- 第一項第二号、第三号又は第五号に掲げる市街地開発事業については、第十二条の三第一項の規定により定められる場合を除き、これらの事業に関する法律(新住宅市街地開発法第四十五条第一項を除く。)において施行者として定められている者のうちから、当該市街地開発事業の施行予定者を都市計画に定めることができる。

- In a case when a Municipality applies the provisions as prescribed in the following items to a Long-Term Care Benefit as listed in said items received by an Insured Person Requiring Long-Term Care for whom it is deemed difficult to pay the necessary expenses for In-Home Service (including equivalent services), Community-Based Service (including equivalent services), Facility Service, or a Home Modification due to disaster or other special reason as determined by an Ordinance of the Ministry of Health, Labour, and Welfare, the term "90 percent" in the referenced provisions shall be deemed to be replaced with "the percentage determined by the Municipality within the range of more than 90 percent to 100 percent or less":
- まちづくりの推進を図る活動を行うことを目的とする特定非営利活動促進法(平成十年法律第七号)第二条第二項の特定非営利活動法人、一般社団法人若しくは一般財団法人その他の営利を目的としない法人、独立行政法人都市再生機構、地方住宅供給公社若しくはまちづくりの推進に関し経験と知識を有するものとして国土交通省令で定める団体又はこれらに準ずるものとして地方公共団体の条例で定める団体は、前項に規定する土地の区域について、都道府県又は市町村に対し、都市計画の決定又は変更をすることを提案することができる。同項後段の規定は、この場合について準用する。

The second sentence of the same paragraph shall apply mutatis mutandis to these cases.

