- In cases where a person alleging that his right was infringed by distribution of information via a specified telecommunications filed a petition that said specified telecommunications service provider take measures to prevent said information infringing his right (hereinafter referred to as 'infringing information') from being transmitted (hereinafter in this item referred to as 'transmission prevention measures'), indicating the infringing information and the allegedly infringed right and the reason why said person insists on said infringement (hereinafter in this item referred to as 'infringing information, etc.') and where said specified telecommunications service provider provided such infringing information, etc. to the sender of said infringing information and inquired the sender if said sender agrees with implementing said transmission prevention measures, where said specified telecommunications service provider has not received any notice from said sender indicating his disagreement with implementation of said transmission prevention measures after seven days from the day of said inquiry to said sender.

- 刑事施設の長は、刑法第二十八条(国際受刑者移送法第二十一条において読み替えて適用する場合を含む。)、少年法第五十八条又は国際受刑者移送法第二十二条の規定により仮釈放を許すことができる期間を経過した懲役受刑者又は禁錮受刑者が、第八十八条第二項の規定により開放的施設において処遇を受けていることその他の法務省令で定める事由に該当する場合において、その円滑な社会復帰を図るため、刑事施設の外において、その者が、釈放後の住居又は就業先の確保その他の一身上の重要な用務を行い、更生保護に関係のある者を訪問し、その他その釈放後の社会生活に有用な体験をする必要があると認めるときは、刑事施設の職員の同行なしに、外出し、又は七日以内の期間を定めて外泊することを許すことができる。ただし、外泊については、その受刑者に係る刑が六月以上執行されている場合に限る。
- In cases where either a person sentenced to imprisonment with work or a person sentenced to imprisonment without work has served the period of time for parole qualification pursuant to the provisions of Article 28 of the Penal Code (including the cases where it is applied by replacing the terms pursuant to Article 21 of the Act on the Transnational Transfer of Sentenced Persons), Article 58 of the Juvenile Code, or Article 22 of the Act on the Transnational Transfer of Sentenced Persons, and falls under cases specified by a Ministry of Justice Ordinance, such as being placed in an open-type institution pursuant to the provision of paragraph (2) of Article 88, if it is deemed necessary that the sentenced person, for smooth re-entry to society, go outside the penal institution to settle important personal matters such as securement of his/her residence and employer following release, visit people relevant to his/her rehabilitation and to the guardianship thereof, or acquire other useful experience for life in society following his/her release, then the warden of the penal institution may permit him/her a day leave or a furlough for a definite period within seven days without an escort of staff members of the penal institution. However, the furlough shall be limited to the cases where a sentenced person has been serving for not less than six months.
- 販売業者は、売買契約の申込みを受けた場合におけるその申込みをした 者及び売買契約を締結した場合におけるその購入者(以下この項において「申込者等」という。)以外の者に対して売買契約の申込みをし、かつ、その申込みに 係る商品を送付した場合又は申込者等に対してその売買契約に係る商品以外の商品につき売買契約の申込みをし、かつ、その申込みに係る商品を送付した場合に おいて、その商品の送付があつた日から起算して十四日を経過する日(その日が、その商品の送付を受けた者が販売業者に対してその商品の引取りの請求をした 場合におけるその請求の日から起算して七日を経過する日後であるときは、その七日を経過する日)までに、その商品の送付を受けた者がその申込みにつき承諾 をせず、かつ、販売業者がその商品の引取りをしないときは、その送付した商品の返還を請求することができない。
- Where a seller makes an application for a sales contract and sends goods pertaining to such application to a person other than the person who made an application for a sales contract in the case the seller has received such application or the purchaser in the case the seller has concluded a sales contract (hereinafter referred to as the 'Purchasing Party' in this paragraph) or makes to the Purchasing Party an application for a sales contract on goods other than the goods pertaining to the relevant sales contract and sends the goods pertaining to such application to the Purchasing Party, the seller may not claim return of the sent goods if the person who received the sent goods does not consent to accepting the application and the seller does not take back the goods before the day on which 14 days have passed from the date of sending the goods (if the person who received the sent goods has requested the seller to take back such goods, and said day comes after the day on which seven days have passed from the date of such request, it shall be the day on which seven days have passed from the date of the request).
