- 第三十九条第一項に規定する業務を目的とする施設(少数の乳児又は幼児を対象とするものその他の厚生労働省令で定めるものを除く。)であつて第三十五条第四項の認可を受けていないもの(第五十八条の規定により児童福祉施設の認可を取り消されたものを含む。)については、その施設の設置者は、その事業の開始の日(同条の規定により児童福祉施設の認可を取り消された施設にあつては、当該認可の取消しの日)から一月以内に、次に掲げる事項を都道府県知事に届け出なければならない。
- With regard to an institution intended for the services provided in Article 39 paragraph (1) (excluding institutions targeting a small number of infants or toddlers and other facilities as specified by an Ordinance of the Ministry of Health, Labour and Welfare) for which the approval set forth in Article 35 paragraph (4) has not been obtained (including institutions for which the approval as a child welfare institution has been rescinded pursuant to the provision of Article 58), the establisher of the institution shall notify the prefectural governor of the matters listed in the following items within 1 month from the date of commencement of its services (or from the date of rescission of the approval, in the case of a child welfare institution for which the approval has been rescinded pursuant to the provision of Article 58):
- 第六条、第八条、第十条、第十一条第一項及び第二項、第十六条から第二十条まで、第二十五条から第五十六条まで並びに第五十八条から第六十条までの規定は、乳幼児が接触することによりその健康を損なうおそれがあるものとして厚生労働大臣の指定するおもちやについて、これを準用する。この場合において、第十条中「添加物(天然香料及び一般に食品として飲食に供されている物であつて添加物として使用されるものを除く。)」とあるのは、「おもちやの添加物として用いることを目的とする化学的合成品(化学的手段により元素又は化合物に分解反応以外の化学的反応を起こさせて得られた物質をいう。)」と読み替えるものとする。
- The provisions of Article 6, Article 8, Article 10, Article 11, paragraphs (1) and (2), Articles 16 to 20, Articles 25 to 56, and Articles 58 to 60 shall apply mutatis mutandis to toys designated by the Minister of Health, Labour and Welfare as those likely to harm the health of infants when they touch such toys. In this case, the term "Additives (excluding natural flavoring agents and articles that have generally been served for human consumption and are used as additives)" in Article 10 shall be deemed to be replaced with "Chemically synthesized compounds (meaning substances obtained by causing a chemical reaction other than a degradation reaction to elements or compounds by chemical means) intended to be used as additives for toys."
