- 年金保険者は、毎年厚生労働省令で定める期日までに、当該年の四月二日から六月一日までの間に次の各号のいずれかに該当するに至った者(当該年の三月一日から四月一日までの間に第一号に該当するに至った者であって、当該年の四月一日現在において当該年金保険者から老齢等年金給付の支払を受けていないものを含み、当該年の八月一日から翌年の五月三十一日までの間に支払を受けるべき当該老齢等年金給付の額の総額を基礎として厚生労働省令で定めるところにより算定した年金額の見込額が、当該年の六月一日の現況において政令で定める額未満である者及び前項第二号に該当する者を除く。)の氏名、住所その他厚生労働省令で定める事項を、その者が当該年の六月一日現在において住所を有する市町村に通知しなければならない。
- A Pension Insurer shall provide notice of the name, domicile and other circumstances as determined by an Ordinance of the Ministry of Health, Labour, and Welfare of a person that is defined by any of the following items from April 2 to June 1 of said year (including a person who is defined by item (i) during the period from March 1 to April 1 of said year that has not yet received the payment of an Old Age, etc., Pension Benefit from said Pension Insurer as of April 1 of said year, and excluding a person whose prospective amount of pension benefit that is calculated pursuant to the provisions of an Ordinance of the Ministry of Health, Labour, and Welfare based on the total amount of said Old Age, etc., Pension Benefit to be received during the period from August 1 of said year to May 31 of the following year is less than the amount determined by a Cabinet Order as of June 1 of said year, and a person that corresponds to item (ii) of the preceding paragraph) by the due date as determined by an Ordinance of the Ministry of Health, Labour, and Welfare every year to the Municipality where said person is domiciled as of June 1 of said year:
- この条約が日本国と当該連合国との間に効力を生じた後九箇月以内に申請があつたときは、日本国は、申請の日から六箇月以内に、日本国にある各連合国及びその国民の有体財産及び無体財産並びに種類のいかんを問わずすべての権利又は利益で、千九百四十一年十二月七日から千九百四十五年九月二日までの間のいずれかの時に日本国内にあつたものを返還する。但し、所有者が強迫又は詐欺によることなく自由にこれらを処分した場合は、この限りではない。この財産は、戦争があつたために課せられたすべての負担及び課金を免除して、その返還のための課金を課さずに返還しなければならない。所有者により若しくは所有者のために又は所有者の政府により所定の期間内に返還が申請されない財産は、日本国政府がその定めるところに従つて処分することができる。この財産が千九百四十一年十二月七日に日本国に所在し、且つ、返還することができず、又は戦争の結果として損傷若しくは損害を受けている場合には、日本国内閣が千九百五十一年七月十三日に決定した連合国財産補償法案の定める条件よりも不利でない条件で補償される。
- Upon application made within nine months of the coming into force of the present Treaty between Japan and the Allied Power concerned, Japan will, within six months of the date of such application, return the property, tangible and intangible, and all rights or interests of any kind in Japan of each Allied Power and its nationals which was within Japan at any time between December 7, 1941, and September 2, 1945, unless the owner has freely disposed thereof without duress or fraud. Such property shall be returned free of all encumbrances and charges to which it may have become subject because of the war, and without any charges for its return. Property whose return is not applied for by or on behalf of the owner or by his Government within the prescribed period may be disposed of by the Japanese Government as it may determine. In cases where such property was within Japan on December 7, 1941, and cannot be returned or has suffered injury or damage as a result of the war, compensation will be made on terms not less favorable than the terms provided in the draft Allied Powers Property Compensation Law approved by the Japanese Cabinet on July 13, 1951.
