三十七条、歯科衛生士法第二条第一項、第十三条の二及び第十三条の三、診療放射線技師法第二条第二項、第二十四条の二、第二十六条及び第二十八条第一項、歯科技工士法(昭和三十年法律第百六十八号)第二条第一項ただし書及び第十八条ただし書、臨床検査技師等に関する法律第二条及び第二十条の二並びに薬剤師法第十九条及び第二十二条から第二十四条までの規定を適用する。
- In case of conducting dental practice pursuant to the provision of paragraph (1), the medical personnel, etc. correspondent to dental practitioners shall be deemed to be dentists and shall be applied provisions of Article 6 and Article 37 of the Act on Public Health Nurses, Midwives and Nurses, paragraph (1) of Article 2, Article 13-2 and Article 13-3 of the Dental Hygienists Act, paragraph (2) of Article 2, Article 24-2, Article 26 and paragraph (1) of Article 28 of the Act on Medical Radiology Technicians, paragraph (1) of Article 2 proviso and Article 18 proviso of the Dental Technicians Act (Act No. 168 of 1955), Act Article 2 and Article 20-2 of the Act on Clinical Laboratory Technicians and Article 19 and Article 22 through Article 24 of the Pharmacists Act.
- 『十訓抄』7-27には、若い頃の清盛について「人がとんでもない不都合な振る舞いをしても、冗談と思うことにした」「やったことがちっともおかしくなくても、相手への労わりとしてにこやかに笑い、とんでもない誤りをしても、役立たずと声を荒げることはない」「冬の寒い時に身辺に奉仕する幼い従者を自分の衣の裾の方に寝かせ、彼らが朝寝坊をしていたらそっと床から抜け出して存分に寝かせてやった」「最下層の召使いでも、彼の家族や知り合いの見ている前では一人前の人物として扱ったので、その者は大変な面目と感じて心から喜んだ」という逸話が記されている。
- In 'Jukkinsho' Section 7-27, the young Kiyomori was described as a person who 'thought it was a joke if someone did something quite unreasonable,' 'gently smiled to be kind to someone who did something that was not funny at all, and also never raised his voice to scorn someone as being useless even when that person had made a terrible mistake', 'let young attendants who served him during a cold winter sleep at the bottom of his clothes and let them sleep well if they overslept, by quietly getting out of the bed,' and 'respected a servant of the lowest rank as a person in front of the servant's family or acquaintances, and that servant was truly pleased as it was a great honor.'
- 大規模小売店舗の新設(建物の床面積を変更し、又は既存の建物の全部若しくは一部の用途を変更することにより大規模小売店舗となる場合を含む。以下同じ。)をする者(小売業を行うための店舗以外の用に供し又は供させるためその建物の一部の新設をする者があるときはその者を除くものとし、小売業を行うための店舗の用に供し又は供させるためその建物の一部を新設する者又は設置している者があるときはその者を含む。以下同じ。)は、政令で定めるところにより、次の事項を当該大規模小売店舗の所在地の属する都道府県(以下単に「都道府県」という。)に届け出なければならない。
- A person establishing a new large-scale retail store (including cases where a large-scale retail store is newly established as a result of a change to the floor area of the building or a change to the whole or a part of the usage of the existing building; the same shall apply hereinafter) (excluding a person who newly establishes a part of the building for the purpose of using or having others use the space for purposes other than for stores to conduct retail business, but including a person who newly establishes or has already established a part of the building for the purpose of using or having others use the space for stores to conduct retail business; the same shall apply hereinafter) shall make a notification concerning the following matters to the prefecture where said large-scale retail store is located (hereinafter simply referred to as the 'prefecture'), pursuant to the provisions of a Cabinet Order:
- この条以下において「鉱物」とは、金鉱、銀鉱、銅鉱、鉛鉱、そう鉛鉱、す ず鉱、アンチモニー鉱、水銀鉱、亜鉛鉱、鉄鉱、硫化鉄鉱、クローム鉄鉱、マンガン鉱、タングステン鉱、モリブデン鉱、ひ鉱、ニツケル鉱、コバルト鉱、ウラ ン鉱、トリウム鉱、りん鉱、黒鉛、石炭、亜炭、石油、アスフアルト、可燃性天然ガス、硫黄、石こう、重晶石、明ばん石、ほたる石、石綿、石灰石、ドロマイ ト、けい石、長石、ろう石、滑石、耐火粘土(ゼーゲルコーン番号三十一以上の耐火度を有するものに限る。以下同じ。)及び砂鉱(砂金、砂鉄、砂すずその他 ちゆう積鉱床をなす金属鉱をいう。以下同じ。)をいう。
- The term 'mineral' as used in the following Articles of this Act shall mean gold ore, silver ore, copper ore, lead ore, bismuth ore, tin ore, antimony ore, mercury ore, zinc ore, iron ore, iron sulfide ore, chrome iron ore, manganese ore, tungsten ore, molybdenum ore, arsenic ore, nickel ore, cobalt ore, uranium ore, thorium ore, phosphate ore, graphite, coal, lignite, oil, asphalt, combustible natural gas, sulfur, gypsum, barites, alunite, fluorine, asbestos, limestone, dolomite, silica, feldspar, agalmatolite, talc, fireclay (limited to those that have fire resistance of Seger cone number 31 or higher; the same shall apply hereinafter), and placer (alluvial gold, iron sand, stream tin and other metallic ores that constitute alluvial deposits; the same shall apply herein after).
- 第一項の規定により医業をする場合における医師相当衛生要員等は、医師とみなして、保健師助産師看護師法(昭和二十三年法律第二百三号)第六条及び第三十七条、歯科衛生士法(昭和二十三年法律第二百四号)第十三条の三、診療放射線技師法(昭和二十六年法律第二百二十六号)第二条第二項、第二十四条の二、第二十六条及び第二十八条第一項、臨床検査技師等に関する法律(昭和三十三年法律第七十六号)第二条及び第二十条の二、薬剤師法(昭和三十五年法律第百四十六号)第十九条及び第二十二条から第二十四条まで並びに臨床工学技士法(昭和六十二年法律第六十号)第二条第二項及び第三十八条の規定を適用する。
- In case of conducting medical practices pursuant to the provision of paragraph (1), the medical personnel, etc. correspondent to physicians shall be deemed to be a physician, and shall be applied the provisions of Article 6 and Article 37 of the Act on Public Health Nurses, Midwives and Nurses (Act No. 203 of 1948), Article 13-3 of the Dental Hygienists Act (Act No. 204 of 1948), paragraph (2) of Article 2, Article 24-2, Article 26 and paragraph (1) of Article 28 of the Act on Medical Radiology Technicians (Act No. 226 of 1951), Article 2 and Article 20-2 of the Act on Clinical Laboratory Technicians (Act No.76 of 1958), Article 19 and Article 22 through Article 24 of the Pharmacists Act (Act No. 146 of 1960) and paragraph (2) of Article 2 and Article 38 of the Clinical Engineers Act (Act No. 60 of 1987).