- この省令は、平成十二年七月七日から施行する。ただし、第一条第八号、第九号、第十一号、第十四号、第十八号、第二十一号、第二十二号、第二十四号イ及びハ、第二十七号及び第三十三号の改正規定、同条第三十四号の改正規定(同号イ(一)及びロ(一)中「七五ミリメートル以上の」を「七五ミリメートルを超える」に改める部分に限る。)、同条第三十五号、第三十六号、第三十八号、第四十号、第四十四号並びに第五十七号、第三条第七号ホ、第十六号イ及びト、第二十号並びに第二十二号の改正規定、第六条第一号の改正規定(同号ハ(三)中「並列プロセッサ」を「並列プロセッサ用に設計したもの」に改める部分を除く。)、同条第二号ロ、第四号及び第八号、第七条、第八条、第九条第一号イ、第十二条、第十三条第五項、第十四条第五号並びに第六号イ及びニ、第十四条の二第七十四号、第十九条、第二十条並びに第二十一条の改正規定並びに第二十五条の改正規定(同条第三項第二号中ヌを削り、ルをヌとし、ヲをルとする部分に限る。)は、公布の日から施行する。
- This Ordinance of the Ministry shall come into effect as from July 7, 2000; provided, however, that the following shall come into effect as from the date of promulgation: the revised provisions of Article 1, item (viii), item (ix), item (xi), item (xiv), item (xviii), item (xxi), item (xxii), item (xxiv), (a) and (c), item (xxvii) and item (xxxiii); the revised provisions of item (xxxiv) of the same Article (limited to the part in which 'those that are 75 millimeters or more' in (a), 1. and (b), 2. of the same item is revised to 'those that exceed 75 millimeters'); the revised provisions of item (xxxv), item (xxxvi), item (xxxviii), item (xl), item (xliv) and also item (lvii) of the same Article, Article 3, item (vii), (e), item (xvi), (a) and (g), item (xx) and item (xxii); the revised provisions of Article 6, item (i) (excluding the part in which 'parallel processors' in (c), 3. of the same item is revised to 'devices designed for parallel processors'); and the revised provisions of item (ii), (b), item (iv) and item (viii) of the same Article, Article 7, Article 8, Article 9, item (i), (a), Article 12, Article 13, item (v), Article 14, item (v) and item (vi), (a) and (d), Article 14-2, item (lxxiv), Article 19, Article 20 and Article 21; and the revised provisions of Article 25 (limited to the part in which paragraph (3), item (ii), (j) of the same Article is deleted and (k) is changed to (j) and (l) is changed to (k))
- この条約が日本国と当該連合国との間に効力を生じた後九箇月以内に申請があつたときは、日本国は、申請の日から六箇月以内に、日本国にある各連合国及びその国民の有体財産及び無体財産並びに種類のいかんを問わずすべての権利又は利益で、千九百四十一年十二月七日から千九百四十五年九月二日までの間のいずれかの時に日本国内にあつたものを返還する。但し、所有者が強迫又は詐欺によることなく自由にこれらを処分した場合は、この限りではない。この財産は、戦争があつたために課せられたすべての負担及び課金を免除して、その返還のための課金を課さずに返還しなければならない。所有者により若しくは所有者のために又は所有者の政府により所定の期間内に返還が申請されない財産は、日本国政府がその定めるところに従つて処分することができる。この財産が千九百四十一年十二月七日に日本国に所在し、且つ、返還することができず、又は戦争の結果として損傷若しくは損害を受けている場合には、日本国内閣が千九百五十一年七月十三日に決定した連合国財産補償法案の定める条件よりも不利でない条件で補償される。
- Upon application made within nine months of the coming into force of the present Treaty between Japan and the Allied Power concerned, Japan will, within six months of the date of such application, return the property, tangible and intangible, and all rights or interests of any kind in Japan of each Allied Power and its nationals which was within Japan at any time between December 7, 1941, and September 2, 1945, unless the owner has freely disposed thereof without duress or fraud. Such property shall be returned free of all encumbrances and charges to which it may have become subject because of the war, and without any charges for its return. Property whose return is not applied for by or on behalf of the owner or by his Government within the prescribed period may be disposed of by the Japanese Government as it may determine. In cases where such property was within Japan on December 7, 1941, and cannot be returned or has suffered injury or damage as a result of the war, compensation will be made on terms not less favorable than the terms provided in the draft Allied Powers Property Compensation Law approved by the Japanese Cabinet on July 13, 1951.