- 特許出願人は、特許出願の日(第四十一条第一項の規定による優先権 の主張を伴う特許出願にあつては、同項に規定する先の出願の日、第四十三条第一項又は第四十三条の二第一項若しくは第二項の規定による優先権の主張を伴う 特許出願にあつては、最初の出願若しくはパリ条約(千九百年十二月十四日にブラッセルで、千九百十一年六月二日にワシントンで、千九百二十五年十一月六日 にヘーグで、千九百三十四年六月二日にロンドンで、千九百五十八年十月三十一日にリスボンで及び千九百六十七年七月十四日にストックホルムで改正された工 業所有権の保護に関する千八百八十三年三月二十日のパリ条約をいう。以下同じ。)第四条C(4)の規定により最初の出願とみなされた出願又は同条A(2) の規定により最初の出願と認められた出願の日、第四十一条第一項、第四十三条第一項又は第四十三条の二第一項若しくは第二項の規定による二以上の優先権の 主張を伴う特許出願にあつては、当該優先権の主張の基礎とした出願の日のうち最先の日。第三十六条の二第二項本文及び第六十四条第一項において同じ。)か ら一年三月以内(出願公開の請求があつた後を除く。)に限り、願書に添付した要約書について補正をすることができる。
- An applicant for a patent may amend the abstract attached to the application within one year and three months (excluding the period after a request for laying open of application is filed) from the filing date of the patent application (or in the case of a patent application containing a priority claim under Article 41(1), the filing date of the earlier application provided for in the said paragraph, in the case of a patent application containing a priority claim under Article 43(1), 43-2(1) or 43-2(2), the filing date of the earliest application, a patent application that is deemed to be the earliest application under Article 4.C(4) of the Paris Convention (refers to the Paris Convention for the Protection of Industrial Property of March 20, 1883, as revised at Brussels on December 14, 1900, at Washington on June 2, 1911, at Hague on November 6, 1925, at London on June 2, 1934, at Lisbon on October 31, 1958, and at Stockholm on July 14, 1967, the same shall apply hereinafter) or a patent application that is recognized as the earliest application under Article 4.A(2) of the Paris Convention, and in the case of a patent application containing two or more priority claims under Article 41(1), 43(1), 43-2(1) or 43-2(2), the earliest day of the filing dates on which the said priority claims are based, the same shall apply to the main clause of Article 36-2(2) and Article 64(1)).
- 意匠登録出願人は、自己の意匠登録出願に係る意匠又は自己の登録意匠のうちから選択した一の意匠(以下「本意匠」という。)に類似する意匠(以下「関連意匠」という。)については、当該関連意匠の意匠登録出願の日(第十五条において準用する特許法(昭和三十四年法律第百二十一号)第四十三条第一項又は第四十三条の二第一項若しくは第二項の規定による優先権の主張を伴う意匠登録出願にあつては、最初の出願若しくは千九百年十二月十四日にブラッセルで、千九百十一年六月二日にワシントンで、千九百二十五年十一月六日にヘーグで、千九百三十四年六月二日にロンドンで、千九百五十八年十月三十一日にリスボンで及び千九百六十七年七月十四日にストックホルムで改正された工業所有権の保護に関する千八百八十三年三月二十日のパリ条約第四条C(4)の規定により最初の出願とみなされた出願又は同条A(2)の規定により最初の出願と認められた出願の日。以下この項において同じ。)がその本意匠の意匠登録出願の日以後であつて、第二十条第三項の規定によりその本意匠の意匠登録出願が掲載された意匠公報(同条第四項の規定により同条第三項第四号に掲げる事項が掲載されたものを除く。)の発行の日前である場合に限り、第九条第一項又は第二項の規定にかかわらず、意匠登録を受けることができる。
- Notwithstanding Article 9(1) or (2), an applicant for design registration may obtain design registration of a design that is similar to another design selected from the applicant's own designs either for which an application for design registration has been filed or for which design registration has been granted (hereinafter the selected design is referred to as the 'Principal Design' and a design similar to it is referred to as a 'Related Design'), if the filing date of the application for design registration of the Related Design (or when the application for design registration of the Related Design contains a priority claim under Article 43(1), 43-2(1) or 43-2(2) of the Patent Act (Act No. 121 of 1959) as applied mutatis mutandis under Article 15 of this Act, the filing date of the earliest application, the filing date of an application that is deemed to be the earliest application under Article 4.C(4) of the Paris Convention for the Protection of Industrial Property of March 20, 1883, as revised at Brussels on December 14, 1900, at Washington on June 2, 1911, at Hague on November 6, 1925, at London on June 2, 1934, at Lisbon on October 31, 1958, and at Stockholm on July 14, 1967, or the filing date of an application that is recognized as the earliest application under Article 4.(A)2 of the Paris Convention, hereinafter the same shall apply in this paragraph) is on or after the filing date of the application for design registration of the Principal Design and before the date when the design bulletin in which the application for design registration of the Principal Design is published under Article 20(3) (except for a design bulletin in which the matters listed in Article 20(3)(iv) were published under Article 20(4)) is issued.