- In cases of development activities other than development activities carried out with the primary purpose of building residences for own private dwelling, roads, parks, open spaces and other vacant spaces for public use (including reservoir facilities intended for fire service which are built in case it is difficult to secure sufficient water for fire service otherwise) shall be of scale and structure that will cause no inconvenience from the viewpoints of environmental preservation, disaster prevention, traffic safety and the efficiency of business activities considering the following items and shall be properly located; and main roads in development areas shall be designed so as to connect with considerably large roads outside of the development areas. In this case, if city plans relating to the relevant vacant spaces have been established, the design shall be in conformance with it.
- 第一項の規定による届出をした者(届出をした者と当該届出に係る建築物の管理者が異なる場合にあつては管理者とし、当該建築物が譲り渡された場合にあつては譲り受けた者(譲り受けた者と当該建築物の管理者が異なる場合にあつては管理者)とする。)は、国土交通省令で定めるところにより、定期に、その届出に係る事項(当該建築物の設計及び施工に係る事項のうち当該建築物に設ける空気調和設備等に係るエネルギーの効率的利用のための措置に関するものに限る。)に関する当該建築物の維持保全の状況について、所管行政庁に報告しなければならない。ただし、同項の届出に係る建築物が住宅である場合は、この限りでない。
- A person who made a notification pursuant to the provision of paragraph (1) (if the person who has made a notification is not the manager of the building pertaining to said notification, the manager; or if said building has been assigned to another person, the assignee (if the building has been assigned to a person other than the manager of the building, the manager)) shall, pursuant to the provision of an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism, periodically report to the administrative agency with jurisdiction the status of maintenance of said building with respect to the matters pertaining to the notification (limited to those concerning measures to realize the efficient utilization of energy for air conditioning systems, etc. installed in said building with respect to designing and construction of said building); provided, however, that this shall not apply to the case where a building pertaining to the notification prescribed in the same paragraph is a residence.
- 第一種特定建築物以外の特定建築物(以下「第二種特定建築物」という。)の新築(住宅事業建築主が第二種特定建築物である特定住宅を新築する場合を除く。)若しくは政令で定める規模以上の改築又は建築物の政令で定める規模以上の増築(前条第一項第一号に規定する増築を除く。)をしようとする者(以下「第二種特定建築主」という。)は、国土交通省令で定めるところにより、当該建築物の設計及び施工に係る事項のうち当該建築物の外壁、窓等を通しての熱の損失の防止及び当該建築物に設ける空気調和設備等に係るエネルギーの効率的利用のための措置に関するものを所管行政庁に届け出なければならない。これを変更しようとするときも、同様とする。
- A person who intends to construct a new specified building other than a Type 1 specified building (hereinafter referred to as a 'Type 2 specified building') (excluding the cases where a residential construction client constructs a new specified residence categorized as a Type 2 specified building), or reconstruct a building beyond the size specified by a Cabinet Order or extend a building beyond the scale specified by a Cabinet Order (excluding the extension prescribed in paragraph (1), item (i) of the preceding Article) (such person shall hereinafter be referred to as a 'Type 2 specified construction client') shall, pursuant to the provision of an Ordinance of the Ministry of Land, Infrastructure, Transport and Tourism, notify the administrative agency with jurisdiction of the measures to prevent heat loss through exterior walls, windows, etc. of said building and to realize the efficient utilization of energy for air conditioning systems, etc. installed in said building with respect to the matters concerning designing and construction of said building. The same shall apply where such person intends to revise the measures.
- 前条第一項から第五項までに定めるもののほか、国は、必要があると認めるときは、国有財産法第十八条第一項の規定にかかわらず、特定施設(第二条第一項第三号及び第四号に掲げる施設(公営住宅を除く。以下この項において「第三号及び第四号施設」という。)並びに同条第一項第五号の政令で定める施設のうち第三号及び第四号施設に準ずるものとして政令で定めるものをいう。以下この条において同じ。)の設置の事業であって、選定事業の実施に資すると認められるもの(以下この条において「特定民間事業」という。)の用に供するため、行政財産を、その用途又は目的を妨げない限度において、当該特定民間事業を行う選定事業者に貸し付けることができる。
- In addition to leases prescribed in paragraphs (1) to (5) inclusive of the preceding article, the national government may, when it finds necessary, lease an administrative asset to be used for a project to establish a Specified Facility (meaning a facility which fall within facilities listed the items (iii) and (iv) of paragraph (1) of Article 2 (excluding public housings) (hereinafter referred to as 'Item 3 and 4 Facilities' in this article) and facilities specified by the relevant Cabinet Order as assets equivalent to Item 3 and 4 Facilities among assets set forth in item (v) of paragraph (1) of the same article; hereinafter the same shall apply in this article) that is useful for the implementation of the relevant Selected Project (hereinafter referred to as a 'Qualified Private Project' in this article) to the Appointed Business Operator who implements the Specified Private Project, notwithstanding the provision of paragraph (1) of Article 18 of the National Property Act to the extent that the lease does not prevent the original use or purpose of the asset.
- 沿道地区計画は、道路交通騒音により生ずる障害を防止するとともに、適正かつ合理的な土地利用が図られるように定めること。この場合において、沿道再開発等促進区(幹線道路の沿道の整備に関する法律第九条第三項の規定による沿道再開発等促進区をいう。以下同じ。)を定める沿道地区計画については、土地の合理的かつ健全な高度利用と都市機能の増進とが図られることを目途として、一体的かつ総合的な市街地の再開発又は開発整備が実施されることとなるように定めることとし、そのうち第一種低層住居専用地域及び第二種低層住居専用地域におけるものについては、沿道再開発等促進区の周辺の低層住宅に係る良好な住居の環境の保護に支障がないように定めること。
- Roadside district plans shall be stipulated in order to prevent nuisances arising from road traffic noise and to promote adequate and reasonable land use. In such cases, regarding roadside district plans that stipulate roadside redevelopment promotion areas (i.e., roadside redevelopment promotion areas provided for in paragraph (3), Article 9 of the Act Concerning the Improvement of the Areas along Trunk Roads; he same shall apply hereinafter), plans, aiming to promote reasonable and sound high-level use of land and the renewal of urban functions, shall be stipulated in a manner that allows for the implementation of uniform and comprehensive redevelopment or development improvement of urban areas, of which those plans for category 2 low-rise exclusive residential districts shall be stipulated to ensure that the protection of the favorable dwelling environment pertaining to low-rise housing around roadside redevelopment promotion areas is not hindered.
- 第一項の規定により給付額減額等の記載を受けた要介護被保険者等が、当該記載を受けた日の属する月の翌月の初日から当該給付額減額期間が経過するまでの間に利用した居宅サービス(これに相当するサービスを含む。次項において同じ。)、地域密着型サービス(これに相当するサービスを含む。次項において同じ。)、施設サービス、介護予防サービス(これに相当するサービスを含む。次項において同じ。)及び地域密着型介護予防サービス(これに相当するサービスを含む。次項において同じ。)並びに行った住宅改修に係る次の各号に掲げる介護給付等について当該各号に定める規定を適用する場合においては、これらの規定中「百分の九十」とあるのは、「百分の七十」とする。