- 消防長又は消防署長は、前項の規定によつて同意を求められた場合において、当該建築物の計画が法律又はこれに基づく命令若しくは条例の規定(建築基準法第六条第四項又は第六条の二第一項(同法第八十七条第一項の規定によりこれらの規定を準用する場合を含む。)の規定により建築主事又は指定確認検査機関が同法第六条の三第一項第一号若しくは第二号に掲げる建築物の建築、大規模の修繕(同法第二条第十四号の大規模の修繕をいう。)、大規模の模様替(同法第二条第十五号の大規模の模様替をいう。)若しくは用途の変更又は同項第三号に掲げる建築物の建築について確認する場合において同意を求められたときは、同項の規定により読み替えて適用される同法第六条第一項の政令で定める建築基準法令の規定を除く。)で建築物の防火に関するものに違反しないものであるときは、同法第六条第一項第四号に係る場合にあつては、同意を求められた日から三日以内に、その他の場合にあつては、同意を求められた日から七日以内に同意を与えて、その旨を当該行政庁若しくはその委任を受けた者又は指定確認検査機関に通知しなければならない。この場合において、消防長又は消防署長は、同意することができない事由があると認めるときは、これらの期限内に、その事由を当該行政庁若しくはその委任を受けた者又は指定確認検査機関に通知しなければならない。
- Where a fire chief or fire station chief is requested to give consent pursuant to the provision of the preceding paragraph, if the plan for the building is not in violation of the provisions of any Acts or any order or prefectural/municipal ordinance thereunder (if a fire chief or fire station chief is requested to give consent in cases where a building official or designated confirmation and inspection body makes a confirmation pursuant to the provisions of Article 6, paragraph (4) or Article 6-2, paragraph (1) of the Building Standards Act (including cases where these provisions are applied mutatis mutandis pursuant to Article 87, paragraph (1) of said Act) for the construction, major repair (meaning a major repair as set forth in Article 2, item (xiv) of said Act), major remodeling (meaning major remodeling as set forth in Article 2, item (xv) of said Act) of a building set forth in Article 6-3, paragraph (1), item (i) or item (ii) of said Act or for a change of intended purpose of such building, or makes a confirmation for the construction of a building as set forth in Article 6-3, paragraph (1), item (iii) of said Act, the provisions of the laws and regulations concerning the building standards specified by Cabinet Order as set forth in Article 6, paragraph (1) of said Act as applied by replacing the relevant terms and phrases pursuant to the provision of Article 6-3, paragraph (1) of said Act shall be excluded), the fire chief or fire station chief shall give consent within three days from the day on which he/she was requested to give consent in the case falling under Article 6, paragraph (1), item (iv) of said Act or within seven days from the day on which he/she was requested to give consent in other cases, and give notice to the administrative agency or person delegated thereby or the designated confirmation and inspection body to that effect. In this case, the fire chief or fire station chief, when he/she finds any grounds on which he/she cannot give consent, shall give notice to the administrative agency or person delegated thereby or the designated confirmation and inspection body to that effect by such time limit.
